<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Sir it is submitted that as per the record file, the industry was earlier operated by the name and style of M/s R.S Green foods, which was issued notice to issue directions U/S 33 A of the Water (Prevention and Control of Pollution) Act, 1974 and 31-A of the Air (Prevention and Control of Pollution) Act, 1981, along with oppoturnity of personal hearing before CEE on 12.01.2018, postponed to 16.01.2018. During hearing, it was decided as under:</span></p>

<p class="MsoListParagraphCxSpMiddle" style="margin-left: 28.9pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-IN;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">The industry shall also obtain NOC/Consent to Operate of the Board before the commissioning of the saila/steamed rice plant.</span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin-left: 28.9pt; mso-add-space: auto; text-align: justify; text-indent: -18.0pt; mso-list: l0 level1 lfo1;"><!-- [if !supportLists]--><span style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-fareast-font-family: 'Bookman Old Style'; mso-bidi-font-family: 'Bookman Old Style'; mso-ansi-language: EN-IN;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';"> </span></span></span><!--[endif]--><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Environmental Engineer, Regional Office, Patiala shall visit the industry after two weeks, verify the compliance of the hearing decisions and process the cases on merits.</span></p>

<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 1;"> </span>The proceeding of the hearing was conveyed to the industry vide this office letter no. 389 dated 17.01.2018 for complying with the decisions. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Thereafter, the unit was purchased by a new firm vide registry executed on 18.07.2022. Accordingly the firm had applied for obtaining fresh consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 under new name in the name & style of M/s Laxmi Narayan Foods, Village Nasirpur, Shambu-Bhadurgarh Road, Rajpura, Patiala.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Accordingly, The industry was visited by the AEE of this office on 08.09.2022 and was found complying with decision of the personal hearing held on 16.01.2018 as well as with the provision of the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;"> </span>and Air (Prevention and Control of Pollution) Act, 1981. </span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">For that reason, the industry was granted fresh CTO's by the competent authority i.e. CEE. <strong>Hence no action is pending against the new firm i.e. M/s Laxmi Narayan Foods.</strong></span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">Moreover, as per Boards office order no. 461 dated 31.12.2013, EE, RO has been delegated the power to decide CTE/CTO to all the <strong>RICE SHELLER WITH DRYERS AND SAILA PLANTS.</strong></span></p>
<p class="MsoNormal" style="text-align: justify;"><strong><span lang="EN-US" style="font-size: 12.0pt; line-height: 115%; font-family: 'Bookman Old Style','serif'; mso-bidi-font-family: Tahoma;">In the present case, the industry is a small scale unit, and therefore the competency to decide the case, lies with EE, RO, PTA </span></strong></p>
