Based on the report of Regional Office, show cause notice was issued to the industry for above-said violations along with the opportunity of personal hearing, wherein, it was decided as under: -</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt .5in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">1.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry shall operate its pollution control devices regularly and efficiently, so as to achieve the prescribed standards.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt .5in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">2.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry shall submit a bank guarantee of Rs. 50,000 and the same shall be encashed by the Environmental Engineer, Regional Office-1, Ludhiana.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt .5in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">3.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The Environmental Engineer, Regional Office-I, Ludhiana shall process the consent application of the industry on merits.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt .5in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">4.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">Thereafter, industry applied for Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for Dyeing and washing of Knitted Fabric @ 2300 kgs/day, which was refused after giving an opportunity of show cause in writing, as the industry failed to submit any reply regarding the following points:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">1.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">As per DTP certificate dated 7.12.2022, the part of industry upto 500’ falls in mix land use along road front and remaining part falls in industrial. It has also been mentioned that green category industries are allowed in mix land area along road front.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">2.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry is using 500 feet along the road for plantation purposes and for ETP. The industry has not mentioned the total length in the Site plan.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">3.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">From above it is clear that the industry has commissioned a red category unit in mix land area, where only green category industries are allowed. However, some part of site falls under industrial and the industry is required to apply for consent under red category in that industrial area only.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">4.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">Also, the industry has not developed a complete plantation as per the Site plan.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">5.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The plantation already developed by the industry is not adequate as per the discharge for which consent is applied as stagnation was observed in the plantation area. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: 0in 0in .0001pt 32.35pt;"><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">6.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry is yet to develop a 2500 sq. yard on the plantation area as per the site plan and only small pockets of the plantation area have been developed.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 0in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> Thereafter the industry applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for dyeing of fabric @ 2300 kg/day and the application was returned to the industry for want of suitability of site report from DTP Ludhiana. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 0in;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> The industry has again applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for dyeing of fabric @ 2300 kg/day submitted a Site plan/Location plan, Proprietorship undertaking, Udhyam Certificate regarding small-scale proof, CA Certificate regarding fixed assets as of 31/03/2022 and a Manufacturing process flow chart. The documents submitted by the industry may kindly be perused.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 14.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> The industry was visited by the undersigned on 10.4.2023 and it was observed as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">1.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry was not in operation during the visit and engaged in the washing and finishing of the fabric. The industry has also proposed to carry out dyeing of fabric in the already installed machinery. Presently the industry is not carrying out any dyeing activity.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">2.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry has installed 3 Soft flow machines of capacity 300 kg (one) and 150 kg (two) along with other fabric finishing machines.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">3.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry has installed a boiler of 3 TPH with cyclone as APCD and adequate stack height and with sampling arrangement.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">4.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The washing effluent from soft flow machines is treated through ETP and the treated effluent is discharged onto land for plantation. The ETP of the industry is based on Physio-chemical treatment followed by Sand/Carbon filtration.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">5.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The treated effluent samples were earlier collected from the outlet of ETP and sent to Zonal Lab, Ludhiana for analysis. As per the report received from Air & Water Lab, Ludhiana vide no. 2481-83 dated 23.01.2023, the concentration all the polluting parameters is within the limits.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">6.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry has developed plantation area of 2400 sq. yard for discharge of treated effluent @ 35 KLD and the same has been shown in the Site plan attached.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">7.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">Further all the machinery (boiler, soft flow machine have been installed well beyond 500 ft. from the road.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">8.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">As per map if the distance from the median of the road is measured all the setup excepts plantation area is at a distance of 500 ft, which is in industrial zone, as per DTP, Ludhiana letter no. 2714 dated 07/12/2022, as per which the 500’ of the site from the front falls in Mix Land Zone and the remaining land falls in Industrial Zone. In case the distance is measured from the edge of the road, only small portion of ETP comes within 500 ft.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">9.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry has installed a Septic tank for the treatment of domestic effluent and treated effluent is discharged onto land for plantation.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -23.35pt; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">10.</span><span style="font-size: 7.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">The industry has submitted Environmental Compensation of Rs 50,000/- vide R. No. 37/5452 dated 20/12/2022 in compliance with the decisions of personal hearing.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -23.35pt; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">11. Further the industry has submitted letter issued by DTP Ludhiana vide no. 789 dated 28.3.2023 mentioning that 500 ft area from the road is mix land and beyond 500 ft the whole area is industrial. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -23.35pt; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">12. The distance of the polluting machinery from road was measured during visit and was found that whole machinery has been installed beyond 500 ft. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -23.35pt; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 50.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;"> </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: normal; background: white; margin: .3pt 5.05pt .0001pt 14.35pt;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d;">Since, all the water polluting machinery as well as boiler has been installed in industrial zone, and only plantation area has been developed in the mixed land area, it is therefore recommended that Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for short term (to check the adequacy of the physio chemical ETP to treat the dyeing effluent) with suitable terms and conditions, and with special condition that the industry shall got its effluent and air emission analyzed from Board's lab during this period.</span></p>
