<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">It is submitted that the industry was issued show cause notice for refusal of CTOs under Water Act, 1974 & Air Act, 1981 before CEE (B) on 09.03.2023, wherein it was decided that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">The brick kiln shall deposit the balance amount of environmental compensation imposed i.e. Rs. 8.75 lacs, within 7 days.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast;">In case of failure to deposit the EC, CTOs be refused and action u/s 31-A of Air Act, 1981 be initiated for closure of the brick kiln and cancellation of license issued by the Department of Food, Civil Supplies & Consumer Affairs.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>However, the industry has failed to deposit the EC as per the decisions of the Competent Authority.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Now the BKO has submitted a request dated 28.03.2023 as per which the industry has requested to consider EC of Rs. 1.0 lac for its actual operation for 4 months. The industry has also requested to consider its case at par with its other unit M/s Sidhu BKO, Village Amir Khas, Distt. Fazilka, wherein the industry has been asked to deposit the EC for the months of its actual operation. It is further submitted that in the matter of M/s Sidhu BKO, village Amir Khas, Distt. Fazilka, the unit was issued show cause notice for refusal of CTOs before the Chairman of the Board on 02.08.2022, wherein it was decided that the BKO shall deposit EC of Rs. 2.5 lacs (total) for actual operation of the BKO for a period of 10 months i.e. from Feb. 2019 to May 2019, October 2019 to Decemebr 2019 and From March 2020 till May 2020 (copy attached).</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-size: 12.0pt; mso-bidi-font-size: 11.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>If approved, the industry may be issued show cause notice for refusal of CTOs under Water Act, 1974 & Air Act, 1981 with an opportunity of personal hearing before Hon'ble Chiarman of the Board for final decision in the matter please.</span></p> |
