File Note: <p><span lang="EN-US">RO has reported that earlier the consent to operate under Water (Prevention&amp; control of Pollution) Act, 1974 &amp; Air (Prevention &amp; control of Pollution) Act, 1981 was granted to the instituted vide online reference no. CTOW/Fresh/PKT/2022/19901026 &amp; CTOA/Fresh/PKT/2022/19901018 dated 28/09/2022, which are valid upto 31/03/2023 for 50 beds for the operation of Medical College and Institute. &nbsp;&nbsp;</span></p> <p><span lang="EN-US">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Now the institute has applied for obtaining renewal consent to operate under Water (Prevention &amp; Control of Pollution) Act, 1974 &amp; Air (Prevention &amp; Control of Pollution) Act, 1981 for 50 beds for the operation of Medical College and Institute through OCMMS in a totally paperless manner by uploading necessary documents as PDF.</span></p> <p><span lang="EN-US">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The project proponent has already deposited Rs. 1,20,500/- vide UTR No. 500048308 dated 29/07/2022 &amp; Rs. 1,20,500/- vide UTR No. 424774447 dated 29/07/2022 and now deposited Rs. 60,000/- vide UTR no. 927400180 dated 04/04/2023 &amp; Rs. 49700/- vide UTR no. 346557690 dated 04/04/2023 as consent to operate fee under Water (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981 including NOC regularization fee and Form downloading fee, which is adequate upto 30/09/2024 against total gross value of fixed assets worth Rs. 22,57,75,932/-/- as on 31/03/2023. &nbsp;&nbsp;&nbsp;&nbsp;</span></p> <p><span lang="EN-US">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The industry was visited by AEE of this office on 10/04/2023 and observed as under:-</span></p> <p><span lang="EN-US">1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The HCF is a 50 bedded&nbsp;Institute.</span></p> <p><span lang="EN-US">2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The HCF has provided colour coded plastic bins at wards, operation theatre, ICU, and Nursing Stations for segregation of Bio Medical Waste and segregation was found as per Bio Medical Waste Management Rules,&nbsp;2016.</span></p> <p><span lang="EN-US">3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The&nbsp;HCF has provided needle destroyers for shredding of needles.</span></p> <p><span lang="EN-US">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The HCF has provided a final collection point for Bio Medical Waste and no mixing of Bio Medical Waste was found during&nbsp;visit.</span></p> <p><span lang="EN-US">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The&nbsp;HCF&nbsp;is&nbsp;maintaining&nbsp;the&nbsp;record&nbsp;of&nbsp;Bio&nbsp;Medical&nbsp;Waste&nbsp;lifted&nbsp;to&nbsp;CBWTF.</span></p> <p><span lang="EN-US">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">There is a one Medical institute also, where MBBS courses are offered and about 100-150 students are currently enrolled.</span></p> <p><span lang="EN-US">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">Hostels for these students are also provided within the premises.</span></p> <p><span lang="EN-US">8.&nbsp;&nbsp;&nbsp;&nbsp;</span><span lang="EN-US">The institute has provided STP for the treatment of the entire effluent generated from the premises. During visit, sufficient quantity of raw effluent was not available and as such the STP was not in operation.</span></p> <p><span lang="EN-US">&nbsp;</span></p> <p><span lang="EN-US">The</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">HCF</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">is</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">a</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">having</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">built-up</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">area</span><span lang="EN-US">&nbsp;</span><span lang="EN-US">more&nbsp;than&nbsp;20,000&nbsp;sq.mts&nbsp;and&nbsp;as&nbsp;per&nbsp;the&nbsp;EIA&nbsp;Notification,&nbsp;2006,&nbsp;such&nbsp;projects&nbsp;needs&nbsp;to&nbsp;obtain&nbsp;prior&nbsp;Environmental&nbsp;Clearance&nbsp;from&nbsp;the&nbsp;competent&nbsp;authority&nbsp;before&nbsp;starting&nbsp;its&nbsp;</span><span lang="EN-US">construction&nbsp;activity.&nbsp;The&nbsp;HCF&nbsp;was&nbsp;commissioned&nbsp;without&nbsp;obtaining&nbsp;Environmental&nbsp;Clearance&nbsp;under&nbsp;EIA&nbsp;Notification,&nbsp;2006.&nbsp;</span><span lang="EN-US">The&nbsp;HCF&nbsp;has&nbsp;constructed&nbsp;the&nbsp;premises&nbsp;without&nbsp;obtaining&nbsp;the&nbsp;Environmental&nbsp;Clearance&nbsp;from&nbsp;the&nbsp;competent&nbsp;authority&nbsp;in&nbsp;compliance&nbsp;to&nbsp;the&nbsp;EIA&nbsp;Notification,&nbsp;2006.&nbsp;The Board has filed&nbsp;Criminal Case&nbsp;against the said HCF cum Medical College under the provisions of the EPA Act, 1986 for violating the provisions of the EIA Notification, 2006 in the court of Hon&rsquo;ble CJM, Pathankot.</span></p> <p><span lang="EN-US">The representative has submitted that the whole area include the area covered by the college as well as hospital. However, the area covered individually by the hospital and the college is below 20,000 sq.mts and as such EC is not covered.&nbsp;&nbsp;&nbsp;</span></p> <p><span lang="EN-US">The Institute has made a representation to SEIAA mentioning that the built-up area of the hospital less than 20,000 sq.mts and as such EC under EIA notification, 2006 is not required. The SEIAA has forwarded the request of the Institute to the Board requesting to submit detailed report regarding component wise built-up area of the medical college and hospital. The exercise will be done shortly and detailed report shall be sent to the competent authority. &nbsp;</span></p> <p><span lang="EN-US">&nbsp; It is pertinent to mention here that the authorization under Bio Medical Waste (Management) Rules, 2016 was granted vide online reference no. BMW/Renewal/PKT/2022/19844688 dated 12/09/2022, which is valid upto 30/09/2023 for 50 beds.</span></p> <p>EE ZO has observed that in medical institute, there are 100-150 students currently enrolled but RO has mentioned sufficient quantity of raw effluent was not available as such the STP was not in operation.</p> <p>RO has replied that not all the students are residents. The STP has been installed for full capacity of the institute and as such the STP has to be operated in batches. During visit, sufficient effluent was not available due to which sample could not be collected.</p> <p>RO has recommended that&nbsp;the renewal of consent to&nbsp; operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and&nbsp; Air&nbsp; Prevention&nbsp; &amp;&nbsp; Control of Pollution) Act, 1981 may be granted to the institute for short &nbsp;term upto 30/09/2023.</p> <p><span lang="EN-US">In view of above, it is recommended that the renewal of consent to&nbsp; operate under Water (Prevention &amp; Control of Pollution) Act, 1974 and&nbsp; Air&nbsp; Prevention&nbsp; &amp;&nbsp; Control of Pollution) Act, 1981 may be granted to the institute for short &nbsp;term upto 30/09/2023 with usual conditions along with special condition as under:-</span></p> <p><span lang="EN-US">1. The institute shall analyze its effluent samples from Board's lab within this consented period.</span></p> <p><span lang="EN-US">2. The institute shall obtain E.C. </span>from&nbsp;the&nbsp;competent&nbsp;authority&nbsp;in&nbsp;compliance&nbsp;to&nbsp;the&nbsp;EIA&nbsp;Notification 2006.</p> <p><span lang="EN-US">Competency (Hon'ble Chairman Sir).</span></p>
