<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">It was brought out that the </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">industry was given personal hearing by the Chief Environmental Engineer (P) of the Board on 10.01.2023 and the same was attended by Ms. Lok Bandhu Sharma, Manager (Blending) on behalf of the industry. After hearing the representative of the industry and officers of the Board, the Chief Environmental Engineer (P) of the Board decided as under</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1.<span style="mso-tab-count: 1;"> </span>The industry shall operate its ETP, regularly and efficiently so as to achieve the effluent standards as prescribed by the Board.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2.<span style="mso-tab-count: 1;"> </span>The industry shall deposit a bank guarantee of Rs. 2.0 lakhs (valid for one year) in the O/o Environmental Engineer, Regional Office, SAS Nagar within 07 days as an assurance to properly operate ETP and achieve the prescribed effluent standards and compliance with the environmental laws.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3.<span style="mso-tab-count: 1;"> </span>The renewal of ‘consent to operate’ applied under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted initially for a period of six months which will be extended after the receipt of the detailed report from Environmental Engineer, Regional Office, SAS Nagar</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">4.<span style="mso-tab-count: 1;"> </span>The Environmental Engineer, Regional Office, SAS Nagar shall visit the industry after 15 days to monitor the ETP, verify the mode of disposal, verify the status plantation area as per Karnal Technology, verify the statements of the industry, verify the compliance of environmental laws and send his report / recommendations accordingly.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry was granted ‘consent to operate’ under the Water Act, 1974 vide no. CTOW/Renewal/SAS/2023/20046686 dated 24/1/2023, valid upto 23/7/2023 for the production of IMFL @ 7000 cases/day by using GNS @ 18.239 MTD, CAB/SCOTCH @ 6.188 MTD & CARAMEL @ 0.027 MTD as raw material, subject to certain condition mentioned therein.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">The industry has applied for renewal ‘Consent to Operate’ under the Water Act, 1974 along with requisite document. Accordingly, the industry was visited by officer of the Board on 23.03.2023 and on 12.06.2023 and it was observed as under:</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1.<span style="mso-tab-count: 1;"> </span>The industry was in operation and engaged in pickling of iron bars using sulphuric acid.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2.<span style="mso-tab-count: 1;"> </span>The industry has installed 03 no. of bottling lines in its premises i.e. one no. automatic line, one no. semiautomatic line and one manual line. Currently, 02 lines are in operation, i.e. automatic line and semiautomatic line.</span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3.<span style="mso-tab-count: 1;"> </span>The industry is maintaining record of the consumption of freshwater.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">4.<span style="mso-tab-count: 1;"> </span>The industry has provided EMF flow meter at the inlet of ETP cum STP and as per the records of reading maintained by the industry, around 4.1 KLD of wastewater is being treated in the said ETP cum STP.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">5.<span style="mso-tab-count: 1;"> </span>The industry is using its treated wastewater for flushing as well as plantation of green area developed by the premises. The industry is maintaining record of the same and as per the record, around 1 KLD of treated wastewater is being reused for flushing purpose and around 3 KLD of wastewater is being used for plantation purpose within premises.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">6.<span style="mso-tab-count: 1;"> </span>The industry has carried out plantation by developing lawns inside its premises and has also carried out Karnal Technology in an area of around 1300 sq. mtr. for utilization of treated wastewater. The arrangements made by the industry for disposal of treated effluent are adequate.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">T</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri;">he industry has not developed adequate plantation area for disposal of treated effluent at optimum capacity.<span style="mso-spacerun: yes;"> </span></span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">A</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">s per the application, the industry has filled water consumption of 48 KLD consumption and only generation of effluent @ 8.5 KLD.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">T</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">he</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;"> industry was </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">not submitted the water balance statement i.e. consumption of fresh water in its process vis-à-vis trade effluent generated, treated and and discharge alongwith adequacy of plantation area.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">T</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">he industry is not complying with the provisions of the Water Act, 1974 and as well as operating its outlet/ plant without valid consent to </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">operate</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;"> of the Board, willfully causing water pollution in the vicinity, thus, violating the provisions of the Water Act, 1974 intentionally & deliberately.</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;"> I</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">t </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">w</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Calibri; mso-fareast-language: KO;">as proposed to initiate action against the industry under the provisions of the Water (Prevention and Control of Pollution) Act, 1974 after affording an opportunity of show cause.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">Therefore, the industry was served show cause notice for refusal of renewal of consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 with an opportunity of personal hearing vide Board’s letter no. 5121-22 dated 19/7/2023 before the Chief Environmental Engineer (P) of the Board on 28/7/2023.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">The representative of the industry attended the hearing and submitted written reply and same was taken on record. During hearing, it was informed that the industry is now complying with all the observations made by visiting officer on 12/6/2023 and also developed adequate plantation area. He requested for grant of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">After hearing the representative of the industry and officers of the Board, it has been decided by the Chief Environmental Engineer (P) of the Board that:</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">1) <span style="mso-tab-count: 1;"> </span>To dispose of the pendency, consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974<span style="mso-spacerun: yes;"> </span>may be granted to the unit for six months<span style="mso-spacerun: yes;"> </span>subject to suitable conditions. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">2)<span style="mso-tab-count: 1;"> </span>The industry shall submit the details of CER activities being carried out by it within 15-days to the Board. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">3)<span style="mso-tab-count: 1;"> </span>The industry shall submit complete details of plantation area marked on layout plan where treated trade effluent and domestic effluent is being utilization onto land for plantation. The industry shall also submit all the records alongwith complete water balance in the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in 6.0pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">4)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry to verify the plantation area developed by the industry, water balance submitted by the industry & other compliances made by the industrial unit and thereafter shall send the report alongwith conclusive recommendations. </span></p>
<p style="text-align: justify; text-indent: 1.0in; line-height: 150%; background: white; margin: 0in 0in 6.0pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance.</span></p> |
