<p class="MsoNormal" style="mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; text-align: justify; text-indent: 1.25in; line-height: normal; background: white;"><span style="font-family: 'Bookman Old Style','serif';">It is submitted that the industry was granted consent to operate vide no. CTOW/Renewal/MOG/2022/17148478 dated 28.04.2022 valid upto 30.06.2028 under the Water Act, 1974 and CTOA/Renewal/MOG/2022/17148471 dated 28.04.2022 valid upto 30.06.2027 under the Air Act, 1981, for production of cement @ 40 TPDusing a single ball mill in the existing premises of area 6 kanal subject to conditions as mentioned in the original consent alongwith additional condition that the industry shall not carry out any activity relating to enhancement of its production capacity without obtaining NOC for expansion as well as environmental clearance under the<span style="mso-spacerun: yes;"> </span>provisions of the EIA notification dated 14.09.2006. While processing the application it was reported that the industry has installed existing ball mill of capacity @ 50 TPD and another ball mill of similar capacity was lying in the premises, which has not been fitted yet and accordingly has not been commissioned yet.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 94.5pt;"><span style="font-family: 'Bookman Old Style','serif';">The industry was earlier granted CTE (for expansion) under Water Act, 1974 & Air Act, 1981 vide no. CTE/Exp/MOG/2020/13194751 dated 13.09.2020 valid upto 14.09.2021 for proposed expansion capacity of 140 TPD with total production of cement @ 180 TPD by installing 2 ball mills of capacity 40 TPD and 140 TPD each subject to special condition that the industry shall not carry out construction activity in its premises regarding expansion of it’s unit (for increase in production capacity of cement 40 TPD to 140 TPD without obtaining prior EC as required under EIA notification dated 14.09.2006 and that the industry shall not undergo expansion w.r.t land area without obtaining prior permission of the Board. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 94.5pt;"><span style="font-family: 'Bookman Old Style','serif';">To verify the SOPs prescribed by the Board for such type of industries and to verify the compliance of provisions of the Water Act, 1974 & the Air Act, 1981, said industry was visited by undersigned and EE of this office on 26.11.2022 and it was observed as under: </span></p>

During visit, only one ball mill was operational. The industry couldn’t produce any record with regard to capacities of ball mills installed in it’s premises. The additional/second ball mill installed in industrial premises was sealed by AEE on 29.11.2022 in compliance to decision of hearing held before SEE, ZO, Bathinda on 20.04.2022.</span></p>

<p class="MsoNormal" style="mso-margin-top-alt: auto; text-align: justify; text-indent: 1.0in; mso-line-height-alt: 9.05pt; background: white;"><span style="font-family: 'Bookman Old Style','serif';">As such, the industry was issued show cause notice with an opportunity of personal hearing before the Senior Environmental Engineer on 16.12.2022. After hearing the partner of the industry as well as officer of the Board, it has been decided that:-</span></p>

<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in;"><span style="font-family: 'Bookman Old Style','serif';">Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 & the Air Act, 1981 for production of cement @ 40 MTD by installing 02 ball mills of capacity 20 TPD each. Details of the case are as under:-</span></p>
<p class="MsoNormal" style="text-align: justify;"><span style="font-family: 'Bookman Old Style','serif';"> </span></p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: -27.0pt; mso-list: l0 level1 lfo3;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Bookman Old Style','serif';">The industry has submitted CA certificate showing fixed assets of Rs. 95.93 lakhs as on 11.01.2023. In addition to earlier fee deposited by the industry, it has deposited Rs. 14,400/- vide UTR No. 921334522 dated 19.01.2023 under Water Act, 1974 and Rs. 14,400/- vide UTR No. 658528597 dated 19.01.2023 under the Air Act, 1981, which is adequate for a period upto 30.06.2029.<span style="mso-spacerun: yes;"> </span>As per the CA certificate, there has been increase in value of land @ Rs. 5,67,100/-. The industry has submitted that<em> the adjacent plot has recently been purchased measuring 6 kanal 02 marlas [bearing khasra no. 126//23min(2-2,) 24(2-0) & 25min (2-0) ]. Copy of registry enclosed. This parcel of land is not being utilized for any industrial activity rather being utilized only for storage of raw material. Moreover, this parcel has a separate entry other than main gate of the industry, however, a portion of the land at the backside is connected with the industry for conveyance of raw material.</em> <span style="mso-spacerun: yes;"> </span><span style="mso-spacerun: yes;"> </span>Further, as per the CA certificate, the cost of plant & machinery has been reduced by Rs. 4,78,542/- invoice dated 11.01.2023 of its old machinery. In this regard, the industry has submitted following undertaking:-</span></p>

