CTE/Fresh/SAS/2023/</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">20884629</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;"> dated 23/1/2023, valid upto 14/1/2024 for Sale of Four Wheel Vehicles @25Numbers/Day, Servicing & Repair of Automobiles @25Numbers/Day and Painting of Vehicles @3Numbers/Day with special conditions as under:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">1.<span style="mso-tab-count: 1;"> </span>The industry will not carry out servicing without obtaining prior permission of the Board.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">2.<span style="mso-tab-count: 1;"> </span>The industry will submit approved building plan from competent person under Factory Act, 1948 at the time of obtaining Consent to Operate.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">3.<span style="mso-tab-count: 1;"> </span>The industry will provide stack of adequate height and sampling arrangement with the paint booth.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">4.<span style="mso-tab-count: 1;"> </span>The industry will install the ETP with components as mentioned in the feasibility report submitted along with the NOC application.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">5.<span style="mso-tab-count: 1;"> </span>The industry shall obtain the necessary clearance for the abstraction of groundwater from the Punjab Water Regulation & Development Authority (PWRDA).</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">6.<span style="mso-tab-count: 1;"> </span>In case of any violation action u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 will be initiated for closure of the project proponent without further notice.</span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The industry has applied fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for Sale of Four Wheel Vehicles @25Numbers/Day, Servicing & Repair of Automobiles @25Numbers/Day and Painting Of Vehicles @3Numbers/Day along with requisite documents. The site was visited by officer of the Board on 14.07.2023 and contacted Sh. Kuldeep, GM Services</span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;"> (8195059977). During visit it was observed as under:</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">1.<span style="mso-tab-count: 1;"> </span>The service station was in operation and is engaged in servicing of four wheeler.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">2.<span style="mso-tab-count: 1;"> </span>Sources of air pollution are DG set of 62.5 KVA capacity which is provided with canopy & stack of adequate height and paint booth which is provided with inbuilt paint filter and stack of adequate height but no proper sampling platform.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">3.<span style="mso-tab-count: 1;"> </span>Source of water pollution are effluent generated during washing of four wheeler for which service station has installed ETP based on Physico chemical technology of 8.5 KLD capacity which was in operation during visit and sample was collected from outlet of ETP and same was analyzed by the Board’s Lab. As per the analysis results, the parameters are found beyond the permissible limits as prescribed by the Board.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">4.<span style="mso-tab-count: 1;"> </span>The treated water is partially disposed off into MC sewer in partially reused for washing purposes. The representative was advised to provide separate water meter to measure treated wastewater utilized for washing and treated wastewater disposed off into MC sewer. The industry is maintaining record of operation of ETP and as per record checked from 01.07.2023 approx. 1KLD water is being treated in the ETP. The industry has also provided the arrangement for bye-passing the untreated wastewater into sewer which the representative was advised to plug immediately.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">4.<span style="mso-tab-count: 1;"> </span>The representative informed that 8 to 10 vehicles are being washed on daily basis. No water meter has been provided on the fresh water line used for washing.</span></p>
<p class="MsoNormal" style="margin-left: .5in; text-align: justify; text-indent: -.5in; line-height: 150%; layout-grid-mode: char;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-fareast-font-family: Batang; mso-fareast-language: KO;">5.<span style="mso-tab-count: 1;"> </span>The industry has not provided hazardous waste room for storage of hazardous waste of category 5.1, 5.2, 33.1, 35.3 and 21.1. The industry has made agreement with M/s Golden Petro for disposal of category 5.1, made agreement with M/s Surya Chemical for disposal of category 33.1 and made agreement with TSDF Nimbuan for disposal of categories 5.2, 35.3 and 21.1. No record of generation and disposal of hazardous waste is maintained by the industry.</span></p>
<p class="MsoListParagraph" style="margin-left: 0in; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">The industry is not complying with the provisions of the Water Act, 1974 and as well as operating its outlet without obtaining consent to operate of the Board, willfully causing water pollution in the vicinity, thus, violating the provisions of the Water Act, 1974 intentionally & deliberately. It was proposed to refuse the consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 after affording an opportunity of show cause-cum-personal hearing. </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">Therefore, the industry was served show cause notice </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-bidi-font-family: Tahoma; mso-bidi-font-weight: bold;">refusal of consent to operate applied </span><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin; mso-fareast-language: EN-IN;">under the Water (Prevention & Control of Pollution) Act, 1974 vide Board's letter no. 5737-38 dated 9/8/2023 before the Senior Environmental Engineer (ZP-1) of the Board on 21/8/2023.<span style="mso-spacerun: yes;"> </span></span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin; color: black;">Sh. Hari Krishan, Service Manager of the unit attended the hearing. He neither submitted authority letter nor reply of show cause notice issued to the unit. Further, he failed to give any satisfactory reply of SCN issued for refusal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: 1.0in; line-height: 150%;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-theme-font: minor-latin;">After hearing the officers of the Board and the representative of the industry, the Senior Environmental Engineer (ZP-1) of the Board decided as under:</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1;">1) <span style="mso-tab-count: 1;"> </span>The renewal of consent to operate applied by the industry under the Water (Prevention & Control of Pollution) Act, 1974 shall be refused.</span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1;">2)<span style="mso-tab-count: 1;"> </span>The industry shall submkt bank guarantee amounting to Rs. 2 Lacs an assurance within 7-days in the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar to comply with the all the environment laws at all the times. </span></p>
<p class="MsoNormal" style="text-align: justify; text-indent: -.5in; line-height: 150%; margin: 0in .7pt .0001pt .5in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma; color: black; mso-themecolor: text1;">3)<span style="mso-tab-count: 1;"> </span>Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the industry as per protocol and send the report with recommendations accordingly, thereafter. </span></p>
<p class="MsoNormal" style="text-align: justify; line-height: 150%; margin: 0in .7pt 6.0pt 0in;"><span lang="EN-US" style="font-size: 11.0pt; line-height: 150%; font-family: 'Calibri',sans-serif; mso-ascii-theme-font: minor-latin; mso-hansi-theme-font: minor-latin; mso-bidi-font-family: Tahoma;"><span style="mso-tab-count: 2;"> </span>If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.</span></p> |
