<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">It was brought out that the </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">industry was earlier granted consent to operate under the Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Varied/SAS/2022/17494666 dated 2/2/2022, valid upto 30/06/2023, for manufacturing of Automobiles coach seats @ 700 Numbers/Day, Railway Material @ 13 Numbers/Day & Agriculture Components Equipment @ 10 Numbers/Day, subject to certain conditions and additional conditions that:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">1. <span style="mso-tab-count: 1;"> </span><span style="background: white;">The industry shall comply with the Environmental laws at all times.</span></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">2. <span style="mso-tab-count: 1;"> </span><span style="background: white;">The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / onto land for stagnation or into the ground at any time under any circumstances and will discharge only treated effluent onto land for plantation / irrigation conforming to the effluent standards prescribed by the Board / Ministry of Environment and Forests & Climate Change.</span></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">3. <span style="mso-tab-count: 1;"> </span><span style="background: white;">The industry shall ensure that at any time the effluent discharged by it shall not exceed the effluent standards laid down by the Board / Ministry of Environment and Forests & Climate Change from time to time.</span></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">4. <span style="mso-tab-count: 1;"> </span><span style="background: white;">The industry shall make necessary and adequate arrangements to hold back the effluent in case of failure of effluent treatment plants and during no demand period.</span></span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">5. <span style="mso-tab-count: 1;"> </span><span style="background: white;">The industry shall regularly maintain the record of treated effluent and make available to the visiting officer of the Board during the conduct of visit. </span></span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry has now applied for renewal consent to operate under the Water (Prevention & control of Pollution) Act, 1974, with same production capacity.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">The site of the industry was visited by officer of the Board on 5/7/2023 and it was observed that:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">1)<span style="mso-tab-count: 1;"> </span>The industry was in operation.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">2)<span style="mso-tab-count: 1;"> </span>The industry has installed two powder coating booth with inbuilt cyclone and stack of adequate height as APCD. The industry has also provided 02 electrically operated drying ovens.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">3)<span style="mso-tab-count: 1;"> </span></span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">The industry has provided submersible for extraction of fresh water to be consumed in Mobility Solution I & II and water meter reading on visit was noted as 586.59 m3. As per record, the water meter reading was 289.32m3 on 1/4/2023. As such, the unit I & II has consumed about 297 KL of fresh water.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">4)<span style="mso-tab-count: 1;"> </span>The industry has provided common ETP for treatment of effluent generated from phosphating section installed in Mobility Solution-I and Mobility Solution – II. The water meter reading for ETP was 2027 KL at the time of visit and as per record on 1.04.2023 was 1953.9 KL. As such, the industry has treated 73 KL of water in ETP since 1/04/2023. The generation of effluent seems to be on the lower side, considering that it has separate phosphating section in plant I & II.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">5)<span style="mso-tab-count: 1;"> </span>The industry has not providing separate fresh water meters on the phosphating section installed in Mobility Solution-I and Mobility Solution – II, as such consumption of fresh water in these sections could not be adjudged.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">6)<span style="mso-tab-count: 1;"> </span>The water meter reading on STP was noted as 13 KL. As per record of old meter, reading on 1/4/2023 was 4053.2 and on 17/6/2023 was 4494.2 KL. As such from 1/4/2023 to 17/6/2023 industry has discharged 442 KL of domestic effluent.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">7)<span style="mso-tab-count: 1;"> </span>The industry has provided separate STP and ETP for treatment of domestic effluent and trade effluent respectively. However, the over flow from clarifier of ETP is taken into collection tank of STP, which needs to be removed.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">8)<span style="mso-tab-count: 1;"> </span>The industry has not provided separate arrangement for collection of sample from ETP and STP. The industry was also advised to provide sample collection points at the outlet of ETP and STP.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white;"><span style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ansi-language: EN-IN; mso-fareast-language: EN-IN; mso-bidi-language: PA;">9)<span style="mso-tab-count: 1;"> </span>The industry has abstracted only 297 KL of fresh water since 01.04.2023, however, as per the record of ETP & STP only, it has discharged about 515 Kl of effluent. As such, the record seems to be manipulated.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry has not provided any provision to collect effluent samples from the outlet of ETP & STP and the record of the industry with regard to water consumption, wastewater generation is not in order due to which adequacy of plantation area/ disposal/ etc. could not be adjudged. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">The industry is not complying with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 as well as operating its outlet/ plant without valid consent to operate of the Board, thus, violating the provisions of the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;"> </span>intentionally and deliberately. It was proposed to refuse the renewal of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974.<span style="mso-spacerun: yes;"> </span></span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">Therefore, the industry was served show cause notice for refusal of renewal of consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 with an opportunity of personal hearing vide Board’s letter no. 5058-59 dated 18/7/2023 before the Chief Environmental Engineer (P) of the Board on </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">28</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">/7/2023.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">During hearing, representative of the unit submit written reply of show cause notice and same was taken on record. He informed that now the unit has complied with all the observations made by the visiting officer on 5/7/2023. He requested for grant of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 . </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">After hearing the representative of the industry and officers of the Board, it has been decided by the Chief Environmental Engineer (P) of the Board that:</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">1) <span style="mso-tab-count: 1;"> </span>To dispose of the pendency, consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;"> </span>may be granted to the unit for six months <span style="mso-spacerun: yes;"> </span>subject to suitable conditions. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in 6.0pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">2)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the unit verify the record being maintained by it and compliances at the site. He shall also carry out monitoring of ETP and thereafter send the report alongwith conclusive recommendations. </span></p>
<p style="text-align: justify; text-indent: 1.0in; line-height: 150%; background: white; margin: 0in 0in 6.0pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance.</span></p> |
