CTOA/Renewal/LDH1/2019/9593281 dated 20/03/2019, both valid upto 30/09/2023 for processing of Paddy @ 3 TPH to produce Rice @ 2 TPH, Rice Husk @ 0.67 T/Hour, Rice Bran @ 0.09 T/Hour and Phuck @ 0.23 T/Hour<strong> (without drier)</strong>.</span></p>
<p class="MsoNoSpacing" style="margin-bottom: 10.0pt; text-align: justify; text-indent: 72.0pt; line-height: 115%;"><span style="font-family: 'Bookman Old Style',serif;">Now, the industry has applied for renewal of consent to operate under the Water Act, 1974 and the Air Act, 1981 alongwith requisite documents through OCMMS. The rice sheller has deposited Rs. 9000/- vide UTR no. </span><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-fareast-theme-font: minor-fareast; mso-bidi-font-family: Raavi; mso-bidi-theme-font: minor-bidi; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-bidi-language: AR-SA;">N208232565960435 dated</span><span lang="EN-US" style="font-family: 'Bookman Old Style',serif;"> </span><span style="font-family: 'Bookman Old Style',serif;">27/07/2023 as Water consent fee and Rs. 10600/- vide UTR no. N208232565927876 dated 27/07/2023 as Air consent fee against the fixed assets of Rs. 24.69 Lacs as on 19/04/2023 as per CA Certificate dated 19/04/2023. The consent fee is adequate <strong>upto 30/09/2028</strong> as per Board's Office Order dated 29/10/2018 after deducting NOC regularization fee. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt -.9pt 10.0pt 0cm;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif;">Further, PPCB has issued office order no. 443 dated 09.08.2021 with subject Auto 'Acknowledgement-cum- Renewal Certificate' for regulatory clearances has mentioned that in suppression of Board's office order no. SEE(HQ)/F. No. 957/2016/59 dated 02.02.2016 and to provide ease of doing business to the entrepreneurs, the Board in its 185th meeting held on 07.01.2021 has decided to extend the facility for auto generated renewal to all categories of small scale industries / projects, without inspection / physical verification of the environmental parameters at the time of submission of such application(s) subject to the certain stipulations.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">Moreover, the Board vide Head Office letter no. 768-97 dated 13/01/2021, decided as under:</span></p>
<p class="MsoBodyText" style="line-height: 115%; margin: .15pt 4.5pt 12.0pt 9.0pt;"><strong><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';">"The Board shall continue to grant consent to establish/consent to operate to the industries with the advisory to obtain necessary clearance for abstraction of ground water from the Punjab Water Regulation and Development Authority (PWRDA). However, aforesaid clearance shall not be insisted upon by the Board at the time of grant of CTE/CTO to the industries."</span></strong></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi;">It is submitted that the Govt. of India, Ministry of Jal Shakti, Deptt. of Water Resources RD&GR Central Ground Water Authority, New Delhi has issued directions u/s 5 of Environment (Protection) Act, 1986 vide letter no. CGWA-21/6/2020-CGWA-101 dated 06/04/2022 “that it shall be mandatory for the Project Proponent abstracting ground water to obtain NOC from CGWA or the concerned State/ UT Ground Water Authority as the case made be in the compliance condition in consent to operate and consent to establish issued by the State Pollution Control Board.” Accordingly, the Board vide letter no. 1955-57 dated 18/01/2023 has informed all the officers of the Board in continuation to earlier circular no. CEE(HQ)/2018/7956-84 dated 03/03/2018 and 768-97 dated 13/01/2021 to ensure the compliance of the said directions.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi;">PWRDA vide notification dated 27.01.2023 has exempted units from obtaining any permission of the authority, which are extracting not more than 300 cubic meters of ground water per month.</span></p>
<p class="MsoNormal" style="margin-bottom: 12.0pt; text-align: justify; text-indent: 72.0pt;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Raavi;">In the subject cited case, the industry has mentioned ground water extraction @ 2.0 KLD. Considering 25 working days per month, ground water extraction will be 50 KL/month, which is less than 300 KL/month. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 72.0pt; margin: 12.0pt -.9pt 10.0pt 0cm;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: Calibri;">It is intimated that CPCB has already issued modified directions u/s 18(1)b of the Water Act, 1974 & the Air-Act, 1981 regarding Harmonization of Classification of Industrial sectors under Red/Orange/Green/White categories vide its letter no. B 29012/ESS/CPA/2015-16/85-84 dated 7.3.2016 alongwith the "Final document on revised classification of Industrial sectors under Red, Orange, Green & White categories" which also includes the consent period for which the consents are to be granted to Red, Orange and Green category industries for 5 years, 10 years and 15 years respectively. Further, Board vide Head Office letter no. SEE (HQ-2)/2018/ 9982-10003 dated 27/08/2018 has directed to strictly follow the consent validity criteria for Red, Orange and Green category industries as mentioned in the modified directions issued by CPCB u/s 18(1)b of the Water Act, 1974 & the Air Act, 1981 i.e. consent to Red, Orange and Green category industries may be granted for 5 years, 10 years and 15 years respectively. But, in the subject cited case, the industry has deposited consent fee only <strong>upto 30/09/2028</strong>.</span></p>
<p class="MsoNormal" style="text-align: justify;"><span lang="EN-US" style="font-family: 'Bookman Old Style',serif; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman';"><span style="mso-tab-count: 1;"> </span>It is therefore recommended that the consent to operate applied under the Water Act, 1974 and the Air Act, 1984 may be renewed <strong>upto 30/09/2028</strong> for Processing of Paddy @ 3 T/hour to produce Raw Rice @ 2 T/hour <strong>(without drier)</strong> with usual conditions (auto generated) alongwith the following special conditions as under:</span></p>
