It is submitted that the consents to operate under the Water Act, 1974 and Air Act, 1981 were granted to the industry vide nos.  CTOW/Renewal/FZR/2022/18878554 & CTOA/Renewal/FZR/2022/18878505 dated 15/07/2022, valid upto 30/06/2023, respectively, for manufacturing of Rice Bran Oil @ 20 TPD, & De-oiled cake @ 80 TPD, subject to certain conditions mentioned therein and following special conditions:- 1.    The industry shall ensure that no public nuisance is created in the nearby area. 2.    The industry shall get its stack emission samples analyzed from the Board's lab within 15 days before its commissioning for the coming season.                     Further the industry was visited by RO FDK on 11.11.2022 in regard to telephonic complaint dated 9.11.2022 and sampling was carried out as per which the particulate matter (PM) was found as 838 mg/Nm3 at 12% of CO2 for 4 TPH boiler with multi-cyclone as APCD, which was beyond the permissible limit of discharge. The effluent sampling was also carried out and as per the analysis report the conc of various parameters at outlet of ETP was within permissible limits of discharge for discharge onto land for plantation. During visit on 11.11.2022, as per the data sheet submitted by RO FDK, it was mentioned that a byepass line carrying untreated effluent was also being discharged into the plantation area. Accordingly the RO, FDK carried out effluent sampling from inlet & outlet of ETP and plantation area. As per analysis results, the effluent being discharged through outlet of ETP was found to be within prescribed limits, however, as per the analysis report, the conc. of parameter COD & BOD were beyond permissible limits in the effluent in plantation area.                      The interim report in the matter was processed by RO, FDK on 24.11.2020 incoporating the air emission samples while the analysis report of effluent samples were still awaited. Meanwhile, show cause notice for revocation of CTO under Air Act, 1981 was issued to the industry with personal hearing before CEE (B) on 12.12.2022. On 16.12.2022, RO, FDK incorporated the effluent analysis results in the e-noting and mentioned that the industry has failed to achieve the prescribed standards for BOD & COD parameters in the effluent samples collected from the plantation area.                     Accordingly, the industry was issued only notice before revocation/ cancellation of consent to operate under the provisions of Air Act, 1981 with an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 22.12.2022, wherein it was decided that consents to operate granted to the industry under the provisions of the Air Act, 1981 be revoked and notice u/s 31-A of the Air Act, 1981 be issued to the industry.                     Further, the industry was issued notice u/s 31-A of Air Act, 1981 with an opportunity of personal hearing on 09.02.2023 wherein it was decided that:- 1.    Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 be issued to the effect that the industry shall not operate its unit without taking adequate pollution control measures as well as without obtaining consents of the Board under the Water Act, 1974 & Air Act, 1981. 2.    Environmental Engineer, Regional Office, Faridkot to ensure the compliance and to submit report for taking further necessary action in the matter.                        Now the industry has applied for obtaining fresh consent to operate under the Air Act, 1981 from the Board through online system alongwith requisite documents under Orange category for manufacturing of Rice Bran Oil @ 20 TPD, & De-oiled cake @ 80 TPD.                     The industry was visited by RO, FDK on 22.03.2023 and it was reported as under:- 1.    The industry i.e. solvent extraction plant was not in operation at the time of visit. The representative of the industry informed that the industry has closed its operation. 2.    The industry has installed boiler furnace of capacity 04 TPH with multi-cyclone as APCD. The industry has provided stack of adequate height with the boiler furnace. The industry has carried out repair of rotary valve of multicyclone so that dust collected at the bottom of cyclone is removed continuously. 3.    The industry has constructed closed room type shed for temporary storage of fuel ash before its final disposal, with water sprinkling arrangements to store the ash in wet condition. 4.    The industry has installed ETP for treatment of trade effluent generated from industrial process. Component of the ETP installed by the industry are Oil & Grease Trap-Equalization Tank- Aeration Tank-Sedimentation tank- Sludge drying beds and Final outlet. ETP was found in line and operationable condition. The industry has provided flow meter at the outlet of ETP and energy meter with ETP. The record of operation of ETP was being maintained by the industry. 5.    The industry has developed plantation in an area of about 1 acre adjoining to the industry.                     The matter regarding report under the provisions of Water Act, 1974 is processed through e-noting no. 18755669 seperately.   If approved, Consent to operate under the Air Act, 1981 may be granted for a period upto 31.03.2024 for manufacturing of Rice Bran Oil @ 20 TPD & De-oiled cake @ 80 TPD with suitable conditions as per the policy of the Board and with addition condition that the industry shall get its emission analyzed from Board’s lab, within a period of one month after its commissioning during the upcoming season.  Competency: CEE(B)
