<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry was visited by officers of the Board on 12.02.2020 and found violating the provisions of the Water Act, 1974 and the Air Act, 1981. Accordingly, the industry was issued SCN for revocation/cancellation of CTOs under the Water Act, 1974 and the Air Act, 1981 along with an opportunity of personal hearing before Hon’ble Chairman of the Board on 06.08.2020, wherein it was decided as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -40.5pt; mso-text-indent-alt: -.25in; line-height: 12.6pt; mso-pagination: none; mso-list: l2 level1 lfo1; background: white; text-autospace: none; margin: 0in 0in .0001pt 40.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;"><span style="font: 7.0pt 'Times New Roman';"> </span>i.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The Regional office shall visit the industry, verify the contentions of the industry, collect the effluent / emission samples and submit the complete detailed report including the condition of ETP etc. alongwith conclusive recommendations in the matter, within 15 days.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -40.5pt; mso-text-indent-alt: -.25in; line-height: 12.6pt; mso-pagination: none; mso-list: l2 level1 lfo1; background: white; text-autospace: none; margin: 0in 0in .0001pt 40.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;"><span style="font: 7.0pt 'Times New Roman';"> </span>ii.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">In case the industry is found violating the provisions of the Water Act, 1974 & Air Act, 1981, Environmental Compensation will be imposed on the industry w.e.f. 12.02.2020 onwards.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -40.5pt; mso-text-indent-alt: -.25in; line-height: 12.6pt; mso-pagination: none; mso-list: l2 level1 lfo1; background: white; text-autospace: none; margin: 0in 0in .0001pt 40.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;"><span style="font: 7.0pt 'Times New Roman';"> </span>iii.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Further action in the matter shall be decided accordingly on merits.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Thereafter, the industry was again visited by officer of the Board on 10.05.2022 and found the industry to be majorly complying with the earlier observations. Accordingly, Competent Authority of the Board directed the Regional Office to get these minor violations complied from the industry and since the industry was <span style="background: white;">not operating its saila plant for which it was earlier granted consents, it was directed to request the industry obtain varied consents for the processes being operated by it i.e. steamed rice which is a non-water polluting process.</span> The industry was requested to obtain varied consents for the processes being operated by it i.e. steamed rice vide Board’s letter no. 3608 dated 21.07.2022.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">In compliance to the mandate of the Govt. regarding “environmental surveillance campaign”, the industry was visited by a team comprising of Er. Guneet Sethi, EE,RO, Faridkot and Er. Amandeep Singh, AEE, RO, Faridkot on surprise basis on 23.11.2022 and it was observed as under:-</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .3in; text-align: justify; text-indent: -.3in; line-height: 12.6pt; mso-pagination: none; mso-list: l1 level1 lfo2; background: white; text-autospace: none;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry needs to provide plantation along remaining two sides of the industrial boundary wall.</span></p>

However, fuel ash was also found stored in open in huge heaps in a plot adjacent to the industry. The industry has not provided boundary wall along plot being used for storage of fuel ash and hence causing nuisance in the vicinity.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .3in; text-align: justify; text-indent: -.3in; line-height: 12.6pt; mso-pagination: none; mso-list: l1 level1 lfo2; background: white; text-autospace: none;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Wall around rice husk storage area was of inadequate height and no wind screen has been provided above this wall.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .3in; text-align: justify; text-indent: -.3in; line-height: 12.6pt; mso-pagination: none; mso-list: l1 level1 lfo2; background: white; text-autospace: none;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Septic water was observed in the equalization tank of the ETP.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry has not applied for varied CTOs under Water Act, 1974 & Air Act,1981 for production of steamed rice only, in compliance to Board’s letter no. 3608 dated 21.07.2022 as mentioned at point no. 3. Above.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"><span style="mso-spacerun: yes;"> </span></span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Since, the industry is not complying with the provisions of the Water Act, 1974 and the Air Act, 1981, therefore, t</span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';">he industry was issued show cause notice before revocation of consents to operate granted under the provision of Water Act, 1974 & Air Act, 1981 </span><span lang="EN-IN" style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT'; mso-ansi-language: EN-IN;">alongwith an opportunity of personal hearing on 19.01.2023. But no representative of the industry attended the hearing. However, an email dated 18.01.2023 has been received from the industry and requested for another hearing. </span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 12.6pt; background: white;"><span lang="EN-IN" style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-bidi-language: PA;"> In view of above, the industry has been afforded another opportunity of personal hearing </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">for revocation /cancellation of consents to operate granted under the provision of Water Act, 1974 & Air Act, 1981 </span><span lang="EN-IN" style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-ansi-language: EN-IN; mso-bidi-language: PA;">on 28.02.2023.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"> During hearing, the representative of the industry submitted a written reply of the show cause notice, which is as under:-</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 12.6pt; mso-pagination: none; mso-list: l0 level1 lfo3; background: white; text-autospace: none; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';">The application has been applied for obtaining revised consent under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.25in; line-height: 12.6pt; mso-pagination: none; mso-list: l0 level1 lfo3; background: white; text-autospace: none; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';">That all the other stipulation mentioned in the show cause has also been complied with except the boundary wall around plantation area which is under process.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Arial MT';"> After hearing the representatives of the industry and the officers of the Board, the Chairman of the Board decided that:-</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 12.6pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">1.</span><span style="font-size: 12.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"> </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry shall maintain the record regarding disposal of fly ash along with vehicles detail and route on real time basis available on the main gate of the industry immediately so that the same can be verified by the visiting officer.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 12.6pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">2.</span><span style="font-size: 12.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"> </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry shall submit the record regarding usage of fuel / fly ash on monthly basis to the Board alongwith the details for which purpose fly ash was used.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 12.6pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">3.</span><span style="font-size: 12.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"> </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">The industry shall manage, treat and dispose-off the solid waste generated from the project premises in accordance with the various provisions of the Solid Waste Management Rules, 2016.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: .25in; text-align: justify; text-indent: -.25in; line-height: 12.6pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">4.</span><span style="font-size: 12.0pt; font-family: 'Times New Roman','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"> </span><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">Regional Office, Faridkot shall visit the industry to verify the compliance made by the industry and shall process the consent application submitted by the industry on merits.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; margin-left: 4.5pt; text-align: justify; line-height: 12.6pt; mso-pagination: none; background: white; text-autospace: none;"><span style="font-size: 12.0pt; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-spacerun: yes;"> </span>Now the industry has applied for obtaining varied consents to operate under the Water Act, 1974 and the Air Act, 1981 from the Board through online system alongwith requisite documents under Red category for manufacturing of Parboiled/Saila Rice @ 4 TPH and Steamed Rice along with sortex machines @ 8 TPH, with requisite documents and adequate consent fees. Accordingly, the industry has deposited Rs. 5,33,000/- vide UTR No. SBINR52023010725155339 dated 07.01.2023 as consent to operate fee under the Water Act, 1974 and Rs. 5,33,000/- vide UTR No.<span style="mso-spacerun: yes;"> </span>SBINR52023010725154026 dated 07.01.2023 as consent to operate fee under the Air Act, 1981, which is adequate for a period upto 31.03.2028 under red category.<span style="mso-spacerun: yes;"> </span></span></p>

Accordingly, the industry has deposited Rs.<span style="mso-spacerun: yes;"> </span>56400/- vide UTR No.<span style="mso-spacerun: yes;"> </span>SBIN123007862776 dated 07.01.2023 deposited as NOC Fee, which is adequate. </span></p>
