Earlier, the industry was issued show cause notice for refusal of renewal of 'consent to operate' under the provisions of the Water Act, 1974 with an opportunity of personal before the Hon'ble Chairman of the Board on 24.5.2022, wherein it was decided that the matter regarding compliance of directions issued u/s 18 (I) (b) of Water Act, 1974 by CPCB on 13/16.12.2021 in the matter of sugar mills and submission of industry during hearing dated 24.05.2022 be put up before the Sub-Committee constituted by the Board for various policy matters & other important issues and in the meantime, the consent under the Water Act, 1974 be renewed upto 31.3.2023 subject to the condition that the industry is bound to comply with the direction(s) [if any] to be given by the Board in the matter. Further, the matter was referred to the sub-committee vide ZO letter no. 2946 dated 22.06.2022 for consideration and the decisions in the matter are still awaited.                Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS on 01.03.2023 for the production of White commercial sugar @ 125 TPD as main product and Bagasse @ 280 TPD, Molasses @ 50 TPD and Press Mud @ 36 TPD as by products using sugarcane @ 1250 TPD as raw material.                    The industry was visited on 22.03.2023 by RO, FDK and it has been reported as under:- 1. The industry was not in operation and lying closed due to off-season. The representative of the industry informed that the industry will be comes into operation in the month of Dec, 2023. 2.    ETP installed for treatment of trade effluent was found in line, however was not in operation. The industry has maintained record of ETP operation. 3.    The industry has provided dedicated plantation area in an area of 2 acre. The representative of the industry informed that additional plantation area of 3-4 acre will be developed during rainy season and before the commissioning of the plant in Dec. 2022 plantation area will be able to take the treated effluent from process. 4.    The industry has installed 02 no. boilers of capacity 20 TPH each and separate wet scrubber has been provided with the boiler section and common stack has been provided with these APCDs. 5.    The industry has already installed OCCEMS for monitoring of parameters pH, TSS, BOD, COD of ETP, same has been connected with the Board 6.    The industry has sold its entire molasses earlier stored in the pits and now the pit was being filled with the fuel ash and earth. 7.    Domestic effluent generated from the residential colony of the industry after treatment in septic tank is discharged into sugarcane farm. 8.    The industry has installed 01 no. DG set of capacity 166 KVA, which is equipped with canopy and adequate stack height. 9.    The industry is lifting its fuel ash to farmers to be utilized in fields and has maintained record of fuel ash lifted to nearby farmers.                    It is also submitted that the OCEMS provided by the industry are connected with the PPCB server, however, the online monitoring systems are lying offline since 08.02.2023.                    From above, it is clear that the industry is not complying with the provisions of Water Act, 1974 by not providing adequate plantation area as well as not operating ETP as per directions of 18 (I) (b) of Water Act, 1974.                 If approved, the consent to operate under Air Act, 1981 may be granted to the industry upto 31.03.2024 with the special condition that the industry shall get its air emission sampling conducted from the Board after its operation in the upcoming season. <span style="font-size: 12.0pt; line-height: 115%; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Tahoma; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">Competency: Hon'ble Chairman of the Board
