<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">It is submitted that consent to <span style="background: white;">operate under the Air Act, 1981 was granted to the brick kiln vide no. CTOA/Renewal/FZL/2016/4873504 dated 21/12/2016, valid upto 30/09/2026 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day</span>, which were revoked vide letter no. 536 dated 07.02.2019.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Further, the brick kiln & DFSC was issued<span style="mso-spacerun: yes;"> </span>notice u/s 37 (I) and 41 of the Air Act, 1981 with an opportunity of personal hearing before the Chairman of the Board on 08.09.2022.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif';">No officer / official from the Deptt. of Food, Civil Supplies & Consumer Affairs attended the hearing and the representative of the brick kiln Sh. Mohinder Kumar, stated that they have adopted induced draught zig-zag technology & obtained completion certificate and requested to give one week for submission of consent applications alongwith deposit of environmental compensation. They also assured that no un-authorized fuel shall be used in the brick kiln at any time. After hearing the representatives of the brick kiln as well as officer of the Board, the Chairman of the Board has decided that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo3; background: white;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The brick kiln shall apply for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 as well as deposit requisite environmental compensation, within one week.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo3; background: white;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Regional Office, Faridkot shall process the consent applications to be submitted by the brick kiln under the Water Act, 1974 & the Air Act, 1981, on merits.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: .0001pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo3; background: white;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">During hearing, the representatives of the brick kiln have been made clear that in case of non-compliance of decision no. (1) above of the hearing within stipulated period and/or use of un-authorized fuel at any time, further action for closure of brick kiln shall be taken without giving any further notice / opportunity.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>Furthermore, the Regional Office has reported that the brick kiln has failed has neither applied for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 nor deposit requisite environmental compensation to the Board and it was recommended to give another opportunity of personal hearing to the industry before the Competent Authority (Hon'ble Chairman), however, the Competent Authority decided to put up the file with the latest status in the matter and the matter was pending with the RO. The above matter was being dealt through e-noting no. 18725501. <span style="mso-tab-count: 2;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span><span style="background: white;">Now, the brick kiln has applied for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 on dated 26.02.2023, for its operation after adopting induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. </span></span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-tab-count: 2;"> </span>The brick kiln has converted to </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">induced draft zig-zag technology</span><span style="font-family: 'Tahoma','sans-serif'; background: white;"><span style="mso-spacerun: yes;"> </span>and has submitted </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">completion certificate dated 28.12.2020 from the service provider.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span></span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has submitted an undertaking (attested by Charted Accountant) </span><span style="font-family: 'Tahoma','sans-serif';">as per which the BKO has used agro fuel for operating the brick kiln </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">with FCBTK technology from Feb 2019 to June 2019. We had stopped the fire because of rainy season. After that we had fired the kiln from Dec. 2019 to Feb. 2020 with FBTK technology. During the period from Feb, 2019 to Feb, 2020, the kiln has deposited Rs. 3,25,000/- (Rs. 25,000 for 13 months) as EC vide R. No. CBINR52022090710 dated 07/09/2022, which is adequate for its operation from Feb. 2019 till Feb. 2020. As the industry was found operating on FCBTK technology on 06.02.2019, 29.02.2020.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';"><span style="mso-tab-count: 2;"> </span>The brick kiln was visited by RO, FDK on 06.04.2023 and it was reported as under:- </span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln was not in operation. However, the brick kiln is making kutcha bricks at site. No fuel was found at kiln site. The representative of the brick kiln informed that the DFSC has not restored their license as the BKO does not have consent to operate of the Board and after the consent from the Board, license will be restored/ validated. Firing will be started after the consent to operate of the Board and license from DFSC. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet as required by the Board.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has now provided adequate sampling facilities with kiln stack to facilitate emission sampling.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The kiln has stabilized the periphery road/movement area with brick bats/keri.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has planted trees along its boundary.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l2 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has provided septic tank for the treatment of domestic effluent and same is being discharge onto land for plantation.</span><span style="font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormal" style="line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif';">If approved, c</span><span style="text-align: justify; text-indent: -22.5pt; font-family: Tahoma, 'sans-serif';">onsent to operate under the Water Act, 1974 may be granted to the brick kiln for production of bricks & tiles @ 30,000 nos./day using induced draft zig-zag technology for a period of 30.09.2030, with suitable conditions.</span></p>
