Subject:               Proceeding of the personal hearing given on 6/4/2023  by the Chief Environmental Engineer (P) of the Board to  M/s  ATS Estates Pvt. Ltd., Project: ATS Golf Meadows Lifestyle, Vill. Madhopur, Tehsil Dera Bassi,  Distt. SAS Nagar w.r.t SCN for refusal of renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974   The following were present: <h3 style="margin-left: 0in; text-indent: 0in; line-height: 150%;">From the Board:</h3> 1.                      Sh. Jaspal Singh, Engineer 2.            Sh. Harmanjeet Singh The officers of the Board brought out that project proponent was obtained  environmental clearance dated 5/5/2017 for the expansion of a group housing project the total land area of the project is 1,11,921.03 Sqm (27.68 acres)  the total built-up area will increase from 1,48,898.53 Sqm to 2,97,587.66 Sqm for the total wastewater generation from the project after expansion will be 858 KL/day, which will be treated in a centralized STP of Municipal Council, Dera Bassi. In the summer season, the project proponent has proposed to utilize 277 KL/day of treated wastewater for flushing purposes, 226 KL/day will be used for horticulture purposes (41,057.34 Sqm) and the remaining discharged into the MC sewer.  The project proponent has obtained consent to operate from the Board, valid up to 31/5/2024 for the Residential project “having 1,242 no. Dwelling units, 125 no. EWS units, 24 no. Shops, 10 no. Booth & 2 no. Community Centers Built up area: 2,85,322.21 Sqm. Domestic Effluent @ 858 KLD - After treatment with terminal STP MC Dera Bassi, 277 KL/day for flushing purposes, 226 KL/day for horticulture purposes (41,057.34 sqm), and remaining discharged into the MC sewer.  Thereafter, the project proponent obtained consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, valid upto 9/12/2022 with the main special condition that the project proponent shall immediately make the connection with STP of MC, Dera Bassi to reuse the treated domestic effluent. The project proponent has now applied for renewal consent to operate as required under the Water (Prevention & Control of Pollution) Act, 1974. The Environmental Engineer, Regional Office as reported that wastewater generated from the project is disposed off into STP of 4 MLD installed by MC on the land of ATS Golf Meadows, STP was in operation, and treated water from the STP is disposed off into the Habatpura drain. The project proponent has laid network of pipeline for using treated water for irrigation and flushing & the line has reached at the distance of 50 meters from the STP and is yet to connected with STP to recycle back partial amount of treated water. The project proponent is not complying the conditions as well as special conditions mentioned in the consent to operate earlier granted to it. It is evident that the industry is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, willfully causing water pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately.  Therefore, the project proponent was issued show cause notice for refusal of renewal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 2063-64 dated 28/3/2023 alongwith an opportunity of the personal hearing before the Chief Environmental Engineer (P) of the Board on 6/4/2023. The representative of the industry who attended the hearing submitted that project proponent has made the connection with STP to reuse the treated water for irrigation and flushing. They have installed a water meter on the pipeline carrying the treated water for irrigation and flushing. They have submitted a copy of MoU made with Municipal Council, Dera Bassi and ATS Infrastructure regarding the entire effluent will be treated in terminal STP at Dera Bassi.                                  After hearing the officers of the Board and the representatives of the project proponent, the Chief Environmental Engineer (P) of the Board decided as under: 1.                   The project proponent shall submit the details within 7-days of all the project of ATS Infrastructure Ltd/ ATS Estate Pvt. Ltd. and its sister concerns which are connected or to be connected with terminal STP alongwith quantity of domestic effluent of each project (generated and to be generated). 2.                   The Executive Officer, Municipal Council, Dera Bassi shall intimate the number of outlets and projects in the Dera Bassi with quantity of domestic effluent which are discharging into the MC sewer, leading to the said STP. 3.                   The Executive Officer, MC, Dara Bassi shall clarify as per clause 2 of the MOU (made between Municipal Council, Dera Bassi and ATS Infrastructure regarding that the entire effluent will be treated in the said STP) whether this STP is adequate to handle the additional wastewater to be generated from all the projects of ATS Infrastructure Ltd/ ATS Estate Pvt. Ltd. etc., in future or not. 4.                   The Environmental Engineer, Regional Office, SAS Nagar shall visit the site of the project(s) within 10 days to verify its statements to be submitted by project proponent and EO, MC, Dera Bassi, to check detail of all project ATS Infrastructure Ltd/ ATS Estate Pvt. Ltd. and its sister concerns to be connected with the said STP and to send his report/ recommendations, accordingly.                                 If approved, proceedings of the personal hearing as above may be conveyed to the project proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
