File Note: <p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry is a small scale red category dyeing unit.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry was earlier granted consent to operate under Water Act, 1974 and Air Act, 1981, both valid upto 15.03.2023 for the production of dyeing of polyester cotton @ 07 T/day and dyed knitted cloth for washing @ 04 T/day with disposal of trade effluent @ 550.0 KLD and domestic effluent @ 2.7 KLD into 15 MLD CETP.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Earlier discharge of the industry was checked online through SCADA system and the industry was found discharging more effluent into the CETP during the month of July 2022 than the quantum of shares.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Accordingly directions u/s 33-A of Water Act, 1974 were issued to seal the additional machinery. In compliance of the directions one soft flow dyeing machine of capacity 150 KG and one winch machine installed by the industry was sealed during the visit on 31.08.2022.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The effluent samples from the outlet of industry leading to the inlet of the CETP were collected on 26.08.2021&nbsp;and as per the effluent analysis report, the concentration of such parameters i.e. COD and TDS was found as 1200 mg/l and 18324 mg/l, which are abnormally high as compare to the inlet design parameters of the CETP as per the DPR. Accordingly, the industry was given personal hearing before the Hon&rsquo;ble Chairman of the Board on 29.09.2022, wherein it was decided that:-</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;Environmental Compensation amounting to Rs. 2.0 lacs shall be imposed upon the industry for violations under the provisions of Water Act, 1974.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;The industry shall install pretreatment plant, so as to achieve the inlet effluent standards of CETP as per DPR.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry has failed to submit the compliance of above mentioned decisions till date and has also not deposited the EC amount of Rs. 2.0 lac imposed upon it. But the industry has submitted a request letter to the Board for reviewing the decisions taken during the hearing dated 29.09.2022 as the SPV is taking necessary measures to improve upon the quality of treated effluent of the CETP and the association is also spending huge money for the addition of new components alongwith the existing components of CETP.</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Now, the industry has applied for renewal consent to operate under Water Act, 1974 and Air Act, 1981. The industry had already deposited consent fee, which is adequate upto 30.06.2026 (Water) and 30.06.2027 (Air).</p> <p style="text-align: justify;">&middot;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry was visited by officer of RO on 06.03.2022 and observed that:-</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;The industry was in operation and was engaged in the process of dyeing of fabric.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;The industry has installed 11 Soft Flow machines of capacity (50 Kg x 1), (150 kg x 3), (300 Kg x 5), (600 Kg x 2). Out of above mentioned machinery, 01 soft flow dyeing machine of capacity 150 KG was found sealed.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;The entire trade effluent as well as domestic effluent was being discharged into dedicated sewer system leading to CETP 15 MLD after collecting in into a collection tank.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;The industry has installed a digital flow meter at the final outlet leading to CETP. The industry has installed SCADA system and the SCADA system of the subject cited industry was found connected with CETP server during visit.</p> <p style="text-align: justify;">5.&nbsp;&nbsp;&nbsp;&nbsp;The record from the online SCADA system was checked and it was found that the average discharge of the industry during the month of September 2022, October 2022, November 2022, December, 2022, January 2023 and February, 2023 were found as 404 KLD, 345 KLD, 389 KLD, 406 KLD, 426 KLD &amp; 435 KLD respectively, which are within the quantum of shares obtained and consent granted.</p> <p style="text-align: justify;">6.&nbsp;&nbsp;&nbsp;&nbsp;The industry has installed one boiler of capacity @ 4 TPH. Cyclone followed by double stage alkali scrubber was provided as an APCD and same was in operation. The industry was using pet coke as fuel in its boiler.&nbsp;Earlier air emission sample of the industry was collected on 04.11.2022 and the concentration of the SPM &amp; SO2&nbsp;were found within the limits prescribed by the Board i.e. 149 mg/Nm3&nbsp;&amp; 246 mg/Nm3&nbsp;against the limit of 500 mg/Nm3&nbsp;&amp; 400 mg/Nm3.</p> <p style="text-align: justify;">7.&nbsp;&nbsp;&nbsp;&nbsp;The industry has installed 01 DG set of capacities 350 KVA fitted with canopy.