It is submitted that the rice sheller was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/FGS/2019/9881437 dated 14/05/2019 and the Air Act, 1981 vide no. CTOA/Fresh/FGS/2019/9881311 dated 14/05/2019, both valid upto 30/09/2023 for Processing of Paddy @ 4.5 T/hour to produce Rice @ 3 MTD (with drier). Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents through OCMMS. Earlier consent fee deposited by the unit is adequate upto 30/09/2023. Now, the rice sheller has already deposited Rs. 42000/- vide UTR no. 570433249 dated 09/04/2023 as Water consent fee and Rs. 42000/- vide UTR no. 499743837 dated 09/04/2023 as Air consent fee against the fixed assets of Rs. 158.86 Lacs as on 16/02/2023 as per CA Certificate dated 16/02/2023 which is now adequate upto 30/09/2028 against the fixed assets of Rs. 139.33 Lacs as on 28/02/2023 as per CA Certificate dated 15/03/2023. There is an increase in the cost of fixed assets, accordingly, the industry has submitted details of the same and deposited Rs. 1100/- vide UTR no. 499743837 dated 09/04/2023 as NOC regularization fee, which is adequate. The industry has submitted stack emission analysis report carried out by Evapo Tech Technical Service and consultants (NABL Lab) on 15/02/2023. As per the report, the concentration of SPM of stack attached to pre-cleaner attached with dryer is 245 mg/Nm3 and of stack attached to milling process is 205 mg/Nm3, which are within permissible limits. The industry has also submitted Dissolution Deed executed on 30/06/2021 as per which Sh. Vikas Singla and Sh. Raghav Singla are retiring partners of the unit. The industry has submitted latest partnership deed executed on 01/07/2021 as per which, Sh. Vinod Kumar, Sh. Sunil Kumar and Sh. Sourav Goyal are partners of the unit. The industry was visited by AEE of this office on 18/04/2023. During visit, it was observed as under: 1.    The industry is not in operation due to off season. 2.    The industry has installed a husk fired mechanical dryer. The industry has provided cyclone separator as APCD with the same. 3.    The industry has provided cyclone separator as APCD with the milling and pre-cleaning sections. 4.    The industry has now provided ladder and other sample arrangement system for the APCD installed at milling section. 5.    The industry was advised to provide proper husk storage enclosure and HDPE warp for covering the same. 6.    The industry has provided brick wall in front of discharge point and has also provided wind screens of height 5’ above it. 7.    The industry has provided septic tanks for treatment of domestic effluent generated from office/labor toilets. 8.    The domestic effluent is discharging onto land for plantation after passing through septic tank.   9.    The industry has provided less plantation within its premises. However, the industry has advised to provide more plantation along the boundary wall. The Board vide letter no. 1955-57 dated 18/01/2023 has informed that department of Water Resources (RD and GR), Central Ground Water Authority, Ministry of Jal Shakti Govt. of India, New Delhi under Section 5 of the Environment (Protection) Act, 1986 has issued directions vide order dated 6/4/2022 that “It shall be mandatory for the project proponent abstracting ground water to obtain No objection Certificate from Central Ground Water Authority or the concerned State/UT Ground Water Authority as the case may be in the compliance conditions in consent to operate and consent to establish issued by the State pollution control Board” Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under: "The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."                         Keeping above in view, if approved, the consent to operate applied under the Water Act, 1974 and the Air Act, 1984 may be renewed upto 30/09/2028 for Processing of Paddy @ 4.5 T/hour to produce Raw Rice @ 3.0 T/hour alongwith drier furnace with usual conditions (auto generated) alongwith the following special conditions as under: 1.        This consent is valid for Processing of Paddy @ 4.5 MTD to produce Raw Rice @ 3.5 MTD (with drier). 2.        The rice sheller shall ensure the compliance of code of practice laid down by Govt. order no. 10/48/2004-STE (4) /932 dated. 15/10/2013 at all the times in true letter & spirit. 3.        The rice sheller shall get its stack emission samples analyzed from Boards lab in the upcoming paddy shelling season and submit compliance. 4.        The industry shall place wind screen of adequate height above the wall in the rice husk storage area before the paddy shelling season. 5.        The rice sheller shall put in place all the hoods, ductings & enclosures and other components of the APCD well before commissioning of the unit for next paddy shelling season and report the compliance in the regard to the Board prior to commissioning of the unit. 6.        The industry shall keep the APCD in good running conditions at all the times and shall also operate the same properly and effectively so as to achieve the standards prescribed by the Board. 7.        The industry shall dispose of the dust contained by APCD in an environmentally sound manner 8.        The industry is advised to obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA). 9.        The industry shall not generate and discharge any kind of trade effluent and shall discharge only domestic effluent onto land for plantation after passing through septic tank. 10.      The industry shall provide plantation all along the boundary wall of the unit, wherever space is available, within 15 days and submit compliance in this regard to the Board immediately thereafter. 11.      The industry shall abide by the fresh directions (if any) issued by the Hon'ble Punjab & Haryana High Court/ Govt./ Board for compliance of code of practice of rice sheller. 12.      The industry shall be bound to upgrade/ replace the APCD as per latest notification issued by the Ministry of Environment & Climate Change, New Delhi to achieve the emissions stands as amended time to time. 13.      The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
