The project proponent M/s Bio-diesel project, Village Sundran, Mubarikpur was granted Consent to Establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2021/16167472 dated 20.08.2021, valid till 21.07.2022 for manufacturing of Bio Diesel @ 30 Kilo Liters/Day with special conditions as under: 1.       The industry shall obtain environmental Clearance as required under the provisions of the EIA Notification dated 14/9/2006, if required and then project proponent shall not start the manufacturing activities/ any development / construction / any other activities regarding installation of the unit without obtaining environmental clearance. 2.       The industry shall not commission without the prior permission of the Board. 3.       The industry shall obtain permission from the PWADA for the abstraction of groundwater. 4.       The industry shall properly handle and manage the solid waste as per the provisions of the Solid Waste Management Rules, 2016. 5.       The industry shall obtain other permissions from the competent authority, if need be. 6.       The industry shall make proper disposal arrangement and shall obtain the prior permission of the Board before giving any occupancy. 7.       The promoter shall not consume any fuel except mustered husk briquettes in thermopack fluid heater and HSD in DG set(s) without obtaining prior written permission from the Board 8.       The industry shall install adequate pollution control devices such as ETP/ STP/ APCD as per feasibility report submitted at the of time of obtaining NOC to to achieve the prescribed standards. 9.       The industry shall submit the approved building plans from the Competent Person approved by the Director of Factories, Punjab, Chandigarh or Director of Factories, Punjab, Chandigarh. Now, the project proponent has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for Bio Diesel @ 30 Liters/Day using Palm Fatty Acid Distillate @ 30.0 Kilo Liters/Day, Potassium Hydroxide @ 540.0 Kgs/day, Sulphuric Acid @  270.0 Liter/day  & Methanol @ 1500.0 Liter/day as raw material. The project proponent has submitted CA Certificate with the value of fixed assets of Rs. 3.07 crore on 31.03.2023. The project proponent has deposited Rs. 93,600/- vide UTR no. AXIC230457152757 dated 14.02.2023 under Water Act, 1974 and Rs. 94,100/- vide UTR no. AXIC230457152761 dated 14.02.2023 under Air Act, 1981.  The project proponent has not submitted any proof of date of commissioning in the name of “Bio-diesel project” The project proponent has submitted electricity bill in the name of M/S Dysten Technologies, Village Sundran, Mubarakpur as proof of date of commissioning, the date of connection is 22.06.2021 The industry has submitted a copy of letter issued by Department of Town & Country Planning Punjab vide memo no. 198 dated 24.02.2021 in the name of M/s Intelligent Materials Pvt. Ltd. regarding Classification of land / land Suitability of the site as per which khasra no. 67//18(8-0), 67//22(7-0) and 67//23(7-13) falls under FEZ zone. The project proponent has submitted Memorandum of Association of Intelligent Materials Private Limited. The project proponent has submitted completion certificate of ETP of capacity 5 KLD by M/s Aqua Tech Engineers dated 27.08.2021 along with dimensional drawing. The ETP consist of Collection pit, pH Adjustment Pit, Flocculation Chamber, Filter Media, Treated Water Collection pit, cooling tower. The project proponent has submitted completion certificate of Thermic Fluid Heater capacity 10 lac Kcal/hr by M/s Thermodyne Engineering System dated 22.12.2021. The project proponent has not submitted dimensional drawing of APCD provided with Thermic Fluid Heater. The project proponent has submitted manufacturing process as under: Drying of RM – Esterification – Settling  vessel – Trans Esterification – Layer Separation – Glycerine – Drying of Bio diesel – Distillation – Bio-diesel. The project proponent has submitted approved building plan from competent person under Factory Act, 1948 in the name of M/s Intelligent Materials Pvt. Ltd. On scrutinizing the application on 10.04.2023, following clarification were raised with request to reply within 2 days: 1)      The industry is required to bring clarification from SEIAA, Punjab regarding non applicability of EC under EIA notification, 2006, as it has not obtained EC. 2)      The industry has applied in the name of Biodiesel project however all the documents submitted are of intelligent material pvt. Ltd, please clarify. 3)      As per the MOA, Preeti Gupta and Neha Gupta are directors , however no authority letter authorising Vivek Gupta has been submitted. 