</p> <p style="text-align: justify;">It is intimated that the industry has submitted a representation w.r.t. EC of Rs. 2 Lac imposed to it. The industry has requested that a bank guarantee of Rs. 1 Lac has already been submitted to the Board and also undertake to submit an additional bank guarantee of Rs. 1 Lac. As such, the industry has proposed to submit total bank guarantee of Rs. 2 Lac in place of EC till the final decision in the matter as the representation at SPV level has been submitted to the Board and Government.</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">The industry has also requested to de-seal its soft flow machine which was earlier sealed by the Board due to excess discharge than the shares obtained. The industry in its request has mentioned that earlier a winch machine was installed by the industry, which was causing the excess discharge and now that winch machine has been removed from the premises.</p> <p style="text-align: justify;">Decision on the representation given by the SPV on behalf of 9 industries to the PPCB / Govt. for not to take action against the individual unit is yet to be decided. Consent cases of such cases are pending with the Board and are require to be decided in time bound schedule.</p> <p style="text-align: justify;">Further, one winch machine and one soft flow machine was sealed by the Board due to excess discharge comparing to the shares allotted. The industry has removed water intensive winch machine. The industry representative informed that they have taken several wastewater minimization measures. Steam condensate recovery system and cooling water recovery system have been re-boosted and recoveries have been improved. Number of baths have been optimised and wastage of water by the workers has been reduced. By virtue of these measures, wastewater generation has been reduced significantly. Contentions of the industry were verified during visit and it has been observed that the average monthly wastewater generation during last six months is much below the quantities of share allotted. Maximum effluent was observed in the month of February, 2023 which was 435 KLD against 550 KLD. In case, the soft flow of 150 Kg is de-sealed, expected effluent increase on account of this machine will be 20-25 KL/per day. Hence, the expected effluent even after the de-sealing of the machinery will remain well within the shares. The industry fulfils the other merits for grant of consent to operate under Water Act, 1974 and Air Act, 1981. However, industry is required to install water meter at the extraction (submersible pumps) to be connected to SCADA system of CETP to compare the extraction with the effluent generation to ensure that no byepass is to be operated.</p> <p style="text-align: justify;">It is recommended that:</p> <p style="text-align: justify;">1.&nbsp;&nbsp;&nbsp;&nbsp;The industry be directed to submit separate Bank Guarantee of Rs. 2 Lac in lieu of EC amounting Rs. 2 Lac till the final decision of the representation of SPV as an assurance that in case the decision will not be in favour of industry, then same could be en-cash by the Board.</p> <p style="text-align: justify;">2.&nbsp;&nbsp;&nbsp;&nbsp;Directions u/s 33-A of the Water Act, 1974 be issued to de-seal one soft flow machine of the industry.</p> <p style="text-align: justify;">3.&nbsp;&nbsp;&nbsp;&nbsp;Consent to operate under Air (Prevention &amp; Control of Pollution) Act, 1981 may be granted to the industry upto 30.06.2027 (adequacy of consent fee) with usual conditions.</p> <p style="text-align: justify;">4.&nbsp;&nbsp;&nbsp;&nbsp;Consent to operate under Water Act, 1974 may be granted to the industry for period of one year as the CETP is not achieving the prescribed effluent standards with suitable condition and special condition that:</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;i.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The discharge of the industry in any case shall not exceed the quantum of shares obtained as well as consented capacity.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;&nbsp;ii.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry shall not install any water polluting machinery without getting prior approval / NOC from the Board.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;iii.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Shares of CETP be "Demat" through Registrar of Companies (ROC), within 2 months, positively.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;iv.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;As such, the production/ effluent discharge in this consent is subject to the final allotment as described at "iii" above. Therefore, in case of variation of shares, the industry is bound to follow the production/ effluent discharge from their unit accordingly and shall obtain revised consents with modified figures of production and effluent discharge as per the final share allotment.</p> <p style="text-align: justify;">&nbsp;&nbsp;&nbsp;&nbsp;v.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;The industry will provide online flow meters at the inlet water source within 15 days and shall be connected to the SCADA system of CETP.</p> <p style="text-align: justify;">Competency :</p> <p style="text-align: justify;">&nbsp;</p> <p style="text-align: justify;">Consent : SEE</p> <p style="text-align: justify;">BG in lieu of EC &amp; Directions : Hon'ble Chairman of the Board</p> <p>&nbsp;</p>
