CTE/Fresh/SAS/2022/16604565 dated 28/1/2022, <span style="mso-spacerun: yes;">&nbsp;</span>valid upto 31/7/2022 for the development of Residential Plots @ 116 and Shop @ 32 Residential Plots @ 116 and Shop @ 32 subject to certain terms and conditions mentioned therein. The project proponent was granted consent to operate under the Water (Prevention and </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma;">Control</span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;"> of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for developing&nbsp;Residential Plots @ 116 and Shop @ 32 &amp; generation of eomestic effluent @ 327.24 KLD and its disposal into sewer (MC Zirakpur) after treatment in STP of 350 KLD&nbsp;vide no.&nbsp;CTOW/Fresh/SAS/2022/18739048 dated 5/7/2022, valid upto 31/3/2023 and vide no. The biodegradable component shall be treated by providing mechanical composter 305 kg/day) to produce compost, which will be disposed of/reused in an environmentally sound manner and the non-biodegradable solid waste shall also be disposed of in an environmentally sound manner.</span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">5.&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent shall also ensure that the hazardous waste and e-waste components of the solid waste shall also be segregated and the same shall be channelized to the authorized facility for such type of waste.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma;">The project proponent has now applied for obtaining renewal of consent to operate under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and for residential colony alongwith requisite documents. The project proponent has submitted layout plan approved from MC, Zirakpur as per which there are 202 plots in the project. The project proponent has submitted partnership deed of the promotor company M/s Dream Homes. The project proponent has submitted permission from MC, Zirakpur vide letter no. 1950 dated 22/8/2020 regarding disposal of treated water into sewer of MC. Further, the project proponent was not linked the consent fee with the application form. T</span><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">he site of the project was visited by the officer of the Board on 4/3/2023 and it was observed as under:</span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">1.&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent has sold the plots to individual builders whom have developed the independent floors and sold off as flats to individual residents. Around 540 flats having S+3 configuration have been constructed in 180 plots and 22 plots were empty. The representative informed that around 350 flats are occupied.</span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">2. <span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent has laid down sewer network, water supply line network and electricity supply network in the project. The pp has installed STP of 350 KLD which was not in operation during visit, but was made to start later on. Sample from outlet of STP was collected and sent to Ho lab. No water meter has been provided at the outlet of STP and reading of energy meter was 1722.2 kwh. No record of operation of STP is maintained. The treated water is being disposed into MC sewer and if required the same is being used in parks using flexible pipeline. During visit, the treated water after STP was being disposed into MC sewer. Location of STP is not marked on approved layout plan. The pp has not installed DG set as power back up for operation of STP incase of power failure. From physical appearance it also appeared that the STP is not operated regularly.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">3.&nbsp;&nbsp;&nbsp;&nbsp;<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent has installed a borewell and no water meter provided over it.</span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-IN;">4. <span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The project proponent has not installed mechanical composter for the in-situ management of wet solid waste but has provided 3 no. compartments for dumping of waste which were found empty. The solid waste is being lifted by 3<sup>rd</sup>&nbsp;party.</span></p> <p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma;">It is evident that the industry is continuously violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 as well as has failed to comply with the conditions imposed in the consent to operate earlier granted to it under the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974, willfully causing water pollution in the vicinity, thus violating the provisions of the said Act, intentionally and deliberately. It was proposed to refuse the consent to operate applied by industry under the Water (Prevention &amp; Control of Pollution) Act, 1974, after affording an opportunity of show cause notice/ personal hearing. Therefore, the project proponent was served show cause notice for refusal of renewal of consent to operate applied under the Water (Prevention &amp; Control of Pollution) Act, 1974 vide Board's letter no. 1909 dated 22/3/2023 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 6/4/2023.</span></p> <p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">The representative of the project proponent attended the personal hearing, but they neither submitted any written reply nor given satisfactory reply especially regarding the operation and efficiency of STP as well as regarding non achievement of the prescribed standards of the effluent sample collected during visit by the officer of the Board on 4/3/2023.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma;">After hearing the officers of the Board and the representative of the project proponent, the Senior Environmental Engineer (ZP-1) of the Board decided as under:</span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">A)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The renewal of consent to operate applied under the Water (Prevention &amp; Control of Pollution) Act, 1974 be refused. </span></p> <p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;">B)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>Recommendation be sent to issue notice u/s 33-A of the Water (Prevention &amp; Control of Pollution) Act, 1974 to the project proponent alongwith an opportunity of personal hearing before CEE (P) of the Board with the following proposed directions:</span></p> <p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">1)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent shall take all necessary steps to stop its construction at site and stop forthwith discharging any effluents/ wastewater into sewer/ into storm water drain/ inland surface water/ onto land for stagnation/ irrigation or through any mode.</span></p> <p class="MsoNormal" style="margin-left: 1.0in; text-align: justify; text-indent: -.5in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">2)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent shall not allow any new occupancy and shall not allow any new possession in the premises of the project, with immediate effect.</span></p> <p style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in 0in .0001pt 1.0in;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">3)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>That the project proponent will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken and it obtains valid 'consents to operate' of the Board under the provisions of the Water (Prevention &amp; Control of Pollution) Act 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981.</span></p> <p style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in 0in .0001pt 1.0in;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">4)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>That the Revenue Authorities shall not register any sale deed related to any plot/ flat/ house/ shop/ any other component of this project with immediate effect.</span></p> <p style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in 0in .0001pt 1.0in;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">5)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>That the Punjab State Power Corporation Ltd. authorities shall be directed to disconnect the supply of electricity available to the project/ not to release any further electric connection to the residential houses in the project.</span></p> <p style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in 0in .0001pt 1.0in;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;">c)<span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The Environmental Engineer, Regional office, SAS Nagar be requested to calculate the tentative environmental compensation to be imposed to the project proponent from the date of violation upto 31.03.2023. </span></p> <p class="MsoBodyText" style="text-align: justify; line-height: 150%; margin: 0in .7pt .0001pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin;
