File Note: <p class="MsoNormal" style="text-align: justify;">In this regard, it is submitted that the industry is engaged in the business of Rice Shelling.</p> <p class="MsoNormal" style="text-align: justify;"><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The industry was granted 'consent to operate' under the Water (Prevention &amp; Control of Pollution) Act, 1974 vide no. CTOW/Renewal/NSW1/2021/16895087 dated 28/10/2021 valid upto 30/09/2022 for processing of Paddy @ 3 TPH for manufacturing of Rice @ 1.95 TPH, Rice Husk @ 0.6 TPH, Rice Bran @ 0.15 TPH, Phuk @ 0.15 TPH and Storage @ 0.15 TPH alongwith domestic effluent @ 0.3 KLD to be utilized onto land for plantation after septic tank, subject to the conditions mentioned therein.</p> <p class="MsoNormal" style="text-align: justify;"><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 2;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>The industry was granted 'consent to operate' under the Air (Prevention &amp; Control of Pollution) Act, 1981 vide no. CTOA/Renewal/NSW1/2021/16895029 dated 28/10/2021 valid upto 30/09/2022 for processing of Paddy @ 3 TPH for manufacturing of Rice @ 1.95 TPH, Rice Husk @ 0.6 TPH, Rice Bran @ 0.15 TPH, Phuk @ 0.15 TPH alongwith one dryer equipped with cyclone separator as APCD, subject to the conditions mentioned therein.</p> <p class="MsoNormal" style="text-align: justify; text-indent: 76.5pt;"><span style="mso-bidi-font-family: Tahoma;">Now, the industry has applied for renewal of 'consent to operate' under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981. It has submitted the copy of compliance reports of previous consents, emission analysis report issued by PBTI dated 15.03.2023, compliance of code of practice for such units and CA certificate. It has submitted that Rs. 9.92 lacs have been increased in the fixed assets due to purchase of some machines / furniture. However, the capacity of the unit has not been increased with this machinery and the industry has applied for same production capacity.</span></p> <p class="MsoNormal" style="text-align: justify;"><strong><span style="mso-bidi-font-family: Tahoma;">Detail of Consent Fees: </span></strong></p> <p class="MsoNormal" style="text-align: justify;"><span style="mso-bidi-font-family: Tahoma;">The industry has submitted the CA Certificate for fixed assets of Rs. 1.37 cr as on 31.08.2022. The consent fees were adequate under both the Acts upto 13.05.2024. Now, the industry again has deposited the consent fees under both the Acts as under:</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><u><span style="mso-bidi-font-family: Tahoma;">Under Water Act, 1974:</span></u></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span style="mso-bidi-font-family: Tahoma;">Rs. 42,000/- vide R.no. SBIN423062986731 dated 03.03.2023.</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><u><span style="mso-bidi-font-family: Tahoma;">Under Air Act, 1981:</span></u></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span style="mso-bidi-font-family: Tahoma;">Rs. 42,000/- vide R.no. SBIN423062991383 dated 03.03.2023.</span></p> <p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: normal;"><span style="mso-bidi-font-family: Tahoma;">The consent fees under both the Acts is adequate upto 30.09.2028 and NOC regularization fees is adequate for one year.</span></p> <p class="MsoNormal" style="text-align: justify;"><span style="mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>As per emission analysis report submitted by the industry the concentration of particulate matter is 41.2 mg/Nm<sup>3</sup>, which is within permissible limits. There is no action pending against the unit as per record file. </span></p> <p class="MsoNormal" style="text-align: justify;"><span style="mso-bidi-font-family: Tahoma;"><span style="mso-spacerun: yes;">&nbsp;</span><span style="mso-tab-count: 1;">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span>In view of above, if approved, the industry may be granted renewal of 'consent to operate' under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 up to<span style="color: red;"> </span>30.09.2028, subject to suitable conditions please.</span></p>
