It is submitted that earlier, the industry is a Large Scale Red Category Unit and was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/NWS/2022/17625927 dated 31.03.2022 valid upto 31.12.2022 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/NWS/2022/17625830 dated 20.04.2022 valid upto 31.12.2022. Thereafter, the show cause notice issued to the industry along with personal hearing before the worthy Chairman  of the Board on 14.02.2023, wherein it was decided that: 1.    The industry shall comply with all the decisions of hearings earlier taken by the Competent Authority of the Board and shall make all required necessary up gradations / modifications to control pollution, by 1st week of March 2023. 2.    The consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be refused as industry has failed to achieve the prescribed emission norms and comply with the directions earlier issued by the Board. 3.    The Environmental Engineer, Regional office, Hoshiarpur shall personally visit the industry after stipulated period to verify the latest status, collect legal emission samples and submit the detailed report along with recommendations, accordingly. 4.    In case, the industry failed to comply with provisions of the Water Act, 1974 & Air ,Act, 1981, the Bank Guarantee amounting Rs. 3.0 lac earlier submitted by the industry shall be en-cashed and further action as per provisions of Water Act, 1974 & Air Act, 1981 shall be taken against the industry. 5.    The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 shall only be considered after compliance of decision no. (1) only.                    A        ccordingly, the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981  were refused.                    In compliance of the decisions of the personal hearing, the industry was visited by officer of this office on 20.03.2023 and report that was in operation.  The power plant has erected the new wet scrubbers as proposed by them during the erpsonal hearing.  The civil and errection work of the wet scrubber has been completed, however, the old wet scruber was found in operation and new wet scrubber is yet to be commissioned, due to which air emission samples could not be collected, the industry failed apply for consent to operate after refusal.                     Accordingly, the industry was given personal hearing before the wrothy Chairman of the Board on 01.06.2023 and the proceedings of the same is awaited.                    Now, the industry has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.                      The industry has already deposited 'consent to operate' fee under both the Acts upto 31.03.2024. The penalty for late application @ 10% is deposited under both Act of Rs. 21,120/- vide receipt no. 000433193179 dated 13.12.2021, which is adequate. The industry has submitted bank guarantee bearing No. 166519IGPER0001 dated 15.10.2019 of Rs. 3.00 lacs extended upto 14.10.2023.                    The industry was visited by the Environmental Engineer along with AEE of this office on 12.07.2023 and observed that the unit was not in operation due to off season.  However, during the visit it was observed that the industry has now connecting the new wet scrubber to the chimney and old wet scrubber has been dismantled.  The industry has installed 02 wert scrubbers in parrlel and same has been connected to the chimney. The industry has also made modification in the existing ESP by changing entire collecting electrods, emitting electrods, guide plates, hammers, rapper shafts and derive mechanism support insiluators heaters along with insiluators etc. with the aim to make it 100% perfect during the operation. The industry claims that the SPM at the outlet of the chimney will be arranging 45-65 mg/Nm3. As per application trade effluent @ 27 KLD and same was used for Ash Quenching, Wet Scrubber, Dust Supression, House Keeping, floor Wash and 25 KLD into City Drain leading to East Bein after ETP.  The domestic effluent @ 3.0 KLD is discharged into City Drain leading to East Bein after septic tank.                    In view of above, it is recommended that the case of the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981  may be considered for grant in light of the decisions of the personal hearing given before the worthy Chairman of the Board on 01.06.2023 please. <span style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; background: white; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: PA;">(Competency lies with worthy Chairman) <span style="font-size: 13.5pt; line-height: 115%; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; color: #5d5d5d; background: white; mso-bidi-language: PA;">
