It is submitted that the industry was granted consent to operate under the Water Act, 1974 vide no. CTOW/Renewal/SGR/2022/20171958 dated 22/10/2022 valid upto 30/09/2023 and the Air Act, 1981 vide no. CTOA/Renewal/SGR/2022/20171581 dated 22/10/2022 valid upto 30/09/2023, for manufacturing of Sorted raw rice (Without dryer) @ 3.0 T/Hour by using Paddy @ 4.5 TPH as raw material under orange category in the name of Sh. Darshan Singh (Partner). Earlier, Sh. Gurcharan Singh had filed the complaint against the unit due to dispute between the partners. The case was also filed before the Hon’ble High Court by the complainant and legal opinion was also taken from the Senior Law Officer, Head Office, Patiala. The details are already mentioned in the previous note history of the consent case (20171581). The competent authority after obtaining the legal opinion from the Senior Law Officer, Head Office, Patiala had approved to grant the consent to operate under the Water Act, 1974 and the Air Act, 1981 to the rice sheller for one year with suitable conditions and a special condition that consent to operate shall be subject to the decisions of the Court(s) in any litigation which is pending between the parties. Earlier, Sh. Darshan Singh s/o Sh. Babu Singh and Sh. Amar Singh s/o Sh. Darshan Singh resident of Village Bhudan, Tehsil & District Malerkotla were the partners of the rice sheller and had submitted Affidavit in this regard dated 13.10.2022. Now, the rice sheller has submitted the death certificate of Sh. Darshan Singh and Sh. Gurcharan Singh voluntarily retires from the firm on 04.08.2023 and Sh. Amar Singh s/o Sh. Darshan Singh further took Sh. Sukhchain Singh and Smt. Harpreet Kaur of 2nd part and 3rd part respectively as his partners from 04.08.2023. The rice sheller has aslo submitted the Retirement cum Admission Deed duly certified from the Notary. Now, the industry has again applied for obtaining renewal of consent under the Water Act, 1974 and the Air Act, 1981 for manufacturing of Sorted raw rice (without Dryer) @ 3.0 TPH by using Paddy @ 4.5 TPH as raw material under orange category in the name of Sh. Sukhchain Singh (Partner). The industry had already deposited consent fee upto 30.09.2026. The industry now has deposited consent fee of Rs. 3600/- vide R.No. 35118687 dated 22/08/2023 under the Water Act, 1974 and Rs. 3600/- vide R.No. 690431871 dated 22/08/2023, under the Air Act, 1981, against the fixed assets of value i.e. Rs. 54.77 Lacs as per CA certificate date 07/08/2023. The deposited fee is adequate upto 30.09.2027 under the both the Acts. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for five years, ten years & 15 years respectively. The Board vide its letter no. 9982-1003 dated 27.03.2018 has requested this office to strictly follow consent validity criteria as mentioned in the modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. It is pertinent to mention here that the Board vide Office Order No. 59 dated 02.02.2016 decided to grant auto renewal of Consent to Operate/ Establish to Orange & Green Category of Industries within 7 days of its application submission without the need of visiting the site/ premises of the industry, in order to facilitate the industry. Further, it is intimated that there is no change in the underappreciated value of the fixed assets. The industry was found complying with consent conditions during last visit and consents were granted thereafter. Keeping above in view, it is recommended that consent to operate granted under the Water Act, 1974 & under the Air Act, 1981 may be renewed up to 30/09/2024 for manufacturing of Sorted raw rice (without Dryer) @ 3.0 TPH by using Paddy @ 4.5 TPH as raw as raw material under orange category, with usual conditions and special condition that 1.   Consent to operate shall be subject to the decisions of the Court(s) in any litigation which is pending between the parties. 2.   The industry will got analyzed its stack emission sample from Board’s lab or Board’s approved lab in coming season.
