<p><span lang="EN-US">RO has reported that earlier, the industry was visited by Officer of this office on 30/05/2022 and it was observed that the industry was operating cupola furnace without installing APCD. As per record of this office the industry has not obtained NOC/consents form the Board and is operating its unit without obtaining consents of the Board. The industry was violating the provisions of the Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974. Notice for violations of the provisions under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 was issued to the industry vide this office letter no. 1858 dated 24/08/2022 with an opportunity of personal hearing at RO level, but industry not attended the personal hearing. Report in this regard was sent to Zonal Office, Amritsar for taking action against the industry.</span></p>
<p><span lang="EN-US"> Directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide Zonal Office, letter no. 3296-97 dated 06/10/2022 against the industry with directions to seal the machinery installed by the industry.</span></p>
<p><span lang="EN-US"> In compliance of the directions issued by the Board, the industry was visited on 23/12/2022 by AEE of this office to seal the machinery of the industry. During visit </span>Sh. Rohit Sehdev (Prop.) was met and it was informed him about directions issued by the Board regarding sealing of the cupola furnace and short blasting machine installed in the unit. But Sh. Rohit Sehdev (Prop.) had not co-operate to seal the machinery.</p>
<p><span lang="EN-US"> The industry submitted a letter in this office and has informed that they have applied for obtaining APCD design from Punjab State Council for Science & Technology (PSCST), Chandigarh and also given order to TS Engg. work for constructing APCD (copy attached).</span></p>
<p><span lang="EN-US"> The industry was still operating its unit without APCD. It is therefore recommended that the industry may be heard before Senior Environmental Engineer, Zonal Office, Amritsar for non-compliance of the directions issued by the Board and for violations under Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p><span lang="EN-US"> The Competent Authority of the Board considering the violations of the industry, the directions u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued vide Zonal Office letter endst. no. 331 dated 08/02/2023 to the PSPCL Authorities for disconnection of electric connection of the industry. The Executive Engineer (Distribution), and the Assistant Engineer, Punjab State Power Corporation Limited, Suburban-Division, Batala (North) was requested vide this office letter no. 407-08 dated 28/02/2023 for submit compliance for directions issued by the Board.</span></p>
<p><span lang="EN-US"> In compliance of directions issued by the Board the Assistant Executive Engineer (North), Sub-Division, Batala vide letter no. 317 dated 06/04/2023 and has informed to this office the electric connection of the firm has been disconnected.</span></p>
<p><span lang="EN-US"> Now the industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The project proponent has submitted various documents, which are enclosed along with the application, which may kindly be pursued.</span></p>
<p><span lang="EN-US"> The industry has also intimated that they have installed cupola furnace and air pollution control device to the cupola furnace having melting capacity less than 3T/hr as per the technology evolved by PSCST, Chandigarh. The industry has submitted copy of Completion Certificate issued by PSCST, Chandigarh vide letter no. PSCST/TFD/756 dated 07/03/2032 of the APCD installed.</span></p>
<p><span lang="EN-US"> The industry has submitted report issued from the Commissioner, Municipal Corporation, Batala vide letter no. 936 dated 29/03/2023, in which it has intimated that the site of the industry falls in an Industrial Focal Point as per Master Plan Batala.</span></p>
<p><span lang="EN-US"> The industry has submitted Approved Building Plan prepared from the competent person approved under the Punjab Factories Act, 1948.</span></p>
<p><span lang="EN-US"> The industry has deposited Rs. 34,800/- vide UTR No. 856190468 dated 31/03/2023 & Rs. 32,400/- vide UTR No. 57263750 dated 31/03/2023 as consent to operate fee under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 including Rs. 500/- as Form Downloading fee against total gross value of fixed assets worth Rs. 32,05,300/- as on 28/02/2023 and same are adequate upto 31/12/2027 under both Acts including Rs. 2900/- as NOC Regularization fee and Rs. 500/- as FDF.</span></p>
<p><span lang="EN-US"> The industry was visited by the officer of this office on 17/04/2023 and observed as under:-</span></p>
<p>1. The industry was not in operation during the visit.</p>
<p>2. The industry has installed a cupola furnace with wet cap as an APCD.</p>
<p>3. The industry has constructed a re-circulation tank with pump motor fitted over it.</p>
<p>4. The industry has erected a pipe network for the re-circulation of the scrubbed water.</p>
<p>5. There is no source of trade effluent. </p>
<p><span lang="EN-US"> The project falls in Orange category in small scale sector, hence competency to decide the case lies with the Environmental Engineer of the Board in the light of Head Office, Patiala letter no. 19650-761 dated 30/</span><span lang="EN-US">04/2013.</span></p>
<p><span lang="EN-US">RO has recommended </span>as under:-</p>
<p>1. Direction u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the PSPCL Authorities to restore electric connection of the unit.</p>
<p>2. The consent to operate under Water (Prevention& control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 may be granted to the industry for a period upto 30/09/2027.</p>
<p><span lang="EN-US">In view of above, it is recommended that the d</span>irection u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 may be issued to the PSPCL Authorities to restore electric connection of the unit premananently as the industry has installed APCD as per the design of PSCST.</p>
