As such, application may be returned from yourself and draft ti retrun the application is as under:</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; mso-line-height-alt: 10.95pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">“ It is intimated that the industry has filed an appeal against the order dated 3.2.2023 under the Water Act 1974 before the Appellate Authority, Department of Science, Technology and Environment on 9.3.2023. The industry, thereafter has filed Civil Writ Petition No. 6818 of 2023 before the Hon'ble Punjab and Haryana High Court alleging that the appeal is pending and not been decided by the authority. Vide order dated 29.3.2023, the Hon'ble Punjab and Haryana High Court has disposed of the Civil Writ Petition No. 6818 of 2023 with the direction that appeal may preferably be decided within 4 weeks by the Appellate Authority. Apart from that Punjab Pollution Control Board was also directed by the Hon'ble Punjab and Haryana High Court vide the said order dated 29.3.2023 to decide the consent application of the industry under the Air (Prevention and Control of Pollution) Act, 1981 within two weeks.</span></p>
<p class="MsoNormal" style="mso-margin-top-alt: auto; margin-bottom: .0001pt; text-align: justify; mso-line-height-alt: 10.95pt; background: white;"><span style="font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; mso-bidi-language: PA;">In view of this fact, the fresh application for consent to operate under Water (Prevention and Control of Pollution) Act, 1974 cannot be entertained by the Board as the appeal is to be heard on 25.04.2023”</span></p> |
