CTOW/Fresh/RPN/2019/10822235 dated 24/09/2019 valid upto 31/03/2023 for Power Electricity @ 76.3 Megawatt subject to suitable terms and conditions mentioned therein.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The power plant has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 alongwith letter regarding power house & colony being separate entities alongwith assurance to dispose off the effluent to the Mojowal 08 MLD STP and copy of permission by EO, MC Nangal to dispose off the effluent into the STPs of capacity 08 MLD & 05 MLD.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The power plant was visited by the officer of the Board on 27.03.2023 and Sh. Jashandeep, Junior Engineer, BBMB Power House was contacted. During visit, it was observed as under: </span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">1. <span style="mso-tab-count: 1;"> </span>The power house is installed on Nangal Hydel channel & is producing 76.33 MW of energy.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">2. <span style="mso-tab-count: 1;"> </span>The energy is produced by 3 no. Hydro-electricity generators. Water from canal is taken through 3 no. penstocks to 3 no. turbines which are rotating the shafts further connected to hydro electric generators for generating electricity.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">3. <span style="mso-tab-count: 1;"> </span>At the power house has sanctioned strength of approximately 40-45 employees. These employees work in 03 shifts around the clock. The domestic effluent is discharged into concrete tank of diameter 03 meters. The domestic effluent generated from the colony is being collected into the 03 no. collection tanks of diameter 03 metre each.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">4. <span style="mso-tab-count: 1;"> </span>The representative informed that the department is in process of installation of STP of capacity 0.5 MLD for the residential colony and the wastewater from the power plant will also be discharged in the said STP after its installation; however, the construction has not been started till date.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">5. <span style="mso-tab-count: 1;"> </span>The power house has not yet disposed off its un-treated effluent from the collection tank to the Mojowal 08 MLD STP.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; tab-stops: 27.0pt; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">6. <span style="mso-tab-count: 1;"> </span>The Additional SE, O&M Division BBMB informed that very less wastewater is being generated and the wastewater will be lifted from the collection tank to the Mojowal STP 08 MLD after the effluent capacity of collection tank is near full. Further, it was informed that proper record will be kept regarding transfer of the effluent.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The</span><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-fareast-font-family: Calibri; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;"> BBMB authorities served show cause notice for refusal of renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 alongwith an opportunity of personal hearing before the Chairman of the Board on 27.04.2023 vide Board's letter no. 2600 dated 17.04.2023. During hearing, the Chairman of the Board decided as under</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">1.<span style="mso-tab-count: 1;"> </span>The Authorities of BBMB, Kotla Power House, Anandpur Sahib, Rupnagar shall submit a bank guarantee to the Board amounting to Rs. 5 Lakh within 7 days as an assurance to install and commission STP of capacity 1.0 MLD at Kotla within one year.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">2. <span style="mso-tab-count: 1;"> </span>It is made clear to the authorities that in case of failure to commission STP within one year, further action under the Water (Prevention and Control of Pollution) Act, 1974 shall be initiated against the authorities which shall include encashment of the bank guarantee to be submitted by the authorities in this regard.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">3. <span style="mso-tab-count: 1;"> </span>The authorities shall not dispose off its domestic effluent illegally into any water body or onto land for stagnation.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">4. <span style="mso-tab-count: 1;"> </span>The authorities shall dispose off its domestic effluent to the Mojowal STP 08 MLD and shall maintain the record of the same.</span></p>
<p class="MsoNormal" style="mso-para-margin-top: 0in; mso-para-margin-right: 0in; mso-para-margin-bottom: .6gd; mso-para-margin-left: 27.0pt; text-align: justify; text-indent: -27.0pt; line-height: 120%; background: white; margin: 0in 0in .1in 27.0pt;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">5. <span style="mso-tab-count: 1;"> </span>The consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 shall be decided after compliance of the decision mentioned at Sr. no. 1</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The decisions of the hearing 27/4/2023 were conveyed to the authority vide Board’s letter no. 3909 dated 25/5/2023 for compliance.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The BBMB authorities has failed to comply with the decision no. 1 of the personal hearing i.e. submission of bank guarantee to the Board within given timelines. In this regard, a reminder has already been issued by the Board to the authority on 09.06.2023.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The matter was considered by the Competent Authority of the Board and it was decided to give final opportunity of personal hearing to the authority due to non-compliance of decisions of hearing dated 27.04.2023 before taking further action in the matter.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">Accordingly, the power plant was issued show cause notice for refusal of consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 4629-30 dated 07.07.2023 has been given an opportunity of personal hearing on 14.07.2023 before the Chairman of the Board.</span></p>
<p class="MsoNormal" style="margin-bottom: .1in; mso-para-margin-bottom: .6gd; text-align: justify; text-indent: 1.0in; line-height: 120%;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The representative of the BBMB authorities attended the hearing informed that the authority is in process for obtaining approval regarding installation of the STP at site. Further, he informed that BBMB authorities have already given approval for submission of Bank Guarantee to the Punjab Pollution Control Board and same shall be submitted shortly.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 120%; margin: 0in .7pt 3.0pt 0in;"><span style="font-size: 11.5pt; line-height: 120%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">After hearing the officers of the Board and the representatives of the BBMB authorities, the Chairman of the Board decided that:</span></p>
