A)   It is submitted that the industry is small scale red category dyeing unit. The industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOW/Renewal/LDH3/2020/11577977 & CTOA/Renewal/LDH3/2020/11578014 each dated 21.05.2020, both are valid upto30.06.2024for Dyeing of acrylic yarn on job basis @ 1400 kg/day with discharge of trade effluent @ 200 KLD into sewer after ETP & domestic effluent @ 1.0 KLD into sewer alongwith one boiler of 03 TPH & one DG set of capacity 75 KVA subject to conditions mentioned therein. B)   Now, the industry has applied for varied consent to operate under the Water Act, 1974 7 the Air Act, 1981 through OCMMS for the Dyeing of Acrylic/ Polyester Yarn @ 7.2 MTPD with discharge of trade effluent @ 434 KLD & domestic effluent @ 1.0 KLD into CETP 50 MLD along with one boiler of 04 TPH &two DG sets of capacity 125 KVA each. C)   The industry has deposited Rs. 10,400/- (8800/- Water + 1100/- NOC + 500/- form fee) vide UTR no. UCBAH23188456987 dated 07.07.2023 under Water Act, 1974 &Rs. 8800/- vide UTR no. UCBAH23188456022 dated 07.07.2023 under Air Act, 1981. The consent fee deposited by the industry is adequate upto 30.06.2028 under both acts. D)   Accordingly, the site of the industry was visited by officer of this office on 1.08.2023 and observed as under: <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">1.        The industry was in operation and engaged in the process of dyeing of yarn. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">2.         The study on effluent generation has been done by the Guru Nanak Dev Engineering College (GNE) and as per report it has total effluent generation as 572.8 KLD from its total 08 chamber of soft flow & 11 cabinet dyeing machines i.e. 05 of 120 Kg & 06 of 60 Kg. However, the industry has granted 434 KLD shares on 22.07.2022 of CETP, hence the discharge of the industry is 138.8 KLD more than the share allotted to it. Therefore, 4 cabinets machines (2 of 120 Kg & 02 of 60 Kg each) were sealed by the board. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">3.        The industry presently has installed 13 cabinet dyeing machines (5 of 120 Kg & 8 of 60 Kg) & all machines were found in operation. The industry has also installed 01 soft flow of 450 (03 Chambers) Kg & 01 soft flow of 300 Kg (02 chambers) having total chambers 5. These soft flow machines were found without steam, water & electric connection not in use. The representative of the industry informed that its old sealed cabinet dyeing machines (2 of 120 Kg & 02 of 60 Kg each) were going out of order due to seal & non operation. Hence, unit has sold its sealed 4 cabinet machines & 3 chambers of soft flow and installed old 4 cabinet of same capacity in place of it. The industry has requested to seal its all soft flow machines ,which are not in operation in place of its soft flow machines. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">4.        As per the GNE calculations total effluent generation from 13 cabinet dyeing machines (5 of 120 Kg & 8 of 60 Kg) and 5 chambers of soft flow will be around 570 KLD, but it has CETP share of 434 KLD from PDA as per letter dated 22.07.2022, hence excess machinery related additional discharge of 136 KLD , i;e 5 chamber of soft flow and one cabinet of 60 kg is required to be sealed. The industry has changed its machinery without prior NOC/Consent of the board. However, in present application it has mentioned above details. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">5.        The industry has submitted the detail of nos of lots, nos of bath, liquor ratio, production and corresponding effluent generation and same is enclosed in the list of the documents submitted by the industry and matching with the data given in the application form. The detail of machinery, nos of lots, nos of bath, liquor ratio, production and corresponding effluent generation has been submitted with list of documents. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">6.        Presently the minimum value between the effluent generation as per GNE report and CETP share allotted to the industry is being considered by the Competent Authority for grant of consent as already approved in such cases. The industry has applied for trade effluent & domestic effluent discharge @ 435 KLD into CETP. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">7.        The industry is connected with the conveyance system of CETP 50 MLD, Tajpur Road, Ludhiana for discharge its trade & domestic effluent. The industry has provided the flow meter at its final outlet leading to CETP. The industry was also provided the ordinary flow meter at inlet water supply. The industry advised to maintain the day to day record of water consumption. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">8.        The online SCADA EMF of the industry of last 7 days (9.08.2023 to 15.08.2023) has been checked and found that average discharge by the industry into the conveyance system of the CETP 50 MLD is 269 KLD. The discharge of the industry in individual day in the above said period is also less than the share allotted to the industry. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">9.        The industry has installed 01 FBC boiler of capacity 04 TPH with cyclone as APCD along with adequate stack height. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">10.     The industry has installed two DG sets of capacity125 KVA each equipped with canopies and adequate height. <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">11.     The matter regarding illegal allotment of share by PDA, Tajpur Road, Ludhiana is also pending in Vigilance department. The Board is submitting reply in this regard time to time to the Vigilance Department. <p class="MsoListParagraphCxSpLast" style="mso-add-space: auto; text-align: justify; text-indent: -27.0pt; line-height: 150%; mso-list: l2 level1 lfo2; tab-stops: 40.5pt; background: white; margin: 0in 0in 3.0pt 63.0pt;">12.     The industry was also raised the clarification to submit the additional details with respect to machinery, water consumption etc as approved by the competent authority in such cases however the industry till date has not submitted the reply was the same.                         In view of above, it is recommended that  show cause notice for refusal of Consent to operate under Air (Prevention & Control of Pollution) Act, 1981 be issued to the industry, please.  Competency: SEE, ZO-II, Ludhiana
