Ø  The industry is a small scale red category. Ø  It is intimated that a public complaint was received in this office regarding smoke pollution caused by subject cited industry. To verify the facts of the complaint the industry was visited by AEE of this office on 16.03.2022 and it was observed that industry is engaged in manufacturing of pipe fitting items and has installed one induction furnace and one shot blasting machine along with Bag filter house as APCD. The industry has also installed two annealing furnaces, zinc galvanizing furnace and grinders a lot of process emissions were observed arising from these processes at the time of visit. The APCD installed with induction furnace was not in operation. The industry has not given any proof regarding area classification & date of commissioning of the industry during visit. The industry is running at site without obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981. Ø  Thereafter,  the industry was given personal hearing before Senior Environmental Engineer, Jalandhar on 19.05.2022 and during the hearing it was decided as under:- <ol style="margin-top: 0cm;" start="1" type="1"> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l4 level1 lfo5;">The industry shall operate the air pollution control devices regularly & efficiently to achieve the prescribed parameters. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l4 level1 lfo5;">The industry shall provided proper & safe stack emission sample collection arrangements with the stacks, within 15-days. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l4 level1 lfo5;">The industry shall get the designation of area of industry as per Notified Master Plan of Jalandhar from the concerned authority and also get permission u/s 79 of Punjab Regional Town Planning & Development 1995 Amendment 2006 for the operation of industry at present location (if required), within 15-days.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l4 level1 lfo5;">The industry shall apply for consents of the Board under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act 1981 alongwith required documents through online system within 15-days. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l4 level1 lfo5;"> The Regional Office-1, Jalandhar shall visit the industry, collect stack emissions samples, after stipulated period and submit detail report alongwith recommendations, accordingly.</li> </ol> Ø  In compliance to hearing decisions the industry was visited by officer of this office on 30.11.2022 and following observations were made:- <ol style="margin-top: 0cm;" start="1" type="1"> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l3 level1 lfo7;">The industry was in operation during visit and is engaged in manufacturing of pipe fitting items.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l3 level1 lfo7;">The industry has not provided sampling arrangements to collect stack emission sample, so sample could not be collected. During visit, the industry was guided to provide proper sampling arrangements. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l3 level1 lfo7;">The industry has not submitted certificate regarding designation of area of industry as per Notified Master Plan of Jalandhar from the concerned authority and also has not submitted permission u/s 79 of Punjab Regional Town Planning & Development 1995 Amendment 2006 for the operation of industry at present location. </li> </ol> Ø  Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 through OCMMS of the Board for manufacturing of Pipe fitting @ 1 T/day by using Pig Iron @ 200 Kgs/day, Zinc @ 40 Kgs/day and Boora @ 10 Kgs/day as raw material  by installing 1 no. induction furnace and 1 no. galvanizing furnace, and detail of the same is as under:- <ol style="margin-top: 0cm;" start="1" type="1"> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l6 level1 lfo2;">The industry has deposited Rs. 29700/- i.e Rs. 22000/- under Air Act, 1981, Rs. 5000/- under VDS scheme, Rs. 2200/- as NOC regularization fee and Rs. 500/- form fee vide R.No. 770448350 dated 31.03.2023 and Rs. 27000/- i.e Rs. 22000/- under Air Act, 1981 and Rs. 5000/- under VDS scheme vide R.No. 823820236 dated 31.03.2023 against from assets of Rs. 19.99 Lacs as on 31.03.2022, which are adequate upto 31.03.2028. It is pertinent to mentioned here that in order no. 394 dated 21.11.2022 for VDS scheme mentioned that this scheme shall be valid only for those small scale industries or institutes/ other establishments (having capital investment less than 10 crore), operating in designated/permissible areas and for those units which have never obtained consent to operate of the Board and have never availed relaxation in consent fees under the earlier VDS Schemes of the Board. But in office order of VDS scheme. It has not been mentioned that this scheme is valid for such type of case, where action is under process against the unit or not it is also mentioned this industry has applied for fresh case in VDS scheme and never taken benefit of the scheme so far.   </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l6 level1 lfo2;">The industry has submitted building plan from approved architect from Director of Factories, Punjab. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l6 level1 lfo2;">The industry has submitted registration certificate under Punjab VAT Act, 2005 as per proof of date of commissioning i.e April/2015.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l6 level1 lfo2;">The industry has submitted classification of area certificate issued from ATP, Jalandhar vide letter No. 689 dated 16.06.2022 in which mentioned the industry falls in general industrial zone as per Master Plan Jalandhar (2009-2031).</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l6 level1 lfo2;">The industry has also submitted site plan, manufacturing process, rent agreement with the application. </li> </ol> Ø  The industry was visited by officer of this office on 10.04.2023 and it was observed   that : <ol style="margin-top: 0cm;" start="1" type="1"> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry was in operation during visit and is engaged in the manufacturing Pipe fitting items. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">There is no source of trade effluent generation and only domestic effluent is discharged into sewer. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry has installed 1 no. induction furnace of capacity 300 kg/day with bag house filter as APCD. The industry has not provided any sampling arrangements to collect stack emission sample, so sample could not be collected.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry has installed 1 no. shot blasting machine of capacity 300 kg/day.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry has installed 1 no. oil annealing furnace (kotha bhathi) of capacity 7 T/day with inadequate stack height.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry has installed 1 no. coal fired galvanizing furnace of capacity 1 T/day. </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry has installed 3 nos. grinders machines, 03 nos. lathe machines, 05 nos. thread machines in its premises.     </li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry using hydrochloric acid for dip of nuts & bolts, but the industry has not made any agreement with registered firm for disposal of its end matter.</li> <li class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%; mso-list: l5 level1 lfo1;">The industry is not complying with the condition of Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 due to above violation mentioned at Sr. no. 3,5 and 8. </li> </ol>                    The industry is a small scale red category unit and competency to decide such case lies with Senior Environmental Engineer, Jalandhar.   Recommendation:- Keeping in view of above, it is recommended that fresh consent to operate under Water  (Prevention & Control of Pollution) Act 1974 and Air (Prevention and Control of Pollution) Act, 1981 may be refused due to above reasons.
