The land area of industry was 39 Kanal 01 Marla bearing khasra no. 73//3/2(4-0), 4(8-0), 7(8-0), 8/1(4-0), 14(8-0), 17/2(7-1).</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">A sister concern unit namely M/s Shri Balaji Overseas existed adjoining to the premises of the industry in an area of 09 kanal bearing khasra no. 50//22/2 (6-11) & 23 min (2-9) for production of sorted rice @ 5 TPH.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Now the application applied for varied CTOs under Water Act, 1974 & Air Act, 1981 for production of steamed/raw rice @ 6 TPH and sorted rice @ 10 TPH. Addition of land area of 47 kanal 05 Marlas (including land area of M/s Shri Balaji Overseas), bearing khasra no. 50//23/1/2(0-16), 23/2(3-6), 24/1 (6-12), 21 min (4-0), 73//2(8-0), 3/1(4-0), 8/2/1(0-11), 9/1(4-0), 73/1 min east (4-0), 10 min (3-0), 50//22/2(6-11) & 23/2/1(2-9), thereby making total land area of 86 kanal 06 Marlas.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The DTP vide its memo no. 516 dated 22.06.2023 has intimated the Regional Office in reference to their office letter, as under:-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.75in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The site does not fall in any focal point or designated industrial zone. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.75in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Site falls in the notified local planning area of Fazilka, the master plan of which is yet to be prepared and the site is located at a distance of more than 1.5 km from the limits of Nagar council, Fazilka. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.75in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">No National Highway, State Highway, Scheduled Road and bye-pass exists within 500 meter distance from the site. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.75in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">Some residential area is located at a distance of approx. 250 meter from the source of pollution of the industry. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The Naib Tehsildar, Fazilka vide its countersigned report dated 26.05.2023 has intimated that village phirni/lal lakir, wild life statutory/zoo, approved residential area, educational institute, historical religious place and protected monuments is not located at a distance of 500 meter from the site. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The site was visited by the officer of the Board on 21.06.2023 and observed that there is a cluster of 40 residential houses and a road within 500 meter from the site. A clarification was sought from Tehsildar, Fazilka vide Regional Office letter no. 4093 dated 23.06.2023 to clarify that whether the residential houses located within 500 meter falls under the definition of approved residential area or not and whether the road is phirni/lal lakir of any village.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The Tehsildar, Fazilka vide report countersigned on 23.06.2023 has intimated that the residential houses located within 500 meter of site are not approved by PUDA, Municipal Corporation/Municipal Council/Improvement Trust or any other agency in the State and the said road is not lal lakir/phirni of any village. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry was visited on 21.06.2023 by the officer of the Board and it has been reported that the industry was not in operation. A HT line is passing through khasra no. 50//24/1 of the industry; however this piece of land is not yet added within the industrial premises and is used for the purpose of parking. The existing area of the industry is 79 kanal 14 Marlas. Boiler of 10 TPH capacity installed with multicylone followed by wet scrubber as APCD. Cyclone installed as APCD with paddy pre-cleaner. The industry is complying with the code of practice notified by the Govt. of Punjab vide notification dated 15.10.2013. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">A similar case namely M/s Guru Kirpa Rice Industries, Village Pir Mohamad, Tehsil Zira, Distt. Ferozepur bearing application no. 21966846 dated 03.05.2023 was received, wherein it was reported by the Regional Office that about 29 residential houses are located within 500 meter from the site of the industry. In the said matter, <em>t</em></span><em><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman';">he Regional Office obtained legal opinon from the Senior Law Officer of the Board, <span style="background: yellow; mso-highlight: yellow;">wherein he has opinoned that in the siting guidelines framed by the Government there is no reference of scattered house and the residential area has been clearly defined i.e. area under a scheme notified by Punjab Urban Planning & Development Authority (PUDA), Municipal Corporation, Municipal Council, Improvement Trust or any other authority / agency in the State. From the perusal of the noting, it is observed that the proposal site is meeting with the siting criteria laid down by the Government of Punjab, Department of Science, Technology and Environment vide order dated 15.10.2023. I do not find any restriction for grant of NOC from pollution angle in the present case for the establishment of rice sheller/ saila plant. However suitable conditions may be imposed to ensure that pollution is not caused by the unit.</span></span></em></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 0.5in; text-indent: -0.25in; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol;"><span style="mso-list: Ignore;">·<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">In view of above, if approved, CTO under the Air Act, 1981 may be granted to the industry for proudciton of steamed/raw rice @ 6 TPH and sorted rice @ 10 TPH with validity upto 30.06.2028, subject to the following special conditions that:-</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; text-indent: -22.5pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">This consent to operate is valid for site area 79 kanal 14 Marla bearing khasra no. 73//3/2(4-0), 4(8-0), 7(8-0), 8/1(4-0), 14(8-0), 17/2(7-1), 50//23/1/2(0-16), 23/2(3-6), 21 min (4-0), 73//2(8-0), 3/1(4-0), 8/2/1(0-11), 9/1(4-0), 73/1 min east (4-0), 10 min (3-0), 50//22/2(6-11) & 23/2/1(2-9) and the industry will not carry out any expansion w.r.t. land area/production capacity without obtaining prior 'consent to establish' of the Board. </span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 67.5pt; text-indent: -22.5pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry will not add Khasra no. 50//24/1(6-12) within the existing premises of the industry at any instance.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 5pt 0in 0.0001pt 67.5pt; text-indent: -22.5pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry will ensure to comply with the code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no. 10/48/2004-STE(4)/932 dated 15.10.2013.</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 5pt 0in 0.0001pt 67.5pt; text-indent: -22.5pt; line-height: 150%; text-align: justify;"><!-- [if !supportLists]--><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span style="font-family: 'Tahoma','sans-serif';">The industry will get its air emission sample analzed from the Board' lab/Approved lab of the Board as per the policy of the Board. </span></p>
