<p class="MsoNormal" style="text-align: justify;">It is submitted that the project proponent has given the reply of the show cause notice, which is reproduced as under:</p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in;"><em>“Our project is an area development project. We are not going to construct any plots in the Colony. The individual plot owners will construct the plots as per the approved drawings of GMADA. We have total 118 plots for independent floors. Out of these plots we have sold 39 plots to ACME HEIGHTS INFRASTRUCTURE (i.e. plot no. 14-21, 39-46, plot no. 99-100, 102 to 117 and plot no. 124-128 ) to construct independent floors. Which is being constructed by the said builder end the built up area of the same is less than 20000 sq. mtr. If the Built-up area of the plots of the said builder will increase from 20,000 sq mtr then they said builder will take EC from Punjab Pollution Control Board. </em></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in;"><em>Out of these plots we have also sold 37 plots (i.e plot no. 53 to 89) for independent floors to EKAM HIGHRISE builder. Which will be constructed by the said builder and the built up area for the same is also less than 20000 sq. mtr. If the Built-up area of the plots of the said builder will increase from 20,000 sq mtr then the said builder will also take EC from Punjab Pollution Control Board. </em></p>
<p class="MsoNormal" style="text-align: justify; text-indent: .5in;"><em>Remaining 42 plots of independent floors are not sold yet. If our company will construct these plots and the area of the same will increase from 20000 sq mtr then we will be liable to take EC from Punjab Pollution Control Board. However, if we sold these plots to another builder then he will be liable to take EC from the Board. All other plots of the project are individual plots.”</em></p>
<p class="MsoNormal" style="text-align: justify;"><span style="mso-spacerun: yes;"> </span>After perusal of the above undertaking, it was observed that as per the approved layout plan total 242 plots, consisting of 118 independent floors/ plots (i.e. 472 flats) and independent plots @ 124, but it is further undertaken by the project proponent that there are total 118 independent floors plots instead of 128, which are typographically error. The project proponent has informed that they have sold the two sites having independent floors to 2 parties namely M/s ACME HEIGHTS INFRASTRUCTURE & M/s EKAM HIGHRISE builder and some independent floors/ plots are not sold yet. The project proponent has given an undertaking that <strong>39 plots were sold to M/s Acme Height Infrastructure <em>(i.e. plot no. 14-21, 39-46, plot no. 99-100, 102 to 117 and plot no. 124-128) </em>and 37 plots sold to <em>EKAM HIGHRISE builder</em> <em>(i.e plot no. 53 to 89) for independent floors</em>,</strong> which shows that individual built up area of both the sites sold to above said builder is less than 20,000 sqm. Remaining 42 independent floors plots are not sold yet. The project proponent has further undertaken that if there company constructs the balanced plots i.e. 42 having independent floors, which have not sold yet and the built up area will increase beyond 20,000 sqm then will be liable to take EC. Further, if these plots will be sold to another builder than he will be liable to take EC from the Competent Authority.</p>
<p class="MsoNormal" style="text-align: justify;">The project proponent has also submitted the total built up area of the project including individual plots, commercial plots and independent floors, which is about <strong>93181.25 sqmtr {individual plot @ 124 [built up area @ 35212.24 sqmtr]+ commercial plots @ 22 [built up area 2746.24 sqmtr] + independent floors plots @ 118 [built up area @ 55222.77 sqmtr]}</strong> and same is less than 1,50,000 sqmtr.</p>
<p class="MsoNormal" style="text-align: justify;">Keeping in view of the above, it is recommended that:</p>
<p class="MsoNormal" style="margin-left: 31.5pt; text-align: justify;">A. Partial consent to operate may be granted under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for one year as per the previous recommendations.</p>
<p class="MsoListParagraphCxSpFirst" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The Revenue Authority may be directed to allow the registry of the individual plot owner.</p>
<p class="MsoListParagraphCxSpLast" style="margin-left: 67.5pt; mso-add-space: auto; text-align: justify; text-indent: -.25in; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="mso-bidi-font-family: Calibri; mso-bidi-theme-font: minor-latin;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]-->The PSPCL Authority may also direct to re-store the electric connection of the individual plot owner.</p>
<p class="MsoNormal" style="margin-left: 31.5pt; text-align: justify;">B. 1. The M/s Acme Height Infrastructure of 39 independents floor plots <span style="mso-spacerun: yes;"> </span><em>(i.e. plot no. 14-21, 39-46, plot no. 99-100, 102 to 117 and plot no. 124-128) may be issued show cause notice with an opportunity of hearing <span style="mso-spacerun: yes;"> </span>for obtaining NOC / CTO of the Board under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 individually. </em></p>
<p class="MsoNormal" style="margin-left: 31.5pt; text-align: justify;">2. M/s <em>EKAM HIGHRISE builder, of 37 independent floors plots</em> <em>(i.e plot no. 53 to 89) may be issued show cause notice with an opportunity of hearing <span style="mso-spacerun: yes;"> </span>for obtaining NOC / CTO of the Board under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 individually. </em></p>
<p class="MsoNormal" style="margin-left: 31.5pt; text-align: justify;">3. The project proponent shall bound to supply the correct information regarding selling of balance independence floors plots @ 42 no. if they will not construct 42 flats individually.</p>
