The marriage palace was earlier granted Consent to operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 vide and Air (Prevention &amp; Control of Pollution) Act, 1981, which were valid up to 30.09.2020. But the marriage palace was failed to apply for renewal of same.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">Earlier, the marriage palace was visited on 02.08.2022 and 29.08.2022 and observed that the STP was in defunct condition and had not developed proper plantation for disposal of treated effluent. The marriage palace had also not installed compost pits. Moreover, the marriage palace has not submitted Bank guarantee amounting Rs. 25000/- which was earlier imposed during the hearing on 08.07.2022 to comply with the provisions of Water (Prevention &amp; Control of Pollution) Act, 1974. Thereafter, the Consent to Operate applied by the marriage palace was refused on 07.09.2022. Accordingly, notice u/s 33-A of Water (Prevention &amp; Control of Pollution) Act, 1974 with opportunity of personal hearing before CEE, Ludhiana on 09.02.2023 and it was decided as under:</span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The marriage palace shall maintain and operate its STP regularly and efficiently so as to achieve the effluent standards consistently as prescribed by the Board/MoEF&amp;CC and as amended from time to time.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The marriage palace shall developed proper plantation area for proper utilization of its treated trade effluent.</span></p> <p class="MsoListParagraphCxSpMiddle" style="text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">The marriage palace shall ensure complete compliance of CPCB/PPCB order no. 64 dated 02.02.2021 regarding Hotels, marriage palace etc.</span></p> <p class="MsoListParagraphCxSpLast" style="text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">EE, RO-4, Ludhiana shall visit the site of marriage palace and verify the compliance made by the marriage palace, process the consent application and send the report/recommendations accordingly.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">Now, the marriage palace has applied for renewal of Consent to Operate under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 through OCMMS. The marriage palace has already deposited fee amounting to Rs. 29000/-vide R. No. 31673817 dated 27.07.2022, under Water Act, 1974 &amp; Rs. 29500/- vide R. no. 281012822 dated 27.07.2022 under the Air Act, 1981, which is adequate upto 31.03.2027 (after deducting late penalty fees).</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">To verify the contents of the application and to get the compliance of the above hearing decisions, the marriage palace was visited by this office on 17.04.2023 and it was observed as under:- </span></p> <p class="MsoListParagraphCxSpFirst" style="text-align: justify; text-indent: -.25in; line-height: 115%; mso-list: l1 level1 lfo2;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">No function was going on in the marriage palace. The representative of the palace informed that the function has been fixed for tonight i.e. 17.04.2023. The preparation for the same was also being done as observed during visit. However, the STP was found in defunct condition and the components were not found interconnected with each other and no motor was found installed near filtration area. The clarifier was found half filled with dry sludge and seemed to be not operated from so long (Photographs attached). Therefore, the marriage palace is violating the provisions of the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 and also not comply with the SWM Rules, 2016.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">&nbsp;</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">In view of the above, it is recommended that the consent to operate applied by the palace under the Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 may be refused and action under provision of both Acts maybe initiated against the palace due to above said reasons.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 115%;"><span lang="EN-IN" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif';">Competency: Senior Environmental Engineer</span></p>
