<p>It is submitted that the industry was granted consent to operate under the Water Act, 1974 & the Air Act, 1981 dated 14.09.2020 for production of Lead / Lead Alloys / Lead Battery Plates / Lead Oxide @ 3700 MT / Year, valid upto 13.03.2021, respectively subject to special conditions mentioned therein.</p>
<p>The industry was also granted authorization along with actual user certificate cum passbook under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 dated 12.03.2021 valid upto 11.03.2026 for re-processing / recycling of lead acid battery scrap / battery plates @ 4800 TPA and generation of category 9.1 (Lead bearing residues) @4 TPA, cat. 9.2 (Lead ash or particulate from flue gas) @ 0.4 TPA & 9.3 (Acid from used batteries) @ 0.02 KLA.</p>
<p>The industry was issued notice u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 along with show cause notice before revocation of authorization under HOWM Rules, 2016 with an opportunity of personal hearing before the Chief Environmental Engineer on 22.12.2022 wherein it was decieded that directions u/s 33-A of the Water Act, 1974 & u/s 31-A of the Air Act, 1981 be issued for closure of the industry and simultaneously, PSPCL authorities be asked to disconnect the electric connection of the industry with immediate effect.</p>
<p>Directions u/s 33-A of Water Act, 1974 & u/s 31-A of Air Act, 1981 were issued to the industry vide letter no. 514 & 512 dated 06.02.2023 and PSPCL authorities were directed vide letter no. 516-17 dated 06.02.2023 to disconnect the electric supply of the industry, respectively.</p>
<p>Now, the industry has applied for renewal in validity of consent to operate under the Water Act, 1974 & the Air Act, 1981 for production of Lead / Lead Alloys / Lead Battery Plates / Lead Oxide @ 3700 MT / Year.</p>
<p>The industry was visited by RO, FDK on 06.03.2023 and it was reported that :-</p>
<p><!-- [if !supportLists]-->1) <!--[endif]-->The industry was not in operation. Electric connection of the industry was found disconnected during the visit.</p>
<p><!-- [if !supportLists]-->2) <!--[endif]-->The industry has installed 01 pot type furnace (02 sections) and 01 no. refining pot which is attached with common gravity settling chambers followed by twin Cyclone, bag filter house and Alkali scrubber as APCD. Stack of 30 meters height has been provided with the APCD with adequate sampling arrangement. The industry has provided a separate energy meter with APCD.</p>
<p><!-- [if !supportLists]-->3) <!--[endif]-->The industry has installed 01 rotary furnace in separate shed, within existing premises and has connected the same with the existing APCD through 01 no. additional gravity settling chamber.</p>
<p><!-- [if !supportLists]-->4) <!--[endif]-->The industry has provided separate battery breaking area with glazed tile flooring and has made arrangements for collection of acid into plastic underground tank, if any generated during breaking of batteries. The industry has provided suction hood to capture acid mist fumes generated during battery breaking process.</p>
<p><!-- [if !supportLists]-->5) <!--[endif]-->The industry has provided separate washing section for washing of empty battery cases before their disposal in the market and has installed 02 no. collection tanks followed by neutralization tank as waste water treatment facility for treatment of waste water generated from washing section. During visit, treatment facility was found in line with the washing area.</p>
<p><!-- [if !supportLists]-->6) <!--[endif]-->The industry has planted trees in an area of about 1.5 kanal in its premises as per karnal’s technology for disposal of treated effluent.</p>
<p><!-- [if !supportLists]-->7) <!--[endif]-->The industry has provided separate Hazardous Waste storage room of adequate capacity with cement concrete flooring. Hazardous waste of category 9.1 of schedule-I was found stored after filling in HDPE bags. The industry has started maintaining the record of generation of hazardous waste.</p>
<p><!-- [if !supportLists]-->8) <!--[endif]-->The industry has installed 2 no. DG set of capacity 110 KVA & 75 KVA each without canopy.</p>
<p><!-- [if !supportLists]-->9) <!--[endif]-->The industry has constructed septic tank for treatment of its domestic effluent with provisions to discharge the treated domestic effluent onto land for plantation.</p>
<p><!-- [if !supportLists]-->10)<!--[endif]-->The industry is maintaining energy meter record for operation of APCD and is maintaining HW generation / lifting record.</p>
<p><!-- [if !supportLists]-->11)<!--[endif]-->The industry has not made any agreement with re-processor of HW category 9.3. The industry has also submitted copy of passbook as per which the industry has procured HW @ 3345 Kg from M/s Avon Cycles on 15.09.2022 which is within the permissible quantity of procurement by the industry.</p>
<p>If approved, following action may be taken please;</p>
<p><!-- [if !supportLists]-->1. <!--[endif]-->Consent to operate under the Water Act, 1974 may be granted to the industry for a period a period of six months with the suitable conditions and special condition that :-</p>
<p><!-- [if !supportLists]-->(a) <!--[endif]-->The industry shall comply with the standard operating procedures framed by CPCB for recycling of lead scrap/used lead acid batteries, in toto.</p>
<p><!-- [if !supportLists]-->(b) <!--[endif]-->The industry shall procure only dry batteries / lead scrap and shall not procure any used batteries containing spent acid until the industry makes agreement with the reprocessor of hazardous waste of category 9.3.</p>
<p><!-- [if !supportLists]-->2. <!--[endif]-->Directions u/s 33-A of the Water Act, 1974 may be issued for temporary restoration of electric supply of the industry.</p>
<p><!-- [if !supportLists]-->3. <!--[endif]-->Regional Office may be directed to seal the DG sets of capacity 110 KVA & 75 KVA installed by the industry without canopy.</p>
