<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">It was brought out that the project proponent has applied for fresh consent to establish (NOC) from pollution angle under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for development of commercial project having 54 plots (162 showrooms) alongwith requisite document. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">The project proponent has submitted Joint Development Agreement between M/s Barnala Builder and M/s Kumar Developers, both the owner to the extent of two adjacent parcels of land total measuring 12300 Sq. yards. The respective ownership of both the Owner & the Developer are as under:</span></p>
<p class="MsoBodyText" style="margin: 0in 0.7pt 0.0001pt 0.5in; text-indent: -0.5in; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">a. <span style="mso-tab-count: 1;"> </span>2450 Sq. yards of land owned vide sale deed dated 29.07.2019 bearing vasika no. 4768 in favour of M/s Barnala Builders; and</span></p>
<p class="MsoBodyText" style="margin: 0in 0.7pt 0.0001pt 0.5in; text-indent: -0.5in; line-height: 150%; text-align: justify;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">b. <span style="mso-tab-count: 1;"> </span>9850 sq. yards of land owned vide sale deed dated 13.02.2017 bearing vasika no. 6854 in favour of M/s Kumar Developers. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">The site of the industry was visited by officer of the Board on 3/5/2023. During the visit, it was observed as un</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">d</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">er:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">1. <span style="mso-tab-count: 1;"> </span>The project proponent has proposed to develop to plots for construction showrooms. The project proponent has laid down the roads and sewerage pipelines.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">2. <span style="mso-tab-count: 1;"> </span>The project proponent shall sell the plots only and individual owner will construct showrooms itself.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">3. <span style="mso-tab-count: 1;"> </span>The project proponent has proposed to provide STP of capacity 30 KLD based on MBBR Technology. The treated wastewater will be disposed of into green area inside premises and excess treated waste water will be disposed of in 1650 sqyd adjoining land to be developed as per karnal technology. The project proponent has submitted copy of agreement with the land owner valid for 10 years along with aks sajjra of the additional land. This additional land is adequate for disposal of 34 KLD of treated domestic wastewater. </span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">4. <span style="mso-tab-count: 1;"> </span>The project proponent has proposed a mechanical composter for treatment of wet biodegradable waste.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">5. <span style="mso-tab-count: 1;"> </span>The 3 showrooms have been constructed on one no. plot. However, no occupancy has been provided. No construction work of STP has started at site till date.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">6. <span style="mso-tab-count: 1;"> </span>The project proponent has proposed to provide 1 DG set 1000 capacity and stack of adequate height.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The project proponent has not uploaded the report from Revenue Authority online w.r.t distance of siting parameters from the proposed site of the project. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">The project proponent has not submitted registered land agreement for disposal of effluent onto land of plantation. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">Out of two land owners developing the project, who will be responsible for environmental management has not been intimated by the project proponent. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">The project proponent is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. It was proposed to refuse the consent to establish (NOC) under the provisions of the Water (Prevention and Control</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO; mso-bidi-font-weight: bold; mso-bidi-font-style: italic;"> of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 after affording an opportunity of show cause-cum-personal hearing. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">Therefore, the project proponent was served show cause notice for <span style="mso-bidi-font-weight: bold;">refusal of consent to establish (NOC) from pollution angle applied under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 </span>with an opportunity of personal hearing vide Board’s letter no. 5086-87 dated 18/7/2023 before the Chief Environmental Engineer (P) of the Board on 28/7/2023.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">The representative of the proponent proponent attended the hearing and failed to give satisfactory reply of the show cause notice. He also failed to submit registered agreement for disposal of treated effluent onto land for plantation.<span style="mso-spacerun: yes;"> </span></span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">After hearing the representative of the industry and officers of the Board, it has been decided by the Chief Environmental Engineer (P) of the Board that </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">1)<span style="mso-tab-count: 1;"> </span>Consent to establish (NOC) from pollution angle applied by the project proponent under the provisions of the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;"> </span>and the Air (Prevention and Control of Pollution) Act, 1981 angle be refused. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">2)<span style="mso-tab-count: 1;"> </span>The project proponent shall re-submit the NOC application alongwith compliance report of observations of the officers of the Board alongwith requisite documents to the Board within 15-days and till then no activity shall be carried at the site by the Board. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">2)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the project site to verify the compliances and thereafter process the NOC application under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 on merits. </span></p>
<p style="text-align: justify; text-indent: 1.0in; line-height: 150%; background: white; margin: 0in 0in 6.0pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">If approved, proceedings of the personal hearing as above may be conveyed to the proponent and Environmental Engineer, PPCB, RO, SAS Nagar for compliance.</span></p> |
