<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">It was desired by the Competent Authority that EE, RO, FDK to personally check the adequacy and applicability of Environmental Compensation to be levied upon the BKO in compliance to the minutes of meeting held before the Chairman, PPCB on 28.01.2020 at Head Office, Patiala with Punjab Brick Kiln Association regarding compliance of Govt. dated 28.05.2019 and to submit the case with clear cut recommendations within 3 days.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">It is submitted that as per the Govt. directions dated 28.05.2019 issued u/s 5 of Environment (Protection) Act, 1986, the brick kilns which are continuing to operate and are in the process of conversion to induced draught technology with zig zag setting / yet to start the process of such conversion are required to pay environmental compensation on the basis of 'polluter pay principle' to the Punjab Pollution Control Board with effect from 01.02.2019 till the adoption of induced draught technology with zig zag setting. This implies that the brick kilns are required to pay the environmental compensation with effect from 01.02.2019 till they operated the kiln without converting to said technology.</span></p>
<p class="MsoNormal" style="margin-bottom: 6.0pt; text-align: justify; line-height: 150%;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">Further, in the minutes of meeting held by the Chairman of PPCB on 28.01.2020 with the Punjab brick kiln association regarding compliance of the orders of the Govt. dated 28.05.2019, amongst other decisions, it was decided that:-</span></p>
<p class="MsoListParagraphCxSpFirst" style="mso-add-space: auto; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">The Regional Offices of the Board are required to impose / charge environmental compensation from the brick kiln ownersfrom 01.02.2019 to 30.09.2019 for the period for which the brick kilns are actually operated (without converting to the induced draught technology).</span></p>
<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-indent: -.25in; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt .5in;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma; color: black;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;">In case brick kiln is not operated after 30.06.2019 due to rainy season but the same brick kiln restarted its operations later on but without converting to induced draught technology, then environmental compensation will be levied for full period till the adoption of new technology.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 0in .0001pt .25in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;"><span style="mso-tab-count: 2;"> </span>The Regional Office has reported that the brick kiln has operated with FCBTK technology from 01.10.2019 to 31.05.2020 and has deposited Rs. 2, 00,000/- (08 months @ Rs. 25,000/month) as environmental compensation.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 0in .0001pt .25in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;"><span style="mso-tab-count: 2;"> </span>In view of the decisions of the meeting dated 28.01.2020, the brick kiln is required to deposit environmental compensation from 01.02.2019 to 31.05.2020 i.e. 16 months @ Rs. 25,000 /month which comes out to be Rs. 4,00,000/-. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in 0in .0001pt .25in;"><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black;"><span style="mso-tab-count: 2;"> </span>If approved, the Regional Office be requested to get the remaining amount of Rs. 2.0 lac as environmental compensation deposited from the brick kiln to conclude the application. </span></p>
