CTOW/Renewal/SGR/2019/11346479 dated 24/10/2019 and under the Air Act, 1981 vide no. CTOA/Renewal/SGR/2020/13921429 dated 11/10/2020, both are valid upto 30.09.2024, for manufacturing of Raw Rice (without sortex machinery & without dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material, under orange category in the name of Sh. Sanjiv Kumar (Partner). <a name="_GoBack"></a> The industry has submitted the partnership deed dated  20.06.2023, wherein it is mentioned that there was two partner of the unit namely, Sh. Sanjiv Kumar Singla s/o Kailash Chand & Sh Ajay Kumar S/o Ram Saran. The industry has submitted that the partner namely Sh Rajan Kumar S/o Sh. Madho Parshad, Rakesh Kumar S/o Sh. Amar Nath   Accordingly, the industry has applied for obtaining revised consent to operate under both the Acts for manufacturing of Raw Rice (without sortex machinery & without dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material, under orange category in the name of Sh. Sanjiv Kumar (Partner).  The fee already deposited by industry in previous granted applications was adequate upto 30.09.2024. Now, the industry has deposited of Rs. 1100/- through online vide UTR No. 634170869 dated 26/07/2023 on account of Water Act, 1974 and Rs. 1100/- through online vide UTR No. 980405044 dated 26/07/2023 on account of Air Act, 1981, against the value of fixed assets of Rs. 9.14 lacs as on 22.07.2023, as per CA certificate dated 22/07/2023. The aggregate fee is now adequate upto 30.09.2025 under the Water Act, 1974 and the Air Act, 1981.                    The industry has neither submitted emission sample report nor deposited air sample testing fee in advance.                      The industry has also submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. The industry has further submitted an undertaking that the consent to operate to my rice sheller unit be granted based on the undertaking submitted by me, therefore, in case during the visit to the industry in future, the entire contents of the undertaking or any part of this undertaking is found false, the Board shall be free to take action against the unit under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has also submitted undertaking regarding updation of APCD from time to time, in future when and required by PPCB or Punjab Govt. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets.  No complaint is pending against the industry. The industry was found complying with consent conditions during last visit and consents were granted thereafter.                   Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 for a period upto 30.09.2025 & under the Air Act, 1981 for a oeriod up to 30/09/2024 for manufacturing of Raw Rice (withour sortex machinery & without dryer) @ 1.0 TPH by using Paddy @ 1.5 TPH as raw material, under orange category, subject to certain conditions to be mentioned therein
