<p style="text-align: justify;">The agenda note and report / recommendations of AEE/EE, RO, may kindly be perused.</p>
<p style="text-align: justify;">The industry was granted ‘Consent to Operate’ under the Water Act, 1974 and Air Act, 1981, both valid upto 12.03.2023 for manufacturing of Plywood, Plyboard, Ply, Board, Laminated Board, Door, Panel, Furniture, Saw Mill, Veneer, Flush, etc of Same Nature @ 3000 Square meters/day, subject to condition mentioned therein.</p>
<p style="text-align: justify;">Directions u/s 33-A of the Water Act, 1974 & 31-A of the Air Act, 1981 were issued to the PSPCL authorities to restore the electricity connection of the industry temporary upto 12.03.2023.</p>
<p style="text-align: justify;">Now, the industry has applied for renewal of ‘Consent to Operate’ under the Water Act, 1974 and Air Act, 1981. The industry has already deposited consent fee, which is adequate upto 30.09.2031 under both acts.</p>
<p style="text-align: justify;">The industry was visited by AEE of RO on 15.03.2023 alongwith scientific staff and it was observed that:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The industry was not in operation for production of ply-board.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The industry has installed 03 vertical band saws (42”), 01 peeler (56”) & 02 hot presses (8 x 4).</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The industry has installed a thermopack of capacity 20 lac Kcal/hour. The industry has stored only wood to be used as fuel in thermopack. The industry has provided gravity dust settling chamber followed by cyclone separator as APCD with the thermopack. Air emission samples were collected during visit to the industry and as per analysis report, concentration of SPM was 284 mg/Nm3.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->4. <!--[endif]-->The boiler of capacity 02 TPH provided by the industry has now been disconnected from production line.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->5. <!--[endif]-->The industry had installed 02 glue kettles for manufacturing of glue. The industry has installed ETP for the treatment of trade effluent generated from the washing of glue kettles. ETP provided by the industry consists of collection tank, coagulation tank, primary tube settler, sand filter, Activated carbon filter & outlet. Components of ETP were in line/operation-able condition. Effluent samples not collected during visit as washing of glue kettles was not in operation.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->6. <!--[endif]-->The industry has installed two DG sets of capacity 250 KVA & 500 KVA, with canopies along with adequate stack height.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->7. <!--[endif]-->District Town Planner, Ludhiana vide memo no: 3876 M2A dated 09.12.2014 has informed that the industry does not fall under any Approved Master Plan/ Local Planning area. DTP had already issued its NOC vide above said memo.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->8. <!--[endif]-->The industry has obtained license from the Department of Forest vide no: 519 dated 08.12.2015 and as per this license, the industry is permitted to install three vertical band saw (42”), one peller (56”) and two hot presses of size 8 x 4. Machinery installed by the industry is as per the license.</p>
<p style="text-align: justify;">Thus, the industry is complying with the provisions of the Water Act, 1974 & the Air Act, 1981.</p>
<p style="text-align: justify;">Further, w.r.t. to your observations dated 23.03.2023, the RO has submitted that:-</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->The industry was in operation for production of ply-board during visit.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->The industry has obtained license from the Department of Forest vide no: 519 dated 08.12.2015 and as per this license, the industry is permitted to install three vertical band saw (42”), one peller (56”) and two hot presses of size 8 x 4. Machinery installed by the industry is as per the license.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->3. <!--[endif]-->The CPCB vide letter no: B-29016/04/07/IPC-1 dated 18.06.2021 had sought compliance of order dated 03.06.2021in O.A. no. 298/2020 titled as “Vineet Nagar vs Central Ground Water Authority and Ors.” of Hon’ble NGT w.r.t. industrial units manufacturing formaldehyde and its different resigns (including melamine formaldehyde, urea formaldehyde and phenol formaldehyde). However, in above said O.A. no., Hon’ble NGT has directed MoEF & CC, CPCB, SEIAA, PCBs/PCCs of all States/UTs to ensure compliance of law w.r.t. EIA notification dated 14.09.2006 [Entry 5(f) of the schedule]. It is pertinent to mention here that the Hon’ble NGT in above said O.A. no. has made reference to the order dated 03.06.2021 in O.A. no. 287/2020 titled as Dastak NGO v/s Synochem Organics Pvt. Ltd. & Ors and industries in question in O.A. no. 287/2020 were 15 formaldehyde manufacturing units of District Yamunanagar which are covered under 5(f) of the schedule of EIA notification 2006. The Hon’ble NGT has taken the same view in O.A. no. 840/2019 titled as Ayush Garg v/s UOI & Ors. The industry in question was M/s Om Chem, village Kurali, Tehsil Bilaspur, District Yamunanagar which is also a formaldehyde manufacturing unit. Thus, there was no reference to glue manufacturing units in all above said O.A.s and industries in question were formaldehyde manufacturing units which are covered under 5(f) of the schedule of EIA notification 2006. Moreover, manufacturing of glue is simple Step - Polymerization reaction of Phenol & Formaldehyde at temperature 80oC - 85oC. Accordingly, this office has taken up the matter with Head Office of the Board vide letter no. 3011 dated 27.07.2021 regarding covering glue manufacturing units under section 5(f) of the schedule of EIA notification dated 14.09.2006, however, no further correspondence has been received in this regard.</p>
<p style="text-align: justify;">Keeping in view of above, it is recommended that:</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->1. <!--[endif]-->Directions u/s 33-A of the Water Act, 1974 & 31-A of the Air Act, 1981 may be issued to the PSPCL Authorities to restore the electricity connection of the industry permanently.</p>
<p style="text-align: justify;"><!-- [if !supportLists]-->2. <!--[endif]-->Renewal of ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for period upto 30.09.2027 with suitable conditions and with special condition that the industry shall comply with any directions received from the Competent Authority of the Board in the matter of O.A. no. 298/2020 titled as “Vineet Nagar vs Central Ground Water Authority and Ors.” of Hon’ble NGT w.r.t. industrial units manufacturing formaldehyde and its different resigns (including melamine formaldehyde, urea formaldehyde and phenol formaldehyde).</p>
