<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;">It is submitted that Consent to operate under the Air Act, 1981 was granted to the brick kiln vide no.<span style="mso-spacerun: yes;"> </span>CTOA/Renewal/FZL/2016/4583814 dated 13.10.2016, valid upto 30.09.2025 for operation of brick kiln with bulls trench kiln (BTK) technology for production of bricks & tiles @ 30,000 nos./day, which was canclled vide letter no. 685 dated 29.01.2020. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span>The BKO was visited by RO, FDK on 11.04.2022 and was found operational after converting to induced draft technology, however, the industry did not deposit any EC / obtained consent to operate.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span>The brick kiln was issued notice u/s 31-A of Air Act, 1981 vide letter no. 2602 dated 01.06.2022 to file objections (if any) within 10 days, but the brick kiln failed to submit any reply in the matter.</span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; line-height: 150%; background: white;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span><span style="background: white;">The brick kiln was afforded an opportunity of personal hearing u/s 31-A of Air Act, 1981 on 07.07.2022, wherein it was decided that:-</span></span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-language: PA;">The brick kiln shall apply for obtaining 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 as well as deposit requisite environmental compensation, within 20 days.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-language: PA;">Regional Office, Faridkot shall process the consent applications to be submitted by the brick kiln under the Water Act, 1974 & Air Act, 1981, on merits.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; background: white; margin: 0in 0in 6.0pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; mso-bidi-language: PA;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; background: white; mso-bidi-language: PA;">During hearing, the Partner of the brick kiln has been made clear that in case of non-compliance of decision no. (1) above of the hearing within stipulated period, further action for closure of brick kiln shall be taken without giving any further notice / opportunity.</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; line-height: 150%; background: white; margin: 0in 7.3pt .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;"> Now, the brick kiln has applied for obtaining fresh consent to operate under the Water Act, 1974 and varied consent to operate under the Air Act, 1981 on dated 24.03.2023, for its operation after adopting induced draft technology with zig-zag firing to manufacture bricks and tiles @ 30,000 nos./day. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; background: white; margin: 0in 7.3pt .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span></span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">The brick kiln has submitted an undertaking (attested by Charted Accountant) </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">as per which the BKO has used agro fuel for operating the brick kiln from March 2019 to May 2019 (three months) and has deposited EC @ Rs. 75,000 (Rs. 25000 for operation for 3 months) vide R. No. 41</span>/5545 dated 16.04.2023, which is adequate.</p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; background: white; margin: 0in 7.3pt .0001pt 0in;"><span style="mso-tab-count: 2;"> </span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-bidi-language: PA;">That the brick kiln has adopted induced draught zig zag technology and obtained provisional completion certificate from CSIR-Central Building Research institute, Roorkee on 22.10.2020 and final Design Adequacy cum Completion Certificate by CSIR, ROORKEE duly signed on 08.12.2020.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; background: white; margin: 0in 7.1pt .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span>The brick kiln was visited by RO, FDK on 06.04.2023 and it was observed as under:–</span></p>

No raw material/ fuel lying at site. The representative of the kiln informed that they will not be able to operate kiln this season due to financial crises. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -.25in; line-height: 150%; mso-list: l1 level1 lfo2; background: white; margin: 0in 7.1pt .0001pt .25in;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">The brick kiln has upgraded its kiln into induced draft zig-zag technology. AVFD fan has been provided with the chimney and the length of the brick kiln (central island was less than 245 feet as required by the Board. </span></p>

<p class="MsoNormal" style="text-align: justify; line-height: 150%; background: white; margin: .3pt 7.1pt .0001pt 0in;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-language: PA;"><span style="mso-tab-count: 2;"> </span></span><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';">If approved, consent to operate under the Water Act, 1974 may be granted to the brick kiln for production of bricks & tiles @ 30,000 nos./day using induced draft zig-zag technology for a period of 30.09.2029, with suitable conditions.</span></p>
