<p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span style="mso-spacerun: yes;"> </span><span style="color: black;"><span style="mso-spacerun: yes;"> </span></span><span style="mso-spacerun: yes;"> </span>It is submitted that Consent to operate under the Air Act, 1981 was granted to the brick kiln vide no. <span style="mso-spacerun: yes;"> </span>CTOA/Renewal/FZL/2016/4583814 dated 13.10.2016, valid upto 30.09.2025 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day, subject to the conditions mentioned therein.</p>
<p class="normalCxSpFirst" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 115%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="mso-spacerun: yes;"> </span><span style="color: black;"><span style="mso-spacerun: yes;"> </span></span><span style="mso-spacerun: yes;"> </span><span style="color: black;">The brick kiln was made aware of these directions dated 28.05.2019 of the State Govt. along with a request to deposit environmental compensation vide this office letter no. 4404 dated 29.08.2019. However, no reply was received from the brick kiln. The kiln neither applied for varied consent to operate for operation of brick kiln with induced draft technology with zig-zag setting nor it has deposited environmental compensation fee. Accordingly, consent to operate under the Air Act, 1981 was cancelled vide no. 685 dated 29.01.2020.</span></p>
<p class="normalCxSpMiddle" style="margin-right: 1.35pt; mso-add-space: auto; text-align: justify; line-height: 115%; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes;"><span style="mso-spacerun: yes;"> </span><span style="color: black;"><span style="mso-spacerun: yes;"> </span></span><span style="mso-spacerun: yes;"> </span>To verify the compliance status the brick kiln, the kiln was visited by AEE on 11.04.2022 and it was observed as under:-</p>

The brick kiln has adopted induced draft technology. No raw material/ fuel was found at kiln site.</p>
<p class="normalCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo1; border: none; mso-padding-alt: 31.0pt 31.0pt 31.0pt 31.0pt; mso-border-shadow: yes; margin: 0in 1.35pt .0001pt .25in;"><!-- [if !supportLists]--><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span><!--[endif]-->The brick kiln has upgraded its kiln into induced draft zig-zag technology, however no completion drawing has been submitted in this regard. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet.</p>
<p class="MsoNormalCxSpFirst" style="text-align: justify; line-height: 115%; background: white;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>During visit, the representative of the industry was advised to apply for consent to operate of the Board under the Water Act, 1974 and the Air Act, 1981 and to deposit Environment Compensation to the Board. But the brick kiln failed to do the needful, so far.</p>
<p class="MsoNormalCxSpMiddle" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; mso-add-space: auto; text-align: justify; line-height: 115%; background: white;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>The brick kiln was issued notice u/s 31-A of Air Act, 1981 vide letter no. 2602 dated 01.06.2022 to file objections (if any) within 10 days on the proposed directions, but the brick kiln failed to submit any reply in the matter.</p>
<p class="MsoNormalCxSpMiddle" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; mso-add-space: auto; text-align: justify; line-height: 115%; background: white;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>In view of above, the brick kiln has been afforded an opportunity of personal hearing on 07.07.2022.</p>
<p class="MsoNormalCxSpMiddle" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; mso-add-space: auto; text-align: justify; line-height: 115%; background: white;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>During hearing, the Partner of the brick kiln stated that earlier they could not operate the brick kiln due to rains as well as non-receipt of payment from MNREGA, however has adopted induced draught zig-zag technology & obtained completion certificate and requested to give 20 days for submission of consent applications.</p>
<p class="MsoNormalCxSpMiddle" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; mso-add-space: auto; text-align: justify; line-height: 115%; background: white;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>After hearing the Partner of the brick kiln and officer of the Board, the Chief Environmental Engineer (B) of the Board has decided that:</p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 115%; background: white; margin: 0in 0in 6.0pt .5in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">1. The brick kiln shall apply for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 as well as deposit requisite environmental compensation, within 20 days.</span></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 115%; background: white; margin: 0in 0in 6.0pt .5in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">2. Regional Office, Faridkot shall process the consent applications to be submitted by the brick kiln under the Water Act, 1974 & the Air Act, 1981, on merits.</span></p>
<p class="MsoNormalCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.5in; line-height: 115%; background: white; margin: 0in 0in 6.0pt .5in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">3. During hearing, the Partner of the brick kiln has been made clear that in case of non-compliance of decision no. (1) above of the hearing within stipulated period, further action for closure of brick kiln shall be taken without giving any further notice / opportunity.</span></p>

<p class="MsoNormalCxSpMiddle" style="margin-right: 7.3pt; mso-add-space: auto; text-align: justify; line-height: 115%;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="font-family: 'Tahoma','sans-serif'; mso-bidi-font-family: 'Arial MT'; background: white;">The license of the brick kiln cancelled by DFSC Fazilka on 09.03.2023. </span></p>
<p class="MsoNormalCxSpLast" style="margin-right: 7.3pt; mso-add-space: auto; text-align: justify; line-height: 115%;"><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>Now, the brick kiln has applied<span style="mso-bidi-font-family: Arial;"> for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 on dated 24.03.2023, for its operation after adopting induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. Details of the case are as under:-</span></p>

Ravi Kant Bhateja, R/o Abohar, Distt. Fazilka and 4. Sh. Omesh Kumar Bhateja S/o Ranvir Kant Bhateja, R/o Abohar, Distt. Fazilka, have decided to enter into partnership in the firm name & style of M/s Jagdish Chander BKO, Village Raipura, Tehsil Abohar, Distt. Fazilka w.e.f. 01.12.2016. </span></p>

Fazilka have given their land on lease to the brick kiln M/s Jagdish Chander BKO, Village Raipura, Tehsil Abohar, Distt. Fazilka, for 10 years i.e. from 01.05.2016 to 30.04.2026 for Rs. 50,000/- per year.</span></p>
