<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; background: white;">It is submitted that as per CA certificate as on 31.03.2023 there is no increase in the value of fixed assets compared to previous CA certificate. The industry has submitted that they have not installed any machinery after grant of previous consent to operate. A letter has been written by this office to District Town Planner, Fazilka vide no 1417 dated 05.04.2013 to submit report regarding operation of unit as per Master Plan of the area in future. However no reply has been received in this regard.</p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; background: white;">Further, it is submitted that as per Board office order no. 21 dated 08.06.2018 regarding Continuation of operation of the industrial establishments in mixed land used/ non-designated areas, it was mentioned that <strong><em>Existing industrial unit/ other establishments which were established before the notification of the Master Plan of the respective cities shall be allowed consents / extensions under the provisions of the Water Act, 1974 and Air Act, 1981 and authorisation under the provisions of Hazardous Waste Management Rules, 2016 for a period of 15 years from the date of the notification of Master Plan after taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from local bodies and other authority is required to be obtained. </em></strong></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; background: white;">As the Master Plan of the Abohar Town has been notified on 14.07.2009 and the industrial unit has been established well before the notification of Master Plan.</p>
<p class="MsoNormal" style="text-align: justify;">In view of above, it is recommended that consent to operate under the Water Act, 1974 and Air Act 1981 <span style="mso-spacerun: yes;"> </span>may be granted for a period upto 14.07.2024 with additional condition that the industry shall obtain permission from the Municipal Corporation Abohar regarding operation of the unit in Master Plan of the area, please</p> |
