<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">It was brought out that the </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">industry was granted consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2022/20141954 dated 11/11/2022 and the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/ 2022/20088242 dated 11/11/2022, valid upto 10/2/2023) for manufacturing of JCB Pins @ 3000 Numbers/Day using Round Bars @ 14 Metric Tonnes/Day raw material with special conditions as mentioned therein.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry has applied varied consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of JCB Pins @ 3000 Numbers/Day using Round Bars @ 14 Metric Tonnes/Day raw material.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">From the <span style="background: white;">perusal</span> of documents submitted by the industry, it has been observed that:</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span class="txtstyle6"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1.<span style="mso-tab-count: 1;"> </span>The industry has applied varied consent to operate for same production capacity, raw material capacity and same wastewater generation and same source of air pollution, hence the industry needs to clarify why it has applied for varied CTO. </span></span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span class="txtstyle6"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2.<span style="mso-tab-count: 1;"> </span>The industry need to list out all the expansion done and source of air pollution/water pollution from that expansion and pollution control arrangements provided with it.</span></span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span class="txtstyle6"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3.<span style="mso-tab-count: 1;"> </span>The industry has not submitted approved building plan from competent authority under Factory Act, 1948 since it has applied for varied consent to operate.</span></span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span class="txtstyle6"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">4.<span style="mso-tab-count: 1;"> </span>The cost of CA certificate increased from Rs. 11.90 Crores to Rs. 17.55 Crores. The industry needs to submit detail of expansion made in plant and machinery along with bills.</span></span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry has not submitted any reply in the matter to the Board.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The site was visited by officer of the Board on 24/6/2023 and it was observed that:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1.<span style="mso-tab-count: 1;"> </span>The industry was in operation and is engaged in manufacturing of JCB pins using Round Bars.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2.<span style="mso-tab-count: 1;"> </span>The industry has installed 05 grinders, 10 VMC machines, 20 CNC machines, 04 electricity fired induction machine and one electricity fired hardening machine. Further, the industry has installed tanks for carrying out phosphating and electro chemical paint on JCB pins and hard-chrome tanks. The industry has removed electricity fired drier and paint booth earlier installed in the premises. The industry has not installed water meter over the process section from where water is taken in the collection tanks for carrying out phosphating, electro chemical paint and hard chrome. No record of water consumption and disposal could be produced during visit. The representative informed that they have not disposed off the effluent to authorized agency. The representative was asked to plug storm water drain provided near the process drain.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3.<span style="mso-tab-count: 1;"> </span>The industry has installed a tank 20 KL for the collection of effluent and the same was found filled with effluent.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">4.<span style="mso-tab-count: 1;"> </span>The industry has installed DG set of capacity 125 KVA with canopy and in-adequate stack height.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">5.<span style="mso-tab-count: 1;"> </span>The industry is located in industrial area approved for setting up of such type of industries.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">6.<span style="mso-tab-count: 1;"> </span>The domestic wastewater generated from the toilets is disposed off into MC sewer.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">7.<span style="mso-tab-count: 1;"> </span>The representative was advised to make agreement for disposal of hazardous waste of category 5.1 & 33.1, provide dedicated room for storage of hazardous waste and apply for authorization under Hazardous & Other Wastes (Management & Trans boundary Movement) Rules, 2016.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">8.<span style="mso-tab-count: 1;"> </span>The industry has not provided environmental data board outside the premises.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">The industry has violated the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. It has now been decided to afford an opportunity of show cause-cum- personal hearing before taking further action under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">Therefore, the industry was served notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air Act, 1981 and (2) Show cause notice refusal of varied consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 with an opportunity of personal hearing vide Board’s letter no. 5207-08 dated 20/7/2023 before the Chief Environmental Engineer (P) of the Board on 28/7/2023, with the following proposed directions:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1)<span style="mso-tab-count: 1;"> </span>Environment compensation shall be imposed on the Project Proponent as damage to the Environment.</span></p>
