<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 71.95pt; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">It is submitted that the industry is a small scale cattle feed unit and was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/FGS/2018/7932457 dated 16/07/2018 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/FGS/2018/7932343 dated 18/07/2018 both valid upto 30/09/2022 for the manufacturing Poultry and Animal Feed @ 120 T/day and Cattle feeds @ 120 TPD.</span></p>
<p class="MsoBodyText" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 71.95pt; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The industry had applied for obtaining renewal of consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith requisite documents through OCMMS. The application of the industry was returned due to following reasons "The unit is located at a distance of about 3.27 KM away from MC limit. Thus, the unit is covered under non-attainment city of Mandi Gobindgarh. The said unit is using FO as fuel in its boiler furnaces and required to be shifted from FO to PNG or cleaner fuel i.e. PNG/CNG/LSHS. But, the fuel policy of the State is yet to be finalized by the State Govt. Therefore, Consent to Operate cannot be decided on FO. As such, you are requested to shift fuel from FO to PNG/ cleaner fuel." In view of above, the application of the industry is hereby returned</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">Now, the industry has applied for obtaining renewal of consent to operate under the Water Act, 1974 and Air Act, 1981 alongwith requisite documents through OCMMS. The industry has deposited consent fee of Rs. 90000/- vide UTR no. CSBKN22237025041 dated 25/08/2022 & Rs. 4500/- vide online R. No. 559417069 dated 17/03/2023 under the Water Act, 1974 and Rs. 90000/- vide UTR no. CSBKN22237025042 dated 25/08/2022 & Rs. 4500/- vide online R. No. 870250235 dated 17/03/2023 under the Air Act, 1981 against the un-depreciated fixed assets of Rs. 716.89 Lacs as on 30/09/2022 as per CA certificate dated 21/11/2022 which is adequate upto <strong>30/09/2027</strong> under Orange category as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee of Rs. 2900/- and penalty charges 25%. There is no increase in the production capacity as well as pollution load due to increase in fixed assets.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The industry has submitted and clarified that it is now using LDO instead of FO in its furnace and wood in another furnace. LDO is a cleaner fuel with low sulphur content </span>.</p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">As per circular no. CEE (HQ)/F.No./957/2016/59 dated 02/02/2016, the case for renewal of NOC/Consent to operate for Orange & Green category industries is to be processed based on self-certification submitted by the industry to the effect that it is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. Accordingly, the industry has submitted compliance reports that it is complying with conditions imposed in the consents granted to it under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board”</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 75.7pt; line-height: 115%; tab-stops: 7.0in; margin: 9.8pt 2.5pt 6.0pt 12.0pt;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="margin-top: 9.8pt; text-align: justify; text-indent: 87.7pt; line-height: 150%; tab-stops: 7.0in;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.</span></p>
<p class="MsoBodyText" style="margin-top: 9.8pt; text-align: justify; text-indent: 87.7pt; line-height: 150%; tab-stops: 7.0in;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">The site of industry falls in <strong>industrial zone</strong> as per the Master Plan of Mandi Gobindgarh.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span style="font-family: 'Bookman Old Style','serif'; background: white;">It is recommended that 'consent to operate' under the under the Water Act, 1974 and the Air Act, 1981 may be granted upto 30/09/2027 with suitable conditions and following special conditions:</span></p>
