The warehouse was established without obtaining NOC / CTO of the Board and is operating without having consent to operate.<span style="mso-spacerun: yes;">&nbsp;&nbsp; </span></span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">Now, the promoter of the establishment has applied for obtaining fresh consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 for operation of warehousein an area of 53604.53 Sq. m having built up area 31410 sqm under orange category along with requisite documents. The establishment has submit its following documents application form, CA certificate land documents, proof of date commissioning, building plan, CLU, Revenue certificate etc. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">Further, the establishment has submitted a letter issued by SEIAA, Punjab vide its letter no. 3678 dated 07.04.2021 regarding exemption of the unit for obtaining environment clearance, as already exempted by MoEF&amp;CC notification no. 325(E) dated 22.12.2014 read with MoEF&amp;CC OM dated 05.03.2015. Furthermore, the establishment has obtained CLU from DTP, Patiala memo no. 178 dated 19.01.2018 for establishment a warehouse unit in an area measuring 12.062 acres. </span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The establishment has submitted electricity bill as its date of commissioning proof i.e. 24.07.2020 and has accordingly deposited Rs. 192000/- vide UTR no. N229232599150398 dated 11.08.2023 as water consent fee and Rs. 192000/- vide UTR no. </span><span style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: 'Times New Roman'; color: black; mso-themecolor: text1; mso-ansi-language: EN-US;">N223232592678679 </span><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">dated 11.08.2023 as air consent fee (including penalty fee). The establishment has deposited Rs. 24000/- vide online receipt no. 360018010 dated 03.12.2021 as NOC regularization fee. The consent fee deposited by the industry is adequate upto <strong>30.06.2024</strong> after deducting penalty fee 96000/- each from the consent fee deposited under the Water Act, 1974 and the Air Act, 1981 against the value of fixed assets of Rs. 1536.25 Lakhs as on 17.05.2023 as per CA certificate submitted by the industry. The establishment has submitted only proposed revised building plan as approved by Joint Director, Director of Factories for total covered area approx. 31410 sqm. However, no completion has been submitted by the establishment.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">CLU- The industry has obtained CLU for an area of 12.062 acres from DTP vide memo No. 178-STP(P/SP-327) dated 19/01/2018 wherein it has been mentioned that the site of the industry falls in mixed land use zone of statuary Master Plan, Rajpura. As per zoning regulations of Master Plan, Rajpura, this activity is permissible within Land Use Zone.</span></p> <p class="MsoNormal" style="text-align: justify; line-height: 150%;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">Proof of Commissioning: Industry has submitted electricity bill as proof of commissioning dated 24/07/2020.</span></p> <p class="MsoListParagraphCxSpFirst" style="margin-left: 0in; mso-add-space: auto; text-align: justify; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">Accordingly, the industry was visited by the AEE of this office on 14.09.2023. During visit, it was observed as under: </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">1.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The establishment is a warehouse and has constructed 2 no. of shed, which are leased out to different delivery companies, one in each shed. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">2.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The establishment has installed 3 no. D.G. set of capacity (2 x 180 KVA and 1 x 62.5 KVA), which are equipped with canopy and stack of not adequate height.<span style="mso-spacerun: yes;">&nbsp; </span></span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">3.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The establishment has not provided water meter in the source of fresh water i.e. tubewell. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">4.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">The establishment has provided 3 no. rainwater establishment pits in its premises and waste water from domestic source and surface run off is going into same pits. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">5.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">No plantation is provided inside the premises. </span></p> <p class="MsoListParagraphCxSpMiddle" style="mso-add-space: auto; text-align: justify; text-indent: -22.5pt; line-height: 150%; mso-list: l0 level1 lfo1; margin: 0in 0in .0001pt 22.5pt;"><!-- [if !supportLists]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif'; mso-fareast-font-family: Tahoma;"><span style="mso-list: Ignore;">6.<span style="font: 7.0pt 'Times New Roman';">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </span></span></span><!--[endif]--><span lang="EN-IN" style="font-family: 'Tahoma','sans-serif';">It was observed that during visit that the domestic water consumption in the establishment will be more than 10 KLD as there are 200-300 people working in the different sheds and there is also a floating population of drivers coming for loading and unloading of parcels.</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0.0001pt 22.5pt; line-height: 150%; text-align: justify;" align="center"><span lang="EN-IN" style="font-size: 1.0pt; line-height: 150%; font-family: 'Tahoma','sans-serif';"><span style="mso-spacerun: yes;">&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;</span></span><span style="font-family: Tahoma, 'sans-serif'; text-indent: 1in;">Therefore, the establishment is intentionally and deliberately violating the provisions of Water Act, 1974 and the Air Act, 1981 by discharging its wastewater directly into the rain water harvesting pits without any treatment.</span><span style="font-family: Tahoma, 'sans-serif'; text-indent: 1in;">&nbsp;&nbsp;</span></p> <p class="MsoListParagraphCxSpMiddle" style="margin-left: 0in; mso-add-space: auto; text-align: justify; text-indent: 1.0in; line-height: 150%; mso-layout-grid-align: none; text-autospace: none;"><span style="font-family: Tahoma, 'sans-serif'; text-indent: 1in;">In view of the above, may if approved, recommendation be sent to SEE, ZO-1, Patiala for issuance of notice to directions u/s 33-A of the Water Act, 1974 and action u/s 31-A of the Air Act, 1981 for closure of the establishment.</span><span style="font-family: Tahoma, 'sans-serif'; text-indent: 1in;">&nbsp;</span></p> <p>&nbsp;</p>