<p class="MsoBodyText" style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2)<span style="mso-tab-count: 1;"> </span>The varied consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 shall be refused. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3)<span style="mso-tab-count: 1;"> </span>The industry shall take all necessary steps to close down its operations and stop forthwith discharging any effluents/ wastewater into sewer/ into storm water drain/ inland surface water/ onto land for stagnation/ irrigation or through any mode.</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">4) The industry shall stop forthwith discharging any effluents/ emissions from its industrial premises or through any mode.</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">5) The industry will immediately stop its activities and will not restart the same unless all necessary water and air pollution control measures are taken and it obtains valid consent to operate of the Board under the provisions of Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">6) The Punjab State Power Corporation Ltd. authorities shall be directed to disconnect the supply of electricity available to the industry.</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">7) To seal DG set installed by the industry, if any.</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">Now, E.E, Regional Office, SAS Nagar reported that the industry has been again visited on 19/7/2023 and it was observed as under:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">1)<span style="mso-tab-count: 1;"> </span>The industry has installed tanks for carrying out phosphating and electro chemical paint on JCB pins and hard-chrome tanks. The industry has installed 2 water meters, one over the DM plant inlet tank and other of DM plant outlet and reading was 4.42 m3 and 34.9 m3 respectively and one meter over RO permeate and reading was 35.2 m3. As per bill checked, the industry has procured the bill from market on 06.07.2023 and hence water have consumed in the process after 6.07 only. The water from these meters has been taken in the process section such as phosphating, electro chemical paint and hard chrome. No record of water consumption and disposal could be produced during visit. The representative informed that they are yet to dispose off the effluent to authorized agency. <u>During visit untreated waste-water from water rinse tank after derusting was being disposed off into MC sewer which was later on stopped</u>.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">2)<span style="mso-tab-count: 1;"> </span>The storage tanks provided by the industry of capacity 4 KL and 2.5 KL was completely filled with effluent. The industry has also installed a syntax tank of 5 KL capacity and around 2600 ltr was found stored in this tank. The representative informed that during earlier visit, the capacity of tank was inadvertently mentioned as 20 KLD.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">3)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar has calculated the E.C from 24.06.2023 to date of hearing i.e. 28.07.2023 (35 days) amounting to Rs. 1,75,000/-</span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">The representative of the industry attended the hearing and submitted written reply and same was taken on record. He informed that the earlier bye-pass arrangements provided by the industry has been plugged. Due to non-operational of CETP, Chanalon, the trade effluent could not be got lifted and stored within the industrial premises. </span></p>
<p style="margin: 0in; margin-bottom: .0001pt; text-align: justify; text-indent: 1.0in; line-height: 150%; background: white;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">After hearing the representative of the industry and officers of the Board, it has been decided by the Chief Environmental Engineer (P) of the Board that:</span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">1) <span style="mso-tab-count: 1;"> </span>The consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 may be refused to the industry. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">2)<span style="mso-tab-count: 1;"> </span>The industry shall make a storage capacity of 20 KL as individual arrangements for storage of trade effluent or make other arrangements for in house treatment of the trade effluent. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">3)<span style="mso-tab-count: 1;"> </span>The industry shall not carry out any polluting process within its premises under any circumstances. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">4)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry to verify as to whether the industry has made arrangements of sufficient capacity for the storage of trade effluent and to verify the status of bye-pass arrangements earlier made by the industry for illegal disposal of trade effluent. </span></p>
<p style="text-align: justify; text-indent: -.5in; line-height: 150%; background: white; margin: 0in 0in .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; background: white;">5)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall calculate the Environment Compensation, which is to be imposed on the industry and get it vetted from the Committee constituted by the Board. </span></p>
<p style="text-align: justify; text-indent: 1.0in; line-height: 150%; background: white; margin: 0in 0in 6.0pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif;">If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance.</span></p> |
