<p>It is submitted that the industry was granted consent to operate of the Board under the Air Act, 1981 vide no. ZP-II/SGR/WPC/2013/F-566 dated 06/05/2013 and the Air Act, 1981 vide no. ZP-II/SGR/APC/2013/F-457 dated 06/05/2013, both valid upto 31/03/2018, for manufacturing of IMFL @ 500 cases / day, with certain conditions mentioned therein. </p>
<p>The industry had earlier applied for obtaining renewal of consent to operate under the Water Act, 1974 and the Air Act,1981 through OCMMS on 15/05/2018, 12/07/2018 & 05/01/2019, 25/09/2020 and 21/09/2021. The applications of the industry under the Water Act, 1974 & the Air Act, 1981 were returned being scrutiny incomplete. </p>
<p>It is pertinent to mentioned here that the industry was issued direction u/s 33-A of the Water Act,1974 vide Board’s letter no. 3139 dated 08/09/2021 and u/s 31-A of the Air Act,1981 vide Board’s letter no. 3137 dated 08/09/2021, wherein it was directed as under :-</p>
<p><em><strong>“ That the industry will not restart its operation without obtaining valid Consent to operate of the Board as required under the provisions of the Water (Prevention & control of pollution) Act,1974 and the Air (Prevention & control of pollution) Act,1981.”</strong></em></p>
<p>Now, the industry has again applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 for manufacturing of IMFL @ 500 cases / day. </p>
<p>The industry has deposited consent fee under the Water Act, 1974 of Rs. 14000/- vide R. no. 59/4693 dated 15.05.2018 and Rs. 8400/- through google pay vide UPI ID 118926608343 dated 08/07/2021 and Rs. 96600/- vide UTR no. 000795549916 dated 02/02/2023 and the Air Act, 1981 of Rs. 14000/- under the Air Act, 1981 vide R. no. 59/4693 dated 15.05.2018 and Rs. 8400/- through google pay vide UPI ID 118926608343 dated 08/07/2021 and Rs. 96600/- vide UTR no. 000553305141 dated 10/05/2023, which is adequate upto 30/06/2028 after deduction of NOC fee of Rs. 1800/- for increase in value of fixed assets from Rs. 92.93 lacs to Rs. 128.77 lacs. </p>
<p>The industry has submitted the request letter vide no. 104 dated 13/03/2023 and stated that the industry has re-commissioned the unit in the month of July,2022 and was running on and off basis. Now, the unit has proposed to run the unit of full scale. Also, the industry has got approved the building plan approved from the Competent Person, Director of Factories, Punjab and has submitted the same. Now, the industry has 3 active partners, the industry has submitted the new partnership deep executed on 1/5/2021 in the name of :-</p>

<p>The industry clarified that the increase in value of fixed assets is due to upgradation of existing machinery and installation of new labelling machine. The industry has not increased in its production capacity. The industry has made addition in the building shed for storage of raw material and packaging material. </p>
<p>To verify the facts, the industry was visited by AEE of this office on 19/04/2023 and it was observed as under :-</p>
<p>The industry was not in operation. The representative of the industry has informed that the unit was lastly operated on 26/03/2023. As such ,the samples could not be collected. </p>
<p>The industry has provided ETP consisting of Bar screen ( oil and grease trap (equalization tank cum sedimentation ( Multimedia Filter(outlet to treat the trade effluent generated from spillage and Bottle washing process. </p>
<p>The industry upgraded the existing machinery and has installed the new labelling machine. The industry has not increased in its production capacity. The industry has made addition in the building shed for storage of raw material and packaging material. </p>
<p> The industry has installed DG set of capacity 35 KVA equipped with canopy and stack of adequate height.</p>
<p>From the above, it is evident that the industry operated its unit without valid consents of the Board under the Water Act,1974 and the Air Act,1981 and has failed to comply with the directions issued to it.</p>
<p>In view of the above, it is therefore, recommended that :-</p>
<p>1. The Consent to operate under the Water Act,1974 and the Air Act,1981 may be granted to the industry for one year with suitable conditions and special conditions as under :-</p>
<p>a) The industry shall got the effluent samples analyzed from Board’s lab and submit within one month.</p>
<p>b) The industry shall provide water meters at source of fresh water supply and outlet of ETP and shall maintain the record of the same on regular basis. </p>
<p>2. A suitable amount of Environment Compensation, as deemed fit by the competent authority may be imposed on the industry on the basis of best judgment and assessment, as the industry has failed to comply with the directions of the Board and operated its unit without valid Consents of the Board w.e.f. July, 2022.</p>
