It is engaged in manufacturing </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Spring Leaf @ 4.8 MTD b</span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">y using Flat @ 5 MTD. The industry has applied for fresh 'consent to operate' under Water Act, 1974 and Air Act, 1981 along-with requisite documents through OCMMS. The industry has deposited </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif';">Rs. 32500/- vide UTR no. IDIBH22287407376 dated 14/10/2022 </span><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">under the Water Act, 1974 and Air Consent Fee: Rs. 32000/- vide UTR no. IDIBH22287411141 dated 14/10/2022 under Air Act, 1981 against the un-depreciated fixed assets of Rs. 73.85 Lacs as on 14/10/2022 as per CA certificate dated 14/11/2022, which is adequate upto <strong>31/12/2031</strong> under the Air Act as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee and penalty charges of 50%.<span style="color: red;"> </span></span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: 1.0in; line-height: 115%; margin: 10.35pt 0in 12.0pt 0in;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">Accordingly, the industry was visited by the AEE of this office on <strong>19/04/2023</strong>. During the visit, it was observed as under:</span></p>

<p class="MsoListParagraph" style="text-indent: -27.0pt; line-height: 115%; mso-list: l1 level1 lfo1; margin: 0in 0in 12.0pt 27.0pt;"><!-- [if !supportLists]--><span lang="EN-US" style="mso-font-width: 124%;"><span style="mso-list: Ignore;">8.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">It has submitted building plans approved on 27.07.2022 from Er. Rajnish Kumar Singla, Competent Person under Factories Act, 1948.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><a name="In_view_of_the_above,_it_is_recommended_"></a><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE(HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 31/12/2031</strong>.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">It is pertinent to mentioned here that a meeting was taken by the Hon'ble Chairman with the officers of the Board on 29/01/2021 at 11:00 AM in the Committee Room, Head Office, Patiala, wherein, it was decided that Consents to operate be issued to the industries for longer duration as per protocol laid down by the Board and more emphasis shall be laid on the monitoring.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';"><span style="mso-spacerun: yes;"> </span>Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -4.5pt; line-height: 115%; margin: 0in 0in 12.0pt 4.5pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';"><span style="mso-tab-count: 3;"> </span><strong><em>The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries.</em></strong></span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 1.0in; line-height: 115%;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">In view of above, it is therefore recommended that:</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l0 level1 lfo2; text-autospace: ideograph-numeric ideograph-other; margin: 0in 0in 12.0pt .25in;"><!-- [if !supportLists]--><strong style="mso-bidi-font-weight: normal;"><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span></strong><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry may be granted fresh consent to operate under the Water Act, 1974 & Air Act, 1981 <strong>upto 31/12/2031</strong> to the industry with suitable conditions and special conditions that:</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">a.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry is advised to obtain necessary clearance for Abstraction of Ground Water from the Punjab Water Regulation and Development Authority (PWRDA).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">b.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry maintains it's stabilized its vehicular movement area within industry/entry/exit points, to suppress the dust emissions.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">c.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry shall obtain NOC of the Board, if it changes any of its product/capacity of the plant.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">d.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry shall not change/modernize its manufacturing process and shall not increase its production capacity.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: .5in; mso-add-space: auto; text-indent: -.25in; line-height: 115%; mso-pagination: widow-orphan; mso-list: l2 level1 lfo3; text-autospace: ideograph-numeric ideograph-other;"><!-- [if !supportLists]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style';"><span style="mso-list: Ignore;">e.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">The industry shall get its building plans approved from Competent Authority if there is any change with respect to the already approved building plans.</span></p>
