<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -28.35pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The wastewater was being discharged into MC sewer as informed by the representative of the hotel, however 04 haudis were also provided to separate solid waste from the wastewater before discharging it into sewer</span></p>
<p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -28.35pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The representative informed that the solid waste is being disposed of at secondary points of dump site of MCL by their own. However no agreement made with the MCL could be produced for the disposal of solid waste by the hotel. </span></p>

<p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-justify: inter-ideograph; text-indent: -28.35pt; line-height: 150%; mso-list: l1 level1 lfo1; margin: 0in 0in .0001pt 35.45pt;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">7.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">The hotel was running at the site without obtaining Consents to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. </span></p>
<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Accordingly, notice u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued to the hotel alongwith opportunity of personal hearing before CEE, Ludhiana on 18.11.2022, wwherein it was decided as under:-</span></p>

But, the hotel has failed to reapply the same till date. </span></p>

<p class="MsoNormal" style="text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Accordingly, compliance of proceedings of hearing dated 18.11.2022 has been sent through e-office as above. Thereafter Show cause notice was issued to the PP alongwith opportunity of personal hearing on 1.05.2023 before SEE- ZO-2, Ludhiana. Proceedings of the said hearing are yet awaited. </span></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">Now, the PP has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. <strong>The PP has deposited Rs 25200/- vide UTR no. SBIN223132897254 dated 12.05.2023, Rs 50400/- vide UTR no. SBIN123018250836 dated 18.01.2023 as air consent fee and Rs 25200/- vide UTR no. SBIN223132899504 dated 12.05.2023, Rs 50400/- vide UTR no. SBIN123018255110 dated 18.01.2023 as water consent fee. The PP has also submitted Rs 61400/- for Air CTO and Rs. 61400 Water CTO via UTR no. SBIN523143617381 dated 23/05/2023 and UTR no. SBIN523143620803 dated 23/05/2023 respectively, which are not yet verified. </strong>As such, the fee submitted by the industry is not adequate under both acts. <strong>The PP has also submitted a letter issued by the Executive Engineer, O&M Cell, MCL Zone-D vide no. 27/XEN/OM/ZD dated 02.05.2023 mentioning that the hotel is connected with STP Balloke.</strong> The hotel has also submitted copy of electricity bill as a proof of date of commissioning, as per which the hotel has commissioned on 04.08.2010. The hotel has neither submitted land use pattern of the site nor any regularization/continuity certificate from concerned authorities. Further, the hotel is not fully complying with the guidelines dated 02.02.2021. </span></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><strong><span style="font-size: 12.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">It is pertinent to mention here that the hotel has earlier applied for obtaining Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, but same were returned twice due to incomplete applications. The application of the hotel is still incomplete.</span></strong></p>
<p class="MsoNormal" style="margin-bottom: .0001pt; text-align: justify; text-justify: inter-ideograph; line-height: 150%;"><span style="font-family: Tahoma, 'sans-serif'; font-size: 16px;">In view of the above, it is recommended that Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused, please.</span></p> |
