Case perused. The industry was granted NOC for establishment of cement grinding unit @ 50 TPD vide certificate no. ZO/FDK/NOC/2004/187 dated 23.08.2004. The industry was further granted consents to operate. As per the record file report of visit dated 02.02.2011, it has been mentioned that the industry has installed 3 no. of ball mills including one no. of ball mill without NOC / consent of the Board. From this report, it can be inferred that the industry has installed 2 no. of ball mills in the unit as per its CTE. Further, the consents were renewed to the industry after dismantling of its additional installed ball mill from time to time. As per the record file, the industry was issued show cause notice on visit dated 19.07.2016 as per which the industry has installed one no. new ball mill by replacing the existing of 2 no. ball mill and further the industry was granted varied consent to operate for operation of 1 ball mill @ 40 TPD using 50 TPD raw material dated 10.07.2017 (valid upto  30.06.2020), which were further extended uptill 30.06.2027. Also, the industry has obtained NOC for expansion from the Board for increase in the production capacity in the existing premises dated 15.09.2020 (valid upto 14.09.2021) with the condition that the industry shall not carry out any construction activity without obtaining EC and will also not add any land area in the existing premises without permission from the Board. Meanwhile, the industry was issued show cause notice for refusal of renewal of CTOs under Water Act, 1974 & Air Act, 1981 alongwith hearing before SEE on 20.04.2022, as the industry has increased the land area by 6 kanals and as added additional ball mill of 50 TPD in the premises. As per the hearing decisions, the additional ball mill of the industry was sealed and the industry was directed not to carry out any expansion activities without obtaining NOC as well as EC. Again, the industry was issued show cause notice for revocation of CTos under Water Act, 1974 & Air Act, 1981 before the SEE on 16.12.2022, wherein it was decided that :- 1.      <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The industry shall ensure to develop three rows of spreading crown varieties of evergreen broad leaves trees all along the boundary wall in compliance to the Board's notification dated 02.09.1998. 2.      <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Regional Office, Faridkot shall visit the industry to verify the compliance (s) made by it, verify the production record and shall give clear cut comments alongwith recommendations in case of any violation is observed on the part of the industry. 3.      <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">During hearing, it has been made clear to the proprietor of the industry that in case of non-compliance of decision of the hearing within stipulated period / any violation(s), further action as deemed fit shall be initiated under the provisions of the Water Act, 1974 & Air Act, 1981. <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">                   Now, the industry has applied for CTOs under Water Act, 1974 & Air Act, 1981 for operation of 2 no. of ball mills for production of 40 TPD cement using 50 TPD raw material and increase in the land area by adding 6 kanal 2 Marla of land. The industry was visited by RO, FDK and it was reported as under:- 1.   The industry was not in operation during visit. 2.   The industry has installed 2 no. ball mills with separate bag filter as APCD, with stacks of adequate stack height. All the dust emission points have been connected with APCDs. During visit, one of the ball mill was lying sealed. 3.   The industry has now provided hoods on the emission generating sources such as jaw crushers, elevators etc. 4.   The industry has stabilized its movement area resulting in generation of dust emissions. 5.   The industry has provided septic tank for treatment of its domestic effluent and provision has been made for disposal of treated domestic effluent onto land for plantation. 6.   The industry has provided plantation along its boundary wall. 7.   The industry has installed storage-cum-feeding silo for the storage and feeding of fly ash. 8.   The industry has installed water sprinkler along the vehicular movement area as well as along the boundary wall so as to control the dust emissions generated due to vehicular movement as well as manufacturing activities.    9.   The industry has constructed a shed in the neighboring plot, connected with the industrial premises at the backside and having a separate entry gate. No machinery has been installed in this plot and only raw material was also lying stored under that shed. <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">                   To process the case, further additional information is required, If approved, the case be sent to RO to submit additional information on the following points: 1.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Whether the industry has made expansion as per CTE expansion granted and whether the industry has obtained EC under the EIA notification 2006 for increase in production capacity / installation of additional ball mill / increase in land area. 2.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">What are the capacities of the ball mills installed by the industry, documentary proof of the capacoity of ball mills. 3.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Whether the RO has verified the record regarding the production capacity of the industry and whether it is within the consented production. 4.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Whether the industry has installed any APCD in the land area added to the existing premises for storage and handling of raw material. 5.    <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Whether the industry is complying with the decisions of hearing dated 16.12.2022. <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">  <span style="font-family: Tahoma, 'sans-serif'; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">Competency : SEE
