The industry was earlier granted consents to operate vide nos. CTOW/Fresh/FZR/2017/5949852 and CTOA/Fresh/FZR/2017/5949695 dated 24/07/2017 under the Water Act, 1974 and the Air Act, 1981, respectively for operation of cold storage facility for potato, fruits & vegetables @ 5300 MTD, subject to the conditions mentioned therein, valid upto 30/09/2021 each in industry ID i.e. O16FZR4164220 under the name & designation of applicant i.e. Manik Gupta, (Partner).</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">Thereafter, the industry has obtained consent to operate under the Air Act, 1981 for a period upto 31.12.2025</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 for operation of cold storage unit for operation of cold storage facility for potato, fruits & vegetables @ 5300 MTD, under green category by creating new industry ID i.e. G23FZR334477 under the name & designation of applicant i.e. Dheeraj Gupta, (Partner).</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">The industry has submitted partnership deed executed on 23.04.2016 stating that Sh. Manik Gupta S/o Sh. Surinder Kumar Gupta, R/o Friends Enclave, Ferozepur Road, Zira, Distt. Ferozepur and Sh. Deeraj Gupta S/o Sh. Ashwani Kumar Gupta, R/o Friends Enclave, Ferozepur Road, Zira, Distt. Ferozepur have decided to carrying on the business of cold storage under the name & style of M/s Gupta Brothers Cold Storage. However, the industry has failed to apply for obtaining consent to operate of the Board under the Water Act, 1974.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">Further, the industry has submitted special power of attorney on 20.05.2019 in which Sh. Manik Gupta, Partner of the firm, has authorized to Sh. Deeraj Gupta, Partner of the firm, to manage the affairs of above said cold store.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">There is no change in production capacity as per the last CTO granted to it. The industry has deposited Rs. 58,800/- vide Receipt No. 251102432 dated 23.02.2023 as consent to operate fee under the Water Act, 1974, against the fixed assets of Rs. 446.92 lacs as mentioned in certificate of CA dated 22/02/2023 as on 31/03/2022. The consent fee deposited by the industry is adequate upto 30/09/2026 under the Water Act, 1974, after deducting 200% penalty fee.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">No complaint is pending against the industry and it was found complying with consent conditions as well as code of practice during last visit of officer of this office.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 has decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 10.4pt; background: white;"><span style="font-size: 13.5pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">Keeping in view of above mentioned facts, it is, therefore, recommended that consent to operate granted under the Water Act, 1974 may be renewed to the industry for a period upto 31/12/2025 for operation of cold storage facility for potato, fruits & vegetables @ 5300 MTD, with suitable conditions as per the policy of the Board, please.</span></p> |
