CTOW/Fresh/FGS/2020/11944652 dated 04/02/2020 valid upto 30/09/2022 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2022/17574870 dated 11/03/2022 valid upto 31/12/2022 for the manufacturing of Forged Blanks & Other Forged Products @ 2.5 MTD. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">It is intimated that Hon’ble NGT while considering the issue of Polluting activities in Mandi Gobindgarh in the matter of OA no. 924/2019 titled as Neeraj Goyal Vs State of Punjab vide order dated 01-10-2020 has directed as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><strong><em><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“In the context of directions to shift rolling mills from coal to PNG we direct the State PCB to ensure that if such shifting does not take place, the non-compliant units be closed till compliance. This should apply not only to rolling mills but also to other similarly placed industries operating on coal. Wherever there is non compliance, the State PCB may take coercive measures, including closure, recovery of compensations and initiating prosecution, following due process of laws.” </span></em></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">Accordingly, Punjab Pollution Control Board has issued directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 to all the industrial units (not only Rolling Mills) operating on coal as fuel in Mandi Gobindgarh as under: </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Calibri;">“That all the industrial units in Mandi Gobindgarh operating on coal as fuel in any form shall shift from coal to PNG on or before 31-12-2020.”</span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1;">Now, the subject cited industry has shifted its unit from Coal to PNG.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">Now, the industry has applied for varied consent to operate under the Water Act, 1974 and Air Act, 1981 with requisite documents under Orange category after shifted its fuel from Coal to PNG. The industry has deposited Rs. 42000/- vide UTR no. AXIC230707966340 dated 11/03/2023 and Rs. 42000/- vide UTR no. AXIC231010731820 dated 11/04/2023 under Water Act, 1974 and Rs. 42000/- vide UTR no. AXIC230707966919 dated 11/03/2023 and Rs. 42000/- vide UTR no. AXIC231010733722 dated 11/04/2023 under Air Act, 1981 against the un-depreciated fixed assets of Rs. 185.06 Lacs as on 28/02/2023 as per CA certificate dated 07/03/2023 which is adequate </span><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">upto 30/09/2030 </span></strong><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">as per Board's Office Order dated 29/10/2018 </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin;">after deducting penalty charges and NOC regularization fee.</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;"> The industry has submitted that cost of fixed assets decreased from Rs. 56.03 Lacs to Rs. 185.06 lacs due to the modifications in furnace for shifting from coal to PNG. There is no increase in pollution load as well as production capacity.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; color: black; mso-themecolor: text1;">Undersigned has visited subject cited </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">industry on <strong>28.03.2023</strong> and<span style="color: black; mso-themecolor: text1;"> it was </span></span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri; mso-fareast-theme-font: minor-latin; color: black; mso-themecolor: text1;">observed as under: </span></p>

<p class="MsoNormal" style="margin-left: -4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: 76.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">Further, the industry is located in the <strong style="mso-bidi-font-weight: normal;">industrial area </strong>of Mandi Gobindgarh.</span><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';"> </span></strong></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 30/09/2030.</strong></span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in; margin: 12.0pt -.9pt 10.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; text-justify: inter-ideograph; text-indent: -4.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Raavi;"><span style="mso-tab-count: 3;"> </span><strong>The Board shall continue to grant consent to</strong> <strong>establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; text-indent: 1.0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Arial;">In view of above, it is therefore recommended that the industry may be granted varied </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 30/09/2030</strong><strong style="mso-bidi-font-weight: normal;"> </strong>to the industry with suitable conditions and special conditions that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">a)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">T</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">he industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">f)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall install sensor/Hooting system to sensitize the labor/worker as and when there will be nay leakage of gas occurs.</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 27.0pt; mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -27.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-bidi-font-weight: bold;"><span style="mso-list: Ignore;">h)<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: Calibri;">The industry shall provide thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the industry.</span></p>
