<p class="MsoNormal">The undersigned is on earned leave and the matter has been forwarded as the unit has already been visited by the undersigned .</p>
<p class="MsoNormal">It is submitted that the industry was granted consent operate under Water Act, 1981 vide no. CTOW/Varied/FGS/2022/20310867 dated 15/12/2022 and under the Air Act, 1981 vide no. CTOA/Renewal/FGS/2022/20310863 dated 15/12/2022 both valid upto 31/12/2026 under the green category for manufacturing of Bars, Angels, Rounds, Joist & Square etc. @ 88 MTD or ERW Pipes @ 85 MTD with suitable conditions and special condition that the industry shall not use any other fuel except PNG in the furnace.</p>
<p class="MsoNormal">On surprise visit to the area by the undersigned on 24/03/2023 it was found that the stack of the industry was emitting thick black smoke and polluting the environment. The industry was immediately visited and it was observed as under: 1. The industry is a rolling mill and was in operation. 2. The industry has installed one re-heating furnace. The industry was using coal as fuel in its furnace. No APCD has been provided to scrub the emissions and the cyclone earlier provided was lying disconnected. The flue gas from the furnace were directly being conveyed to the stack. 3. Lot of process emissions from the front opening of the furnace where the raw material is fed, were being emitted into the atmosphere. 4. The representative of the industry informed that it is using coal on trial basis.</p>
<p class="MsoNormal">The industry was found using non-consented fuel i.e. coal in the furnace without APCD and permission from the Board, emitting thick black smoke from its stack and polluting the environment willfully.</p>
<p class="MsoNormal">The industry was found violating with the provisions of the Air (Prevention & Control of Pollution) Act, 1981. Mandi Gobindgarh has been declared Non-attainment city by CPCB and Action Plan for clean air has been prepared and submitted in Hon’ble NGT, New Delhi. One of the key activities of the Action Plan is control of industrial emissions by taking action against non-complying industrial units (CIE-4).</p>
<p class="MsoNormal">Meanwhile the industry has applied for consent operate under Water Act, 1981 and the Air Act, 1981 under the Orange category(2063-Steel and steel products using various furnaces like blast furnace /open hearth furnace/induction furnace/arc furnace/submerged arc furnace /basic oxygen furnace /hot rolling reheated furnace) for operating it is unit on coal.</p>
<p class="MsoNormal">Keeping in view of above, if approved, the 'consent to operate' under the Water Act (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 may be refused .</p>
