<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif'; color: red;"> </span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">Earlier, the industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981 vide no. <strong><em>CTOA/Renewal/ASR/2022/18929026 dated 01/07/2022 up to 31/12/2022 And Under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/ASR/2022/18929035 dated 01/07/2022 up to 31/12/2022 </em></strong><em>for Electroplating (on job basis) @20Kgs/day subject to the suitable condition mention therein and temporary restore the electric connection of the industry for six months.</em></span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif'; color: red;"> </span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: 0.5in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">Directions u/s 31-A of the Air (Prevention & Control) Act, 1981 and us/ 33-A of the Water (Prevention & Control) Act, 1974 were issued to PSPCL authorities vide Zonal Office letter. no. 2269-2271 dated 08/07/2022 for temporary restore the electric connection of the industry for six months i.e. upto 31/12/2022.</span></p>

<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif'; color: red;"> </span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">Now the industry has applied for renewal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 details of the case are as under:-</span></p>

<p class="MsoListParagraphCxSpFirst" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry has submitted CA certificate dated 31.03.2022, with value of gross fixed assets as Rs. 3.70 Lacs. It has already deposited Rs. 5500/- vide UTR Ref No. CBINH22147919815 dated 27.05.2022 under Water Act, 1974, Rs. 500/- vide UTR Ref No. CBINH22147919788 dated 27.05.2022 as application form fee, Rs. 5500/- vide UTR Ref No. CBINH22147918986 dated 27.05.2022 under Air Act, 1981, which is adequate upto 30/06/2027 under both acts.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry has a valid agreement with CETP - M/s JBR Technologies Pvt. Ltd., Ludhiana for lifting of effluent @ 2000 Lts./Month, valid for a period upto 29.11.2024.</span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormal" style="margin-bottom: 0.0001pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif'; color: red;"> </span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The site was visited by undersigned on 20.04.2023 and observed as following:-</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">1.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">During visit, industry was in operation and electric connection of the industry was intact.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry is engaged in process of electroplating (Nickle Plating) on job basis with 04 no. plating drums.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">3.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry has installed a water flow meter on fresh water line leading to process whose reading was 9999 lts. at the time of visit which is not correlating with the fresh water/effluent record submitted with application.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-bottom: 0.0001pt; text-align: justify; text-indent: -0.25in; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">4.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: 'Times New Roman';"> </span></span><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry has provided underground storage tank of unknown capacity for storage of effluent to be disposed off to JBR Private Ltd.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 4.5pt; text-align: justify; text-indent: 31.5pt; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">The industry is not complying the with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 0.0001pt 4.5pt; text-align: justify; text-indent: 31.5pt; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';"> </span></p>
<p class="MsoNormal" style="margin-left: 4.5pt; text-align: justify; line-height: normal;"><span lang="EN-US" style="font-size: 12pt; font-family: Tahoma, 'sans-serif';">Keeping in view of above, it is recommended that applications under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 of the industry may be refused please.</span></p>