4)      The industry has not submitted completion certificate of APCD provided with thermic fluid heater and it's dimensional drawing. 5)      Proof of date commissioning has been submitted of another unit Dysten Technology as such adequacy of fee cannot be adjudged. 6)      In the NOC, the industry has proposed to install STP for the treatment of domestic waste water but now it has proposed septic tank No reply has been received from the industry. Under-signed is of the view that the industry is covered under category 5 (f) of EIA notification, 14/09/2006, but a clarification is required to be obtained from SEIAA for surety. The industry was visited by undersigned on 15.04.2023 and contacted Sh. Abhishek Gupta, Director (9417210947). During visit it was observed as under: 1.       The industry has not provided Environmental data board outside the premises. 2.       In the premises, 2 industries are in operation, one is involved in manufacturing of bio diesel and another is involved in manufacturing of copper, aluminium, molybedenum, zinc additives which is used as intermediate of industrial metallic paint. Both the industries are run by the same owner. No manufacturing process was in operation during visit. 3.       The industry involved in manufacturing of bio-diesel was not in operation. The representative informed that they have done trial of the plant in August 2022 and not operated since then as the prices of palm oil has gone up due to Ukraine war. He informed that now the prices has come down and they will start the production shortly after obtaining Consent to Operate of the Board. Further, he informed that the manufacturing of copper, aluminium, molybedenum, zinc additives is being done since 2019. The biodiesel to be manufactured will be sold to Govt. companies such as IOCL, BPCL etc and copper, aluminium, molybedenum, zinc additives are sold off to local paint manufacturers. 4.        The industry has installed 2 no. raw material collection tanks for storage of palm oil and tallow oil and 2 no. finished products collection tanks for storage of finished products of capacity 50 KL each. 5.       Manufacturing process of Bio-diesel is as under: Palm Oil + Tallow Oil Mixture Dried in a vessel using steam of thermopac heater (esterfication)------ Addition of methanol & caustic done in the dried ester in another vessel to form bio-diesel----- Layer separation using water to separate glycerine from bio-diesel--- Glycerine stored in 3 syntax tank of 5 KL each and bio-diesel stored in a tank of 20 KL capacity---- Distillation of Bio-diesel is done and bio-diesel in condensed form is collected in collection tank of 50 KL and sludge left at the bottom is taken to another tank from where it is sold to poultry farm as informed by the representative.  By-product Glycerine recovered from the process is being neutralized using HCL/ H2SO4 and thereafter distilled to get pure glycerine and sludge left at the bottom is taken to another tank from where it is sold to poultry farm as informed by the representative. 6.       The effluent is generated during the layer separation of biodiesel and glycerine and from the cooling tower blow down. The ETP consists of components Collection pit, pH Adjustment Pit, Aeration, primary clarifier, Sand Filter, Carbon Filter, Treated Water Collection pit. The collection tank were found filled during visit. No water meter has been provided at the outlet of ETP. No energy meter has been provided with the ETP. The industry is yet to provide sludge drying beds with the ETP. The treated water line is connected to cooling tower and hot water generator. 7.       Manufacturing process of copper, aluminium, molybedenum, zinc additivesis as under: Cu, Al, Zn crystals---- Crushing in Ball mill (4 no. enclosed)----- Heating in electric furnace (2 in no. and provided with no APCD and stack of inadequate height )----- Micronizeration in 2 no. cyclone using calcium carbide (connected with a duct and provision of water sprinkling to contain the dust and dust settled is collected in 3 no. pits. 2 tanks were found filled with sludge. No arrangement for disposal of sludge has been made. 8.       The industry has provided one no borewell and no water meter has been provided. 9.       Around staff of 45 person work in the industry. The industry has provided septic tank for the domestic waste water and has provided a perforated pipeline in the final collection tank dug into the ground. 10.   The industry has installed DG set of 320 KVA with canopy and inadequate stack and 85 KVA with canopy and adequate stack height. In view of above, it is recommended that the industry may be issued  show cause notice for the refusal of ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing.
