It is intimated that the application for obtaining renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1981 and the Air (Prevention & Control of Pollution) Act, 1981 were scrutinized and the following shortcomings/ observations were made:
A) Earlier, the consent to operate granted to the industry by the Board on 9/12/2016 under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, valid upto 30/9/2021 alongwith following main special conditions:
4. The industry shall not carry out the spray painting in its premises till installation of paint booth with necessary pollution devices.
5. The industry will apply for authorization under Hazardous and Other Wastes (Management, Handling and Trans-boundary Movement) Rules, 2016 of categories @ 5.1 and 21.1 and 21.2, whichever is applicable, within one month.
As per record of OCMMS, the industry has not obtained authorization as required under the HWM Rules, 2016 for categories @ 5.1 and 21.1 and 21.2 after elapsing of more than 6 years period.
B) The compliance report of consent conditions and request letter dated 10/4/2023 submitted by the industry with the application, has not been signed by authorized signatory.
C) The industry has submitted the year-wise CA certificate as on 31/3/2022 only, as such, the industry needs to submit latest CA certificate of un-depreciated value of fixed assets as on 31/3/2023.
D) As per covering/ request letter dated 10/4/2023 in which it has been mentioned at Sr. no. 5 "The increase in value of plant & machinery over the years is due some replacement". Therefore, the industry is required to submit details of bills and other details which show what type of addition/ replacement of in plant and machinery.
In view of the above, the industry was requested to send/ upload the reply to the observations/ shortcomings as mentioned above within 2-days. Till then your application may be treated as incomplete.