Satish Kumar Resident of Bhagha Purana, Partner of the firm M/s Luxmi Cement Industries, Village Gholia Kalan, Bhagha Purana, Distt. Moga do here by solemnly affirm and declare as under: - </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">1. That We are running a cement grinding unit since 2004, having a total capacity of 40 TPD with 2 Ball mills of 20 TPD each. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">2. That in 2015, there was a major breakdown in one of the ball mill and to overhaul the machine, that machine was sent to the company. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">3. That Few amendments were made in the remaining one ball mill to adjust its capacity and we started working for to increase the capacity of one ball mill to 40 TPD to maintain the overall capacity of the industry. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">4. That From last few years, we were operating one ball mill at 40 TPD but due to these amendments, our overhead costs rose many folds which wasn't viable for our business. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">5. That As we have received our repaired ball mill of 20 TPD capacity, which was sent for overhauling to the company. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify;"><em><span style="font-family: 'Bookman Old Style','serif';">6. That Now, we want to operate both the ball mills at 20 TPD as per original installation. We have reversed the amendments made to the remaining ball mill and have adjusted the capacity of both the ball mills to 20 TPD each maintaining the total capacity of our plant at 40 TPD"</span></em></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: 67.5pt;"><em><span style="font-family: 'Bookman Old Style','serif';">"M/s Laxmi Cement Industries, Village Gholia Kalan, Bhagha Purana, Distt. Moga (Punjab) has engaged our services regarding amendment of their 2 ball mills and Air Pollution Control Systems for their Cement Grinding Unit. A de-tailed feasibility report covering design and specifications of the proposed air pollution control systems was provided to us by the industry. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: 67.5pt;"><em><span style="font-family: 'Bookman Old Style','serif';"> </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: 67.5pt;"><em><span style="font-family: 'Bookman Old Style','serif';">We have amended the 2 ball mills and their capacity to 20 ton/day each and in total reaching 40 ton/day. Industry have already installed A.P.C.D. (Cyclone & Bag Filter System) at Both Ball mill units according to feasibility report submitted. All the dust emitting points should be covered with specially designed Hoods/Bag so as to bring minimum dust emission to open. All the dust collecting’ points from ball mill no 1 & ball mill no 2 were ducted to existing APCD consisting bag filter. The industry will duct dust emission from unit 1 & unit 2 to the which will produce 40 TPD (20 TPD each) of cement. </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: 67.5pt;"><em><span style="font-family: 'Bookman Old Style','serif';"> </span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 40.5pt; mso-add-space: auto; text-align: justify; text-indent: 67.5pt;"><em><span style="font-family: 'Bookman Old Style','serif';">The AIR POLLUTION CONTROL SYSTEMS- for combustion emissions from Ball mills, in their present configurations, seems to be in conformance with the recommended design and specifications, and are expected to perform adequately to satisfy the (Cement Grinding of 40 TPD) desired requirements in achieving the applicable statutory norm."</span></em></p>

Necessary orders may be issued for de-sealing of 2<sup>nd</sup> ball mill having capacity 20 TPD.</span></p>
