It is submitted that the project proponent was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2021/14677274 dated 02/06/2021 valid upto 31/12/2021 for Sale Purchase and Servicing of Four Wheeler @ 40 Numbers/Day, subject to suitable and additional conditions that: 1) The service station shall provide environmental data board outside the premises. 2) The workshop shall maintain the record of fresh water consumed in process and treated waste water discharged after ETP. 3) The workshop shall apply authorization under Hazardous Waste Management Rule 2016 within 15 days. The project proponent was also granted consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2021/14676787 dated 26/05/2021 having validity upto 30/09/2025 for Sale Purchase and Servicing of Four Wheeler @ 40 Numbers/Day, subject to certain conditions as mentioned therein. Thereafter, the project proponent was applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974. The project site was visited by undersigned and found that the project proponent is not complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, willfully causing water pollution in the vicinity as well as does not comply with the conditions mentioned in the consent to operate earlier granted to it under the Water (Prevention & Control of Pollution) Act, 1974, thus, violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and intentionally and deliberately. Therefore, the project proponent was served show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 alongwith an opportunity to submit reply within 7-days vide Board's letter no. 7219-20 dated 30/11/2022. But the project proponent was failed to submit its reply. After that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 was refused. Now, the project proponent has again applied for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974, with same capacity. The project proponent has submitted its CA certificate mentioning decrease in its fixed assets from Rs. 56.5 lakh to 52.01 lakh as on 31/03/2022. The industry has not submitted any reason/ undertaking regarding the deduction of its fixed assets. However, the fees slab is same. Earlier, the project proponent had deposited Rs. 52,300/- (Rs. 25700/- vide UTR no. 23314392741DC dated 28.12.2020 under Water Act, 1974, which is adequate upto 30.09.2026. The project proponent has submitted analysis report of outlet of ETP & the sample collected by Noida Testing Laboratories on 06.10.2022 and the results are as under: pH – 7.16,  TSS – 20, TDS – 456, BOD – 20, COD – 70 & O & G – 05 The results are within the prescribed limit of the Board. The project proponent has submitted compliance report of the previous Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 granted to it, but not submitted compliance of special conditions. The project site was visited by AEE of this office on 12/04/2023 and during visit, it was observed that: <p class="MsoListParagraphCxSpFirst" style="margin-left: 1.25in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;">1.    The industry is a workshop of 04 wheeler maruti vehicles. The industry is having one body workshop,01 paint booth and washing station. <p class="MsoListParagraphCxSpMiddle" style="margin-left: 1.25in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;">2.    The effluent generated from washing area is being treated by ETP and the entire treated effluent is being discharge into sewer. The effluent sample was collected from the outlet of ETP and same was sent to Board’s lab for analysis. The industry has provided water meter at the outlet of ETP and reading was noted as 184.97 m3 and energy meter noting as 370 Kwh. The industry shown the record register of water meter as well as energy consumption in the operation of ETP and after checking it was noted that the energy consumption meter are mismatching and the workshop manager was advised to maintain the record properly. 3.    During visit, the tree leafs and plastic bottles are floating in the tube settling tank. Photographs enclosed in attachment. <p class="MsoListParagraphCxSpFirst" style="margin-left: 1.25in; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1;">4.    The industry has not provided environmental data board at the main entrance gate of the site. 5.    During visit, oil was found spillage on the floor in the hazardous waste room and roof sheets was found broken. The representative of the industry was advised to repair the storage of hazardous waste room immediately and also make partition in the room for different categories of hazardous waste.   From the above, it is clear that the industry is not serious to maintaining the record of ETP as well as hazardous waste storage/ hazardous waste management. The industry has also failed to comply with previous consent conditions granted under Water (Prevention & Control of Pollution) Act, 1974. Keeping in view of the above, it is recommended that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be refused, due to above said violations.   Competency: Senior Environmental Engineer